Many months ago I received a scam call. It said it appeared that I had bought an iphone on Amazon for a certain amount of money and if I agree that I had bought it, just hang up the phone. I hanged on the phone until the scammer hanged up first. Since then I don't answer my phone immediately unless I'm 100 % sure its someone I know.

I'd rather rewrite civil forward to only be allowed if the individuals convicted of a criminal offense and the money is proven to be gained from illegal activity. The government should not be able to go into your bank account to collect its fines any more than it can go into your home to collect its fines. The government has been taken over by criminals. @@unifiedtheoryoflife9922 credit reporting doesn't collect money, I was talking about a civil suit where both parties are private citizens, and not so called "civil seizure" where the government just decides to take your money because reasons. What I'm talking about has literally existed since courts of law and is subject to due proceed, namely it can only happen as a result of a verdict of a civil trial. And the alternative is that a business can be found grossly negligent, incompetent, or malicious and yet simply decline to pay their victims, and the only punishment they would receive is that paperwork would be lodged at a private business, maybe even themselves, detailing how naughty they have been.

An agent in Seattle literally put my aunt's money in her pocket. The agent opened my elderly aunt's wallet, removed all cash- about $300- and stuck it in her pocket. Gone. Supervisor threatened to arrest my aunt if she didn't move along.

One of their videos explains what they do. They take cases that may win them recognition with the Supreme Court and change policy. IJ cannot help people with natural law, because they are bound by oath to maritime/merchant law, so don't think of it so much as helping people, but changing the policies of commerce. I remember reading a report that pointed out that the average civil forfeiture of cash is less than one thousand dollars. The point was that the agents involved will know that if the legal expense of a lawsuit exceeds the amount seized, a lawsuit is unlikely. The cases we hear about are like the example in the video. If an innocent citizen is targeted for forfeiture of tens of thousands or more, the lawsuit becomes more compelling.

They have not ruled on it directly. They ruled on a case where someone’s vehicle was kept during a stop and arrest but they ruled the vehicle returned because it’s value was much higher then the applicable fines. So it wasn’t technically a ruling against civil asset forfeiture it was against unreasonable fines. Unfortunately The supreme court’s way of not ruling against civil asset forfeiture.

Research "right to travel." The Supreme Court has ruled many times on this matter. Police cannot even lawfully stop a traveler without witnessing a crime (a crime for a natural, living people is ONLY one natural people harming another natural people.) There is even case law that shows one does not need a concealed carry permit as a traveler, either. Right to travel is a great place to start in your study of natural law (the only law that applies to natural people,) because there's so much case law that supports it. Attorneys, bound by the ABA, are not allowed to even tell you about it. Learn!

Great information to consider. Cobbling together information from sites like this suggest the reasonable and proactive solution for the common traveler is to use electronic funds transfer or completely avoid carrying physical currency. The risk of loss is too great and the government actives are premeditated to create a hostile and near impossible logistical labyrinth for the average citizen to recover cash. The weakest link of the entire process will be human intention. Money (or sex) is the oldest culprit to expose human flaw. But great work for the Institute of Justice for taking a leadership position on legally adjusting the due process of civil forfeiture. Critical taxation and drug enforcement mission statements can continue without the need for strong arm tactics. The improvement is the transparency of due process during common property forfeitures.

In FL people at random vehicular stops had cash confiscated. They were going to auctions requiring cash to buy lockers, cars or houses. The state police or local offices accused them of using the money to buy or have gotten the cash through drug sales - even when proof of why they were carrying cash was provided. There was a huge scandal on Florida's east coast that it was illegal theft. Even after officers were found guilty people didn't get their cash back because they had no proof of how much was stolen by the "officers".

In theory a contract signed under duress or as part of criminal extortion is invalid. Try to prove that, or do so without stress and life disruptions and legal costs more than most such thefts by armed thugs.... For $40k to $250k or more in costs plus several years of elevated stress and lots of time, you may or may not get some of your $20k back.... Which tactically, is part of the scheme.

There needs to be a strong penalty clause for failure or refusal to return assets if they are not proven to be connected to a crime, in a timely fashion. Only punitive and compensatory damages will make it too painful to just take people's money and property, maybe even some jail time for STEALING from the people and violating their rights

This is a unconstitutional practice! Marburg versus Madison in 1803 Supreme Court Case, states that if a law conflicts with the U.S. Constitution, it"s not a law!!! This particular matter is one that I would protest so venomously they probably would have done what they are best at, besides taking what they have no right to take, and that would to be to shoot me!!! I have not had any problems with LEO's in at least 50 years. I'm 69 now. I see law enforcement, regardless of which branch as completely out of control! I have a serious problem with LEO's that act outside of the law and this is wide spread. I respect the law and obey the law! However I do not respect nor do I support bad LEO's, under any circumstances! I watch them everyday as they extort money from people, violate their rights, beat the hell out of people without cause, they shoot unarmed men and women, they use traffic stops to try and find something to arrest you for, thus causing huge delays and illegal seizures of property. LEO's have just begun to feel the hate they work so hard to earn everyday. I have no confidence nor trust at all in our judicial system, elected officials, nor the folks they hire! This election is proof positive that government is corrupt from the top down. Who can trust any of them? The legislators and courts have made so many laws that are either directly or indirectly against the U.S. Constitution. I no longer trust anyone in government and any sane person would have to agree, without a doubt!!!

There is no law to declare money on a plane for domestic flights......when asked questions do not answer, ask if you are being detained; if not go on your way with your money. If they try to coerce you by saying you are being detained tell them you have nothing to say and request they call your lawyer. Note to all.....have a criminal lawyer's card on you and a number in your phone. If out of state your lawyer can procure one for you.

Since the courts obviously don't want to obey the Constitution and prevent TSA and other rogue agents from this sort of theft, perhaps fellow passengers should surround the melee, and force the agents to let go of the cash and other assets under threat of the peoples' force, which is exactly what our founders had in mind when they put the 2A in our Constitution's Bill of Rights. A few boot parties later, with a few agents seriously tarred and feathered for their violations of our rights should be enough to teach the agents a lesson in the difference between an actual criminal and a good citizen exercising their rights. This sort of government greed and ambition has gone way too far and yes, We The People have every right to force it to a complete STOP.

I saw one where the dea was searching for homes to seize from people; they had to be home owners with paid off mortgages and very little resources to fight back... and paid for the cops to have a seminar on how to seize the "right way" so they could keep the stuff they took... even waited on a drunk driver to leave a bar and take his brand new Mercedes... this gives me a whole new reason to kneel for the anthem...

1st thing to do if there is a cash seizure FORCE the agent on the scene to ARREST YOU. This begins paperwork that FORCES them to charge you with a crime to justify taking your property in open court. File the forfeiture return paperwork before your court date, they will drag their feet but you want it on filed for when you go to court. Get in touch with a group like IJ, the local media. Get the names of all officers present and file complaints & release through social media.

Consult your legal aid advisor on how to protect money before traveling. Make a cashier checks, travelers checks. Wire the funds to your bank. Better make a cashier check. Always consult an attorney. It's worth not having your funds stolen buy all those crooks.

Oh and one other thing - the Supreme Court has ruled that violation of a persons rights based on a presumption is not allowed - see Vlandis v Kline ... the cops have to complete an affidavit that they have probable cause that the money was used illegally- so what you have is an unrebutted affidavit on the record. There are cases that say that the court does not even have jurisdiction over the res till a claim is made - the claim must be a verified claim... if it's a federal seizure the claim must be made in triplicate...the 1789 judicial act gave the Federal District Court jurisdiction over ALL SEIZURES and it's my position that all seizures include seizures also means seizures made by states too.

Also - the comments about having to declare over 10k when traveling internationally are in error. A thorough review of those laws indicate that they apply to couriers that are transporting funds and securities for a financial institution... what the airlines do is pressure the passengers to complete the form and then the airline will turn them in - just take the form and dont turn it back into the airline - when you get off the plane and go through customes just hand them the blank form and tell them you dont work for any financial institution- the times that I know of that this has be done resulted in the feds taking the blank form saying thank you and either passing them on through or continuing with there customs entry... the courts have ruled that United states currency is legal to posses - the only time US currency becomes contraband is if it is used to further a crime or is the product of a crime. Then if it is seized and a claim is made the relation back doctrine kicks in and the burden shifts fo the government to show what illegal act was committed that was illegal... the seizure laws are simple if someone would just take the time to study them - I dont know why there is such a problem with seizures in this country. The feds and the states would back off this activity if the lawyers of this country would take a step back and see exactly how these seizures operate as a denial of several constitutional rights and first get the money back - then sue the crap out of the cop and the agency for a ton of money - it wouldn't take but a couple of good law suits and this crap would be over. So right off the bat is see violation of 4th - 5th - 14th amendments. Wake up lawyers

But isn't it armed robbery? The LEO is taking your property, without your permission. Perhaps they didn't draw their weapon (yet), but they are carrying a sidearm, so the threat is still present, even if it's implied. I think most folks, if confronted with that situation, would feel threatened, & reluctantly comply, for fear of what comes next, if they object to the seizure. This whole Civil Asset Forfiture resembles the incentive-based system utilized by gangs & organized crime. I find that fact alone very disturbing, for oh so many reasons. Who protects us from the LEOs?

Ok folks listen up - there is a very simple way to get your money back - what you have to do is to MAKE A CLAIM TO THE AGENCY WHO SEIZED IT. Your due process is in the post seizure hearing - the money is seized on a presumption - once the claim is made the burden shifts to the government to prove a connection to a crime... what you do is to take the seizure to court - the rules are the supplemental rules of admiralty procedure ... you can have your money back in 3 days - the problem is lawyers dont know how to handle a federal seizure - once a claim is made the seizure is moved to a high speed process that is judicial ... DO NOT USE THE ADMINISTRATIVE PROCEDURE - I have gotten money returned in 3 days... contact me if you need help...

This is bloody disgraceful. In Ireland we have the Crminal Assests Bureau (CAB) first of it's kind globally. They must apply for a warrant to enable them to seize cash 7/or assets. Allowing the Feds to play cop, judge & jury is shocking and wide open to corruption. If the Feds have a genuine reason for concern or illegality then they could seize the money temporarily but should have to apply to a special federal court sitting at the earliest possible oppurtunity.

It's one thing if she was arrested and convicted of being a courier for a drug trafficker. However, they had no evidence of a crime, and they in fact did not arrest or convict her of any crimes. There is no due process. So this is seizure without any evidence of a crime. In fact, their records show that they know for a fact that drug money couriers drive cars across country, and they do not use middle-aged women who are flying. What kind of illegal crime organization purposefully sends a cash shipment through a federal xray and search checkpoint?

Unfortunately, SCOTUS has ruled that "Civil Asset Forfeiture" is legal. The big problem is that the law enforcement agency that takes the money gets to keep that money. This is a law that needs to be changed. Seized money needs to be accompanied by a criminal conviction. Note that this happens with traffic stops too. Law enforcement can take your money at the side of the road too.

While these seizures are breathtaking and UNJUST, I heard firsthand from someone that a person who sold his house in U.S. and wanted to take $250,000 cash with him to a Middle East country to buy a house there. So this guy a day before his flight with the cash goes to the airport Customs office and explains that he is leaving the country tomorrow with about $250k cash. The Customs gave him bunch of forms to fill out and bunch of officers began counting his cash money for verification. The next day he left with all that cash with no problem. So I wonder how such a contradictory treatment could take place.

If I am carrying $5,000 to $10,000 in travelers checks are they safe from seizure? Can travelers checks be seized? If so, can the government cash them without the owner signing them? Can they force the owner to sign them? If seized can you get them replaced as if they were lost or stolen?

I'm not a lawyer, but I'd guess they can just keep the checks (and other property) regardless if they can cash them or not. If you take photos of the checks, you'll have a record of them so that you could go back to the bank and report them stolen. Be careful to note that it was an unlawful asset seizure, or you could be setting yourself up for a fraud charge.

If you can still get paper checks. I think they've moved to debit cards now. Police carry machines that will clear out your bank account using your bank card, so they might be able to clear the traveler's check card the same way.

In the case of the woman with the $80,000, the DEA agent who took the money was"wearing a gun", but they didn't mention if he was wearing a condom. And when he took the money, did he offer a receipt, or at least offer to use Vaseline? Who initially conceived of civil forfeiture as a law? When police do a drug raid and find cash, they keep the cash as drug money. When a car is used to transport the drugs, they keep the car. When people travel with drugs they keep the drugs and arrest the traveler. In every case where property or money is taken, it is associated with illegal drugs, and it must be proven otherwise to get the things returned. So now, it seems that it is illegal to carry cash and to have it returned you must prove your innocence in a court of law? "Not innocent until proven not guilty?" The burden of proof being laid upon the victim. The only sense that can be maid of all this is that it's based on a different set of rules that are not being interpreted correctly. The fact that an agency tasked with airline safety can be the start of all this is the real problem. The fact that it has become such a wide spread problem is an injustice. The fact that the government issues the cash as legal tender for all debts and then takes it away for suspicion of illegal activity when you have it basically means that money has become illegal in the possession of private citizens. Various agencies being allowed to keep the money is the motivation for these intrusions. So I ask again, are they required to wear a condom?

Do not carry cash. Everyone should know this by now. Get a travelers check or do money transfer. I move money through a national investment banking, one branch to another. Structuring is something else to know about. These are regular deposits to your own account. They can grab right from your bank account.

im using my wifes account so i can comment knowing about civil forfiture at airports i called the TSA in washington dc and asked them if i could fly with over $48,000 i got from a trust, that the money would be in $100 bills. i was told that when i got to the line for inspection (the xray machines and such) to ask for a supervisor and step out of line. the supervisor came over and i told him i was traveling with a large amount of cash and he asked me if i was traveling international and i said NO,he then told the xray machine guy to let the money through. it was in my back pack. i was 61 years old and traveling with my infant son around 1.5 years old. this was october 2019. i made sure to carry a copy of the check i cashed as i am a real killer and a psychopath so if someone steals my property the laws do NOT prevent me from anything the reason i had the cash was the bank the check was written on refused to cash the check and give me a cashiers check for $40,000 of it because i didnt have an account with that bank. so i contacted the federal reserve branch that was over them, the next business day i received a call from a manager from a different state wanting to know how they could make me happy, i told her i now wanted $100 bills for the amount of the check. she had to have brinks deliver that much cash to the bank on the day i flew in to des moines iowa. the manager that had told me she would NOT cash the check at all, was now trying to apologize and i told her i didnt want to hear it and to give me my money, which she did! by "im a real killer" im saying i do not give a crap what someones job is, i know the law and do not care what the laws say, you steal from me or harm my family in any way and you will pay what ever i choose. do not think i will do what i say, just try your luck!
