It's completely open on top with no roll bar. And hasn't been through American crash testing. I'm pretty sure the law would see it as a motorcycle. Also I think it's the fact that sit on it without seat belts. Instead of in it. I'm no expert so I could be talking out of my anal sphincter.

Legally it really does come down to number of wheels.

Technically, they should be manufactured with 3 wheels, then converted to 4 by the aftermarket. That would allow them to still be motorcycles or autocycles.

@@1t_wasnt_me I just know in the US it's completely legal. There are four wheel conversions for Polaris Slingshots that don't change the classification. The "outrigger" style motorcycle trike kits also technically have four wheels.
