I am generally in agreement with Professor Mustafa, especially on family law (polygamy, bigamy, etc.), that these should not be treated as crimes under criminal law. However, there are a few actions that the state should be able to restrict and consider treating as crimes, especially, those that impact and limit the freedom of others in the society. And, these will reflect the progressive or regressive nature of that state. For instance, with regard to activities / acts those impinge on the freedom of others' rights to life, liberty and property: 1) State punishes / fines individuals for littering / defecating / spitting in public spaces; 2) State punishes / fines (and even withdraws driving license for repeated violation) drunken and/or rash driving because it impacts other citizens' rights to life and liberty; 3) State punishes a doctor for "murdering" female fetuses because it violates gender equality norms (that the state agrees to uphold); 4) State criminalizes hate speeches that spread communal disharmony; 5) State criminalizes any activity that goes against the norms of building a multi-religious, multi-ethnic, multi-linguistic, multi-racial civilization; 6) State criminalizes any activity that promotes inequality of opportunity, reward and punishment on the bases of religious, ethnic, race, language and gender; 7) State criminalizes activities that desecrate sacred places of other religions (SC should have made the Ayodhya violators who places idols inside the masjid in 1949); etc., etc. To summarize, I would like to say, that it is not the act of criminalizing itself that is regressive. Rather, what is being considered as criminal should determine the regressive or progressive nature of the State. And, in this sense, the Indian state has been moving from progressive liberal to regressive values since the late 1960s and now galloping deep into regression since the 2010s.

If marriage of girl is such a independent decision ,which it should be,why our maintenance law put obligations on father to maintain girl child till married-when getting married is her independent decision//further how the maintainance is only for 18 year to boy when the practical situation is -he is just out of school before 1year back and our educational system promote full time learning instead of learning with earning//further in the age of equality when patents give equal importance to both girl and boy child -why obligation only on man to maintain parents when atleast we are able to observe the change when our siblings are working including our mother and not pure housewives

If we then take a consideration whether it is for consent to marry -that again in itself commodities the individual as for sale- which is absurd interpretation ,a kanyadaan is a gift of girl child ,further it is my life a no longer fair concept in social contract as restricting the definition of society to one individual rather than atleast family as unit will lead very unpleasant circumstances.

Mr. Mustafa is very subtle in saying how islamic law is good and hindu society is shit. He needs serious lessons on hindu traditions though..

Sir ji, I have high regards for you, therefore I insist that people like you must stop such "everyday enactments" from being enforced upon the ignorant citizens, by challenging each one of them in the supreme court and force the supreme court to establish the CONSTITUTION on the ground.

saurabh grover The power of enacting laws vests with parliament so i doubt if the Supreme court can in every case bring them down. They will prevail so long as they remain within the Constitution. So it is the legislature which has to look within and engage in serious debates before enacting any law which in today's times is rarely seen.
