On this episode of Australia Censored, leading Australian legal expert, Dr Rocco Loiacono, discusses how the federal government’s proposed ‘misinformation’ laws compare to other international censorship initiatives, and how such legislation would have had a damaging effect on debate if it were in place during the Covid-19 pandemic or the Voice to Parliament Referendum.
In his discussion with the Institute of Public Affairs’ Director of Law and Policy, John Storey, Rocco reinforces the importance of freedom of speech and how government should not be the arbiters of the ‘official truth’.
Dr Rocco Loiacono is a senior lecturer in the Curtin University Law School, and a regular contributor to Sky News and The Spectator Australia.

@@miragestor Never ascribe to malicious intent that which can be ascribed to incompetence … or just laziness… technical competence and siloed work is the problem, that emerged after the removal of the ‘permanent Agency Heads’ at the end of the nineties. After that agencies became sycophants for the whims of the ministers of the day… even if it required money that lacked budget appropriations or was questionably unlawful… To support this, the number of people with technical competence in an agencies prime purpose area were slowly reduced .. easier to get departments to do what you want if they don’t know any better… and now the ratio of Karens is too high.. ‘they know because they know…’.. Until 90s that Australian Government processes were renowned for models of good governance… that changed…

@miragestor - Yes, and these two guys, are very generous in the way they are speaking about this matter, as if the Government genuinely wants to do the "MAD Bill" to protect Australians. Pffffttt!! Make no mistake. Labor and Liberal , Greens Nationals, same bird. There are a few real politicians out there that are not mincing words about how corrupt this Government is. Senator Gerard Rennick. Senator Malcom Roberts. Senator Russell Broadbent. Pauline Hanson, to name a few. IPA has come a long way since I joined. That's why I left. You have to call a spade a spade guys. You're just too nice.

Yes totally correct the loss of trust in our government is not the time to trust their control of our information. The Agenda 30 paper talks of our kids being under government control for their schooling the under 16 rule is about brainwashing our kids and not letting them be exposed to much of the truth hidden and as told to the parents now proven to be false...like much of our history and the propaganda we have all been exposed to!

There are literally people on the left, middle aged men who watch AFL, arguing for the misinformation bill on Bigfooty forums. They have no idea of the implications of such measures, and also the ignorance to the fact that they support the "side" (the left), which used to be the side in favour of protecting freedom of speech.

The United Nations Declaration of Human Rights, Article 19 states: "Everyone has the right to freedom of opinion and expression; this right includes freedom to hold opinions without interference and to seek, receive, and impart information and ideas THROUGH ANY MEDIA and regardless of frontiers." Surely the Australian Government, as a signatory to this Declaration, are IN BREACH of their signed undertakings and should be taken before the WORLD COURT to answer for their anti-free speech legislation that they have EXEMPTED THEMSELVES from.

When will you understand that 'rights' given by NGOs, governments or other bodies are simply an expedient clause, (like a politician's promise) that can be denied, changed, ignored or otherwise done away with. 'Rights' only exist as long as people can explain, why, how and when they exist and for whom. That's why the US constitution has 'inalienable rights', but that doesn't solve the problem either. You/ we are the rights, by being human.

Australian courts take international law into consideration in their judgments. International law is not binding unless legislated. Being a signatory helps. As you pointed out, this bill is the opposite. So it will be interesting to see the courts’s interpretation when the court cases start. Most people don’t know that the court threw out most of the fines against the COVID protestors. The courts are our last hope.

So true. We are seeing the un-hidden formation of a One World Government controlled from Europe; we're seeing all the technology infrastructure being put in place; we're seeing Laws/Bills that do nothing for the people but hand over more power to the politicians/globalists; we're seeing the financial system deliberately subjected to enormous stresses that a collapse is imminent; we've seen that most countries in the world have turned their backs on Israel - the only democracy in the Middle East; we're seeing unfettered illegal immigration all over the world to western countries (to weaken them politically and financially); and more to come... This is really important. For some reason, many of the people I speak with that aren't all over youtbe but watch t.v, aren't even aware of it. A large part of the country still listens to the narrative instead of asking a question.

There is a section in 'the M/D Bill' that would outlaw 'the rise of any new religion that is deemed to be harmful to society.' This Bill is akin to the old Orthodoxy legislating against a coming Reformation or Age of Enlightenment.

The problem for us is the other side LNP were the party that wanted this legislation now it's basically up to the greens to defeat it god help us. So people need to be contacting greens senators and senators in general to apply pressure to abandon this legislation in it's entirety. I personally am hoping that the greens performance in the QLD election last week can help them to make the right choice this time around.

Our "freedom of speech" is not constitutional, it is a privilege provided by the supreme court. Which means, actions can be taken within the legal system to have the privilege overturned. Therefore, instead of the referendum for the inclusion of the Indigenous people to be represented within the constitution, we the people should have been voting for freedom of speech to be added. So while freedom of speech remains a privilege ruling from the supreme court, the government can do as they will to control the context and content of speech.

Vote accordingly. Labour, Green and liberals must be last three on your ballot paper. make sure where your preferential vote goes to. Libertarian or One Nation or an independent that has lab, lib and green last on their how to vote cards. We have no other recourse under this corrupted constitution and legislations. Also people need to realize that the Hemp Party, Animal Justice Party and a few others are just satellite arms of the Labor/Greens alliance.

There are still a lot of Australians that watch the news on their TV. For example, "my parents didn't have access to X or KZbin," so a lot of important information that we know was not being shared with the rest of the public. The very idea of this legislation makes me want to say SO much against the idea but the one thing I’ll say, or rather ask, now, before I’ve even finished watching it is …. How many people throughout history would not be allowed to speak about their ideas or inventions under this legislation? Albert Einstein, Benjamin Franklin, the Wright brothers, Louis Pasteur, are just a very small handful that spring to mind. All these people talked about their ideas before they actually did anything. Under this legislation none of them would be allowed to do that because the “experts” of the day would have said it was misinformation because THEY didn’t know about these things. Who would you add to my list? What about current “new thinkers”, “philosophers”, scientists, doctors, psychologists etc who are “outside” the circle? So, ALL the sciences world be at risk. What many scientists believe today will very possibly change in time. That’s HOW many areas evolve but without the ability to talk about, to discuss new ideas these things will be completely stifled. Then, in the area of public health (which really comes under the sciences)? I won’t talk about the big things that happened starting around 3 years ago. I’ve got a more basic example of why this misinformation thing should NOT be in the hands of “experts”. Here’s my example: I am attending a public hospital course on diet, nutrition and healthy eating. The girl running the course tells us that eggs are healthy. I asked her about this because, not all that long ago, we were all being told by all our health professionals and “experts” that eggs were actually not that good for us. The egg yolks has too much fat in them. They were bad for our cholesterol levels. You should only eat one per day or less often than that. Now, they say that’s not true anymore. BUT what that ACTUALLY means is that it was NEVER true. She said “they” have changed their minds about peas too, for example. “They” used to say they were a carbohydrate but now they say they are protein Or, how about Jesus Christ? He was vilified by those in power who disagreed with him. Yes, I know they say make allowances for religions in this legislation but WHO gets to make those calls? Which experts get to tell us which religious ideas we are allowed to believe in or not? Even within a religion there are many different views. Who gets to decide which ones are right and which are not? I could go on but I won’t. The last thing I’ll say is IF this bill is allowed to pass it WILL BE the thin edge of the wedge, give them an inch and they will take a mile. “They” want control over what we can and can’t say and even think. Once it’s in they can AND WILL add things, change things AND take things away.

I think there should be more referendums for things especially things like this. If they put this to the people, it would be overwhelmingly quashed. It cannot be passed and if by some corruption it is, then the Government will lose the next election. I believe this Bill is the beginning of the end of our freedoms, such that we have left, and if people do not realise that then they are blind.

Even experts can get it wrong! Until results of an experiment are allowed to be observed, it doesn't matter how expert you are. Observation always leads to discussion, formation of theory and then retest to confirm. The world's biggest vaccine trial must be discussed, information studied and safety determined.

Our education system should give adults facts and skills so each individual can know or discover through research the truthfulness or falsehood of the topic. This gives each citizen the ability to decide for themselves and then support their position. A government department in control of the status of information would move the right to every Australian to reach their own conclusion to the political elite.

An expert is an expert in giving good results. That is True Information. A person who has a piece of paper qualifying that they completed a course, but they give poor results then that evidence shows that person is not an expert. Bad results comes from Misinformation.

As a matter of fact, Britain and France declared war on Germany. During the ensuing 8 months Hitler sought peace with Britain and France. In May 1940, Britain bombed Germany which resulted in Germany then invading France. As it was, the Allies never came to Poland's aid, resulting in 45 years behind the Iron Curtain. Churchill was every bit a warmonger, certainly as much as was Hitler. Noting too, the Soviet Union was empire building and was, as history tells us, a threat to the sovereignty of numerous nations.

This Soviet threat you referenced was foremost in Germany's mindset. Allied Geopolitians were also watching and concluded that the Germans if allowed to fight on their timeline would defeat the Bolsheviks and then rule from the Rhine to the Bering Strait which meant Britain had to find a moral pretext to declare war and this was achieved via a treaty Britain made with Poland. We can see why laws to control 'the narrative' are being brought to legislation, the High Ups moral authority, on numerous fronts, is on the line.

I believe this mis /dis information bill has deeper beginnings than just our Govt in Australia. This has been a hot topic in other countries and freedom of speech plus mis /dis information was only just spoken about in the US congress By Robert Kennedy JNR. This could have roots on the WEF, and is even included in amendments in the UN. I have also heard on the grapevine that this law is to counter interference from an Upcoming major war involving many countries. ( maybe mis information itself or maybe true ?)

I can understand how and why the religious sector can speak against the censorship of speech bill, it's because the freedom to practice your own religion is part of the Australian constitution. It's not a supreme court privilege ruling.

The thing is freedom of speech was protected by the creators of the internet, because people did not want to develop for a technology that they knew would be used against the people, so a deal was made that the freedom of speech on the internet would always protected and written into law, and hear we are another lie made by government.
