It’s totally legal to go in/through/across someone’s car when they are stopped in a pedestrian crosswalk. Once you are stopped there, you are legally part of the crosswalk. In fact, if they would try to take off with you inside their car, it would be kidnapping. The same applies to someone parked in front of a fire hydrant. You are then legally part of the road and your windows can be broken to make room for the hose.

Great, he will get a fine for failing to yield, and she will pay for the damage because she smashed into him afterwards and what she did can be considered reckless driving (switching lane twice in a couple seconds without checking mirrors and blind spots)

@@zegamerz1980 Everything flowed from his failure to yield. She was attempting to pull around him after he placed his self in that position of illegally cutting her off. If you'll check the video again, she wasn't changing lanes. If I suddenly leap in front of your car and you hit me, it is not your fault. I placed myself in that position. As the driver entering the street, he must wait until the lane is clear of traffic before pulling out. Motorists already driving in the lane have an expectation they have the right of way and should not have to dodge cars who are trying to enter traffic.

@@JamesHarris- that is where you are wrong. An insurance company will see 2 different events. If she smashed in the back of his car after he failed to yield, it would be his fault. The road rage she made afterwards and smashing in the side of his car will be considered her fault as she was not in a position where this manoeuver was necassary. Check the footage, you will see she had stopped in her lane, or maybe 1/4 in the adjacent lane, then she suddenly slammed on the gas and tried to cut in front of him

@@zegamerz1980 but she was forced to swerve in to the wrong lane to avoid hitting him, so she was trying to get back in to the correct lane, when he hit her, if he wasnt being reckless and drving aggresively, he wouldnt have hit her, not sure tho as this is american road laws and lanes...in UK while there is a polite way of alternating letting people in, thats normally only of both lane of traffic that are merging are same amount, if camera drivers lane didnt have much traffic behind him, he was being impatient, and forced her to react, slamming on gas could be simply to avoid being obstacle or avoid car coming up behind, he then drove in to her by jerking forward.....

She was not fully in the lane when it starts, and the person cutting her off did not push her more than she already was, because she stopped before, then she slammed on the gas into the other lane and cut him off in return. The difference is, she slammed into him while doing so. One could even argue that she was not supposed to be there as the turning lane starts further than the position she was in at the start of the video.
