I didn't get to see the art in question, so unless it looks exactly or extremely similar to the original art, then Midjourney is in the right. I mean, we can go down the rabbit hole with copyright as to what is or is not copied. For example, someone draws/created the first dog and then the next person comes along and draws a specific breed...then the next person refines it again on the same breed but with longer hair in a different pose...is that copyright?

That is a fair point, they are also good for artists or people that like to doodle while also having the option to write notes as well. It's a more niche market though compared to lined notebooks, and so I always found it strange that Printful didn't include a lined notebook for everyone else.

My opinion is that AI art's proper utilization is ideation. I'm an artist, and sometimes I struggle to come up with what I want to draw, how I want it to look, what the composition should be, etc. With a few simple prompts, I can get an assortment of images that I can then use as inspiration. Alternatively, if I were not an artist, and wanted to hire one, I could use AI to generate images similar to what I wanted and provide it to the artist as reference. They say a picture is worth a thousand words, and any artist who has tried (and occasionally failed) to capture a client's vision based on a written description may find that AI helps bridge that gap. That said, I'm not opposed to AI being used to create products straight-up. As an artist, my own art is essentially the result of me "scraping" all the visual references and personal experiences I've had over the course of my life. In other words, REAL artists do the same thing AI is doing. We're just not as fast or as prolific, simply because we're human and limited by things like time and skill. But the method of creation is still valid. AI is a tool. Like any tool, it is not moral or immoral unto itself - only those who use a tool can use it in a way that is wrong.

You Nailed It! Thank you! As an artist, I couldn't agree more. I was in film school when consumer grade digital cameras first hit the market. People acted the same way about digital vs film photography: "Oh no, the brilliant box is gonna kill my ability to earn a living." When film processing went digital: "Oh no. Photoshop is trying to steal my darkroom income." In music, it sounded like: "Oh no. Electric keyboards are gonna antiquate musicians and singers will only need boxes to make hits and I'm gonna starve." I could go on throughout every functional tool and medium that is used for creating art. Now, the same sort of people are projecting a mentality that technology's chokehold is finally being applied toward all artists- just because the box is learning how to use it's own previously perfected tools. "The creation cannot circumscribe the creator." That's my mentality. I've worked for 25+ years in harmony with the changing of the times and tools, as much as I could have. In fairness, I only found this channel because the companies who printed my artwork on overpriced shirts for several years became suddenly challenged by print-on-demand sites and refused to adapt their tools for the sake of keeping up with the times. "AI versus Artist" has to be the least likely to threaten Artists, if you think about it. As I've said thousands of times, "All Intelligence is Art, Officially Perceived by Some or Just Someone." Meanwhile, people screaming the loudest would still be screaming regardless, with or without the big bad bots and apprehensible apps. Smartphones, in particular, were destined to strike fear in the hearts of the dumb and uninspired among us, anway. Just my opinion.

I think you misunderstood the judges point. Their art is copyrighted, absolutely. But to file a copyright CLAIM, you are usually required to officially file it with the copyright office. That's why Disney always does it immediately, because they preemptively know they will probably have to sue someone.

As a trained artist myself, I agree. All of us artists have been trained by studying and emulating various styles and techniques of other artists, and as long as we don't replicate them, and present it as our own, it is fine. Artists build their own styles that way, by incorporating all their influences into their own style. Midjourney AI was trained in the same way. Furthermore, I think AI produced art will have a positive effect on the market for art produced by the human hand, such as real, fine art, paintings and drawings.

I heard that you can't use canva graphics and texts on Amazon because of sub licencing issues for Print on drmand T shirts. What do you know about this? In the past you said if we added to the graphics to make the design original we would be onay. At least thats what I understand. Does that still stand teue?

I know a video was made on this. Besides my Amazon Merch experiment (which actually had some t-shirts go on to become sellers now 2 or so years later, which was pretty cool to see) I don't sell on there, so I haven't kept up with their policy changes. They apparently have a very weird licensing rule which other POD platforms don't have. I'm unsure, I focus on building my own POD brands with Printful/Printify & they don't have any weird licensing rules. I'd recommend asking Amazon & Canva's legal teams directly, to be honest! What I will say is Canva can't control images they don't own. A ton of Public Domain/CC0 license images are in their library. They can't control what you do with them. Their license doesn't apply to those images 🙏

I think Skimmy just made a video, maybe early August. It seams Canva was iffy as to his pod questions, especially about Amazon. Not sure about Etsy and the distributors. Imho… it sounds too complex for me. I won’t use Canva at this point in time for print on demand.

Canva is very clear about their license rules. They even made a video being very transparent about it here. I have a great relationship, I sell designs I make with Canva. They even commented on my Canva tips video, haha! Here is their license video: kzbin.info/www/bejne/fIe1ZaZ_p7GXd5o The issue is over the fact that Amazon, specifically, requires a sublicense or something along those lines, in their current TOS. Which is a weird requirement. In reality, it doesn't impact anything, it's just a sublicense "on paper" so that they protect themselves for using your image on their website. In the spirit of Canva's license rules, I doubt they care or would chase this up at all since the entire purpose of their TOS is basically to stop you from reselling individual images and that's the spirit of it. But whether their license rules allow for Amazon's weird sublicense is I think a grey issue as I don't think Canva's license TOS currently really addresses that question. I don't think you can blame Canva for not being "clear" on Amazon's own TOS. That's why you've really just got to talk to both platforms about a conflict like this, not just Canva. Also - separate from this discussion altogether - I also think it's important to note that a lot of "negative" videos about Canva are going to come out because Canva recently kicked out most of their affiliates from their affiliate program. If you don't use them in a piece of content at least once a month, influencers can no longer get paid for leads. A lot of people will now take that as an "opportunity" to make a negative Canva video because honestly, they do get clicks! I am not saying that this video was about that at all, it's a good question to raise. I just mean in-general, a lot of "Canva sucks" videos will almost certainly come out now that people aren't getting paid by Canva anymore.

I still use dot journals / dot notebooks to take notes at meetings and conferences. Dot journals tend to be made with better quality paper. The dots show enough of a line to follow when writing, the dot layout makes creating a grid or chart quick and easy, and my favorite is that the lines don’t stand out as much as ink for pdf, OCR, and google notes when shared with my team or added to a project file. I also use dot journals as a travel journal. I start each trip with pages for business expenses and personal, add receipt envelopes then along the way add ideas, parts of brochures, tickets, sketches and hp sprocket images. It’s a great way to share my trips with family and friends and to review even years later. While I realize I am in the minority, I for one, am grateful the dot notebooks are still being made.

There were cases in the US a few years ago that reestablished that artists (photography in particular was the focus) do not have to register with the copyright office to be covered by the protection of the law. Some judges do not know this and rule otherwise but then get overturned on appeal. It is more important that if you have not registered that you be able to prove that your art is copied so it is really showing up in court with no specific examples that is likely to sink them. Hard to prove harm otherwise. I'm not an attorney either, but I do get advice from a good IP lawyer about my work.

This has never been an issue, it is well established within copyright law that you do not need to register your art. Most countries in the world have already signed a treaty specifying this. I think you have confused this aspect of copyright law, with the need to register it to submit a lawsuit. It has always been a requirement that to submit a lawsuit against someone that, for admin purposes, you need to actually officially file your copyright with the copyright office. It is no different to school. Every child has the right to go to school. You still need to actually register with your school, to attend it.

re the Midjourney lawsuit - I said when it first came up that it was a silly argument by the artists, because how is training an AI on publically available art any different from a human artist learning art by copying other artists, and then using those skills and techniques they learned when making their own original art? Those same artist bringing the lawsuit didn't learn their own art style in a vaccume. They are basically trying to make the argument that learning is theft, which is just ridiculous.

I do understand why the artists are upset with MidJourney. However, that doesn't mean they have a legit case. As a thought experiment, could I ask an artist to make me an image in the style of (let's say) Banksy? Yes, I could. Then could I legally sell that image if it doesn't look like any of Banksy's actual paintings? I would say: Yes I could! So in effect, MidJourney is as the artist whom I asked to make me a picture in the style of Banksy.

In the Banksy scenario, it’s not exactly copying. Mid journey is taking actual images without permission. Then manipulating them for their benefit and profit. God forbid they pay the artist instead of stealing the art.

Midjourney does not manipulate any photos it scraped during training. They don't "use" the images, besides as essentially a visual reference, like how people have saved & downloaded Anime art, and then used it to inspire their own drawings. Those people did not "manipulate" the art or "use" it, they just looked at it. That is what Midjourney does. It just looks at art, and learns from it. It's a pretty big, common misconception that Midjourney actually uses the art to generate other art pieces, it never uses art during the generation process, and it's honestly very understandable that people think this too. For awhile, people would even accuse Midjourney in my video comments of "photo bashing" which is essentially taking bits of pictures, and stitching them together, which Midjourney does NOT do at ALL.

But you aren’t hiring any artist. Many normal people couldn’t hire a big name artist. You would be just typing words on a screen. And AI does most of the work. I’ve been using Mid for a month. Very seductive. But is it good for creativity or the professional art, illustration, and photography world. For example, I can be inspired by Mickey Mouse. I can draw a mouse, develop my own style and sell it. But if it ends up being too much like Mickey, Disney has every right to sue you.

It's nothing like fan art at all. Fan art is when you take another intellectual properties characters or icons, and redraw it, in whatever style you want. Those characters and icons are protected by copyright. The art style that those characters or icons were drawn in, however, is not. It isn't illegal for a human to make art that is similar in style to another artist, in fact it isn't even illegal to blatantly copy another artists work as long as its modified to a sufficient degree such that it becomes your own piece. It is also not illegal for people to train by looking at other people's artwork. Given all these facts, I frankly don't see how midjourney could be viewed any differently.

That first RB one is such bs. First they say they have filters in place to catch it, which means they acknowledge it's copyright theft, then they say Atari didn't file a takedown, so... its only theft if the owner reports it? Why have a filter, why not operate under safe harbour like etsy does? But unlike Etsy, RB manufacture the designs and are therefore producing counterfeit goods. Surely there are human eyes involved in that part of the process, if not at least a 2nd filter? Does this mean anyone can manufacture IP now if they're not directly told not to? Seems a dangerous precedent to me...

I love my dot journal. Still use one daily to keep track of EVERYTHING. Since I work full-time and am a homeschool mom of a teenager and a pre-teen, my dot journal is a LIFE SAVER! As for the lawsuits, I am on the fence. I see where you're coming from regarding the fact that redbubble, etc., take fees from sellers and thus could/should be partially liable, but at the same time, I feel like we the sellers should be obsessively proactive regarding copyright. I still can't believe the number of people getting away with (for now) Disney copyright violations. Anything that is a logo is a no-go!

well one thing I do know and that is from hearing from lawyers and judges that AI art can't be copyrighted. I've heard that from several sources now, and heard from are own court system. Art to be copyrighted has to be made by a human, and sad part is not even animals can get art copyrighted. But if you modify your AI art to feel more like you did the work then it can be copyrighted.

I think that’s in part because of how people use it or how the soul the image is. If you just use it as part of a graphic or to create a pattern it’s definitely different than that just the image it’s self on the shirt. Because at that point it’s just a basic graphic T-shirt and that’s not everyone’s style. If people were using it for simple patterns it’s likely different than a graphic. Or incorporating it in a logo as a vector/graphic

I think that schools and universities routinely use various artists as examples to teach their students. They will even set assignments where students copy the style or even the specific image of an artist. Those works are not considered copyright infringement as long as they are not sold as original works by the artist. In this case, the AI uses the artists as inspiration but none of these works are claimed to be created by the artist that inspired it.

Artists sometimes imitate other artists style to hone their craft. They may crate art inspired by van Gogh or Salvador Dali. I'm unsure if the artists have grounds to sue on the basis of name/style generation if it doesn't look similar to their copyrighted work.

Food for thought regarding the artists sueing midjourney: The supreme court already presented a ruling that places all ai generated art in the public domain. The ruling was based on the idea that 1) the person requesting the art by producing an ai request was basically the same as a person commissioning artwork from an artist. And therefore does not own the copyright for the original work which would belong to the artist (who in theory COULD sign over the rights) 2) Only a person can hold ownership of a copyright. And since the artist in this case is an ai and not (for legal purposes) a person it: A) cannot own the copyright for the work it generated and B) cannot transfer the rights to the person who comissioned the art This lead the supreme court to determine that all ai generated works should become defacto public domain. NOW... With that in mind. Lets look at the aforementioned lawsuit: The artists themselves who want to sue midjourney created their original works by using skills developed through inspiration. Every artist without acception mimics other artists styles by vieing those other artists works then emulating the style while creating their own unique artistic piece. Midjourney's ai does exactly the same thing. Which roots the entire lawsuit deeply in hypocrisy. The only viable argument any artist can use is if their works were contained in a private vault (real world OR digital behind a password protected PRIVATE storage). But it is far more likely that they willingly shared their art online in an ooen forum as a form of public portfolio in order to attract comission requests. The midjourney ai's use of the datasets created from the publically available art works would be tantamount to an artist sitting in a museum sketching the Mona Lisa.

What would happen if there was an EU type ruling demanding that MidJourney "forget" any artwork that was copyrighted by EU artists. They have a law now demanding that companies delete data on citizens if they request it, this applies to Facebook and alike.

Are you also going to ask art students to forget any art they've seen by EU artists in case they produce something that has an element of someone's style? If so, why dont you ask all art galleries to remove all art by EU artists so no one can remember it, and then demand that anyone who has bought an artwork by an EU artist is not allowed to hang it in their house in case anyone sees it and remembers it. Then we'll see how much art those artists sell and how that affects their income.

We all "scrape" art as we see it then make our own art inspired but what we like and know. Similar to what Midjourney is doing. My daughter learned to draw but making fan art of her favorite cartoons. Now all her art is Similar but not the same as those cartoons, it's not stealing, it's inspiration. IMHO

I imagine portrait artists hated the camera when it was introduced. Art evolves. I’m not sure how you can claim infringement when it’s text that’s typed in. Maybe artists will need to trademark their names? I haven’t tried Midjourney yet but would like to play with it to see if I want to subscribe.

Correction EVERYTHING evolves over time. But most people fear change, hence why there are always factions of humans complaining or fighting all the time. The irony is the quicker you embrace change, the further ahead of the game you are. Using AI is a new acquired skill just as anything else. When you see how accurate some of these AI prompts are, it's like coding to get a particular picture outcome. The quicker that natural artists learn this skill too, they will be 10 x grater than what they currently are and 100x greater than the avg. person who uses AI

Its like jumping through hoops to get to midjourney especially if you are not already a discord member and familiar with how to use it. I wasn't. I was trying out many AI applications these last two days and that one by far would be the one I immediately knew I was least likely to use again. I should have made videos recording every process. 😑🙍‍♀

I like your videos and find them quite interesting, and you are one of the few KZbinrs that actually does deep research into the subject and is very objective. My only complaint is the use of Wikipedia as a source, as it is unreliable, and anybody can alter an article.

My 2 cents as an "Artist". A.I is a tool. It won't make you into an artist anymore than a plane will turn you into a bird. You need to be a true artist in all sense of the word for A.I to work for you: creativity, originality, some talent, and a metric ton of practice. Relax.

I disagree. Sadly, too many people appear to be fooled, or the buyers and users of the faux art think it is saving them money as opposed to hiring a real artist. So in the end, the result is less work for artists doing original artwork because cheapo buyers making use of this new "tool".

Artists have NOTHING to worry about, in 2 years time ai images will be saturated and a picture or painting drawn by a human will become so sought after they artist will be able to command any price.

Problem is there is waaaaaay to many people with money grabber background watching your videos and flooding the net with AI generated crap, and people with serious art and designer background mostly using AI for idea generation and not creating the design itself....hence i like that part of the process:DD

I'm curious to see how the midjourney prompt lawsuit plays out because Zoom just updated their terms saying they will be using all users and their content to train their AI program. it will set precedent for all companies to do the same. Seems like it's pretty much allowing companies to make money from us moving forward.

As long as you allow them to. There has been quite the backlash against zoom for their recent change to policies. And I for one will not be using their service going forward. Their reach seems to be so long that there would be nothing preventing them from selling your image to a movie production company and then having characters for a movie generated that look like you… As just one example.

The websites don't know if the uploader has or doesn't have the right to use trademarked/copyrighted materials...it's not their job to police. So yes, they take money from fees, but that's as far as their involvement goes. The original TM/CR holder can still come after the user...

I would understand that but that same standard isn't applied to KZbin. They have had to implement extremely strict copyright checks on their videos, because of lawsuits from music companies. And YT isn't even acting as a merchant on behalf of KZbinrs! So I find it very surprising that Redbubble legally isn't held to that same standard, their "checks" are nothing like KZbin's. That is not me agreeing or disagreeing, it's just more an observation that the music industry seems to get treated quite differently!

No. As a public figure, I have people that actively dislike me - such as you 🙏 I can't change people's minds that dislike me, but that is OK. However, when people who do dislike me find my products, they have attacked my business directly, such as: * Review bomb them with negative comments * Reported them for false copyright/trademark infringement * Reported them for falsely violating community guidelines All of these things put my business in jeopardy, which puts my staff in jeopardy. I have set up this very common boundary, which is not to reveal the products/stores I have, and I understand if you wish to only watch & follow KZbinrs that do reveal these and I respect that choice, and so I do just ask that you will respect mine 🙏🙏🙏

I'd like to use AI to help me pull my art together. I have my brand and concept but curious as to what AI would spit out for me. Then afterwards I would take that generative artwork and tweak it myself so I feel my own style is infused with it. I don't want to copy paste AI but use it to season my idea. 😅
