You can't just grab artwork from the public galleries of many of these AI generators (NightCafe for sure) and start selling it. That would be theft and you could be fined or hit by a lawsuit. Depending on the platforms terms and the prompters plan the rights to those images are either with the user who 'created' it, i.e. prompted it or the platform. Now you may not get caught, but if you do it could result in fines, lawsuits, getting kicked off the platform you are selling on, etc.

So I agree with your morals (and I share them) but I would say that it can be a grey area from a legal standpoint.

Glad the judge made the right decision! However, if it’s not “your” design generated by your prompts. Not right to take it! Generate your own.

I have to agree - I would just rather create my own designs (it is way more fun than just taking someone else's).

My son makes a drawing on paper and then it is scanned into the computer. That scan is uploaded to ai which generates a colored image from the drawing based on that. Surely that would be copyright. Heidi

This is a great scenario and I can certainly offer my opinion (which is just one person's opinion). The original drawing - your son would own the copyright. But the AI-colored image is a different image. So it would be tough to say who exactly generated the image. The AI? Your son? If images are significantly transformed, it can be difficult to tell who is the actual author of the finished art.
