Hi! Business type as in what type of business entity should you form? You can operate as a sole proprietor, obtain a business license and a DBA. If Etsy is collecting and remitting the sales tax for you you do not need a sellers permit since they are the marketplace facilitator

It doesn't matter. The state will steal treat you as though you're operating a store or restaurant and literally FORCE you to buy a LLC with all the legal documents which includes the zoning process to even get a business license. The process is VERY FRUSTRATING and EXPENSIVE! Believe me I am going through it now just to sell ice cream cones from a popup table under a canopy tent roadside business.......

Most likely, yes - each city has different rules with business licenses so contact each city to be sure. You are selling products on site in that city which creates a physical business presence which I'm most cases will require a business license

So if I have a business license for Spokane, WA and a seller’s permit for Washington but I use Shopify for my online business and make sales to CA or any other state, I would need to obtain a seller’s permit for CA and those other states? Even though it is all done online? Super informative video btw! I appreciate the info but would love clarification on my question.

If you meet the sales thresholds or other regulations for the individual state yes. Tracking each individual states requirements is difficult so I recommend using a tool like Tax Jar to monitor it automatically from linking it to your sales data

If you're setting up an etsy store online and selling print on demand merch that a production partner is printing and shipping do you still need a sellers permit? You mentioned marketplace... but I'm not sure if etsy pays the tax to the cdtfa or not

Etsy collects and remits the sales tax in most states. Check Etsy seller info for your specific state to ensure they are collecting and remitting your sales tax. This is referred to as being a marketplace facilitator

To buy wholesale you will need a sellers permit. To sell on Etsy you should have a business license, DBA for your business name, and your county may require zoning clearance or home use permit for your business

Hi coach Ginny! I love your channel and even though you are not a lawyer or a tax adviser, the information that you provide is like gold. It’s based on information,action that are on government websites and not just your opinion and I love that about you! I do have a question though, since I’m a sole proprietor doing business in San Diego, CA, as a distributor for Enagic, which is a company that manufactures water ionizers, and they are license to do business here in the US, not just California. This being said Enagic does everything like processing orders, sending us check commissions and reporting those commissions that we receive from them. Basically, all I do is to market those products either online (my own website, social media, and door-to-door, or through referrals, then I would get a commission from the company by selling their products. So if I understand it correctly, I don’t, personally, need a Seller’s Permit since I don’t collect any taxes. ENAGIC on the other hand does collect them from customers. Please confirm. Also, my next question is do I still need a business license? Now, in the future, I am planning to establish an LLC. Would this mean that I would need a business license? Kindly advise. Hi! Are they sending you a 1099 tax form at the end of the year? If yes then you are an independent contractor, and because you are not selling products yourself, and they handle the sales tax then no you would not need a sellers permit

If you are an independent contractor, you may collect commissions from those referrals without having your own business, but if you are creating a presence as a business, you'll want to register a DBA and obtain a business license
