I have heard the recordings on other youtube channels, its wasn't the air traffic controller's fault, it was the helicopter's pilot fault; and DEI in my opinion is at fault, it is impossible for the helicopter pilot not have seen the plane incoming with lights full on in a clear night.

No!!! The controller controls the airspace. It definitely was his fault despite handing off responsibility to maintain visual separation which can't realistically be done at night safely.
