WHEN we want to see change from the LEADERSHIP in the PD and SO, and that change rolls down hill to the cop/deputy on the street we must change how they keep their dollars. WHEN we change the rules, the law, that takes the settlement or lawsuit payout from the specific department, i.e., the department or sheriff office, we will see change. WHEN they can't pay salaries, overtime, new hires, new cars, bullets and coffee, they will change. Wait, we are not finished. We also will pass laws that hold the “involved peace officers”, be it patrol/deputy, supervisor, commander, or chief/sheriff for their failings. Each found to be responsible for will help personally accountable for the first $50,000 not to be paid by the city/county or city/county insurance. While we wait for federal law or state law to make this happen, we must tackle the local city/county to change it there. Now, they also need a carrot. When a department can go 1 year, 2 years or such without citizen complaints, no lawsuits we reward them. As long as the city/county or their insurance pays the settlement or lawsuit, NOTHING will change.

The cops are trained and told to say stuff that is also not true while on camera - body camera so the DA and police can pile more charges on top of the stuff they are already doing. This also helps when they start striking charges off in exchange with pressuring to take a plea. Cops and public servants don't read or bother to read the law. Academy doesn't teach law, they teach tactics, filling out reports, torture and how to hide a girlfriend. So case law doesn't matter. We see the reaction on many cops faces with someone tells them the name of case law and they roll their eyes. The only two they know, Terry and MvP. otherwise, they dismiss it because it shows they don't know.

The real problem isn't the lack of case law, which is very helpful for illegal arrest, but an empty pocketbook and lawyers who value the $$$ over extending legal help as needed. No money, no justice in America. Been there, and screwed because I was pennyless at the time. I don't trust the legal system in America now. Our legal system only works if the people we elect, are ethical. honest and morally straight. Where are they??? Bottom-up changes are due for change, as Battousai commented.

The only place case law can be used is in the court room. But that is only after years of lawyer gymnastics. In the streets it’s the law of the sovereign military and they don’t care about courts. They are in it for what they can do in the moment. And the more punishment they can get away with, all the better. What a better definition of a police state can we have than the state of the nation now.

Case law is mostly useless because it doesn’t bring charges to the officer that breaks the law and constitutional rights. It only holding the department/city liable in a civil court and that only takes money away from the people not the actual department and if it does the department has insurance that caps out or umbrellaed. That means in some states have law in place to protect them from civil liability. This is where they know they can do wrong and break the law with impunity.

Case law can be overcome by legislation. SCOTUS doctrine allowing LEOs to lie almost without consequence, and qualified immunity should be reigned in legislatively. The courts are in place to clarify the intent of law, not to create law.

One of my States (nsw Australia) best case law is Carr vs New Town police. Which in a nut shell says if the maxium penalty is a fine you can't be jail but must be issued a court appeearance ticket. Odfly I met him in a pub at 3 am . Story was he was on his way to his brothers funeral when a cop hasseled him do ends up attest for a fine only offence the cops refused to release him till 4 pm after the funeral and wake. Cop hated him so laught about it. Luck cameras had been onstalled. He then sued won cop was fired after Judge wrote to Commissioner.

0. Without caselaw, without restricting lower court judges to higher court precedents, judges would be able to re-decide the logic of settled law with each case. That means wide variance in whether police misbehavior is criminal or not. But even with the system of caselaw in place, this Roberts Supreme Court has been upending it by un-logically re-deciding existing caselaw according to their own whims, based on political motives. Dobbs a recent example. "Qualified immunity" another, where civil rights claims that you and I would be liable for THEY are not, if there hasn't been a prior case making it clear. Which basically sets up a roadblock preventing progress on civil rights vs police. As I'm sure it was intended. To preserve the asymmetry of police power vs we the people. @Battousai

The question is what is it useful specifically for? Will caselaw prevent a cop from assaulting you? Probably not. Is it possible that it might help you get a pay out after the incident? Sure. It’s a long shot, but possible.

I think people are getting confused what Turner Vs Driver case law establishes, it only establishes that you have the right to film police without detention or arrest. I think lays a good foundation for cop watchers, but it does not fix the bigger problem of police over-reach.

@ battousai, why or how could he claim qualified immunity? Qualified immunity does not protect against criminal prosecution. I know you know this I’m just putting out there for others to understand. Qualified immunity is a judicial doctrine that shields public officials from civil liability (i.e., money damages), unless their actions violated “clearly established law.” Mullenix v. Luna, 577 U.S. 7, 11 (2015). It has nothing to do with criminal liability and offers no protection for police officers facing criminal prosecution. I don’t see how it could even be brought up. Is it a crime for a person to pick up another person and slam them face first on the concrete. It’s plain and simple. Yes that’s a crime. If courts asked what was the reason to pick up that person and slam them on the concrete face first? (1) Because she didn’t follow a lawful order (2) Because she was resisting me attempting to place her under arrest. (3) Because she was interfering, walked into the crime scene and I demanded her to go across the street and she didn’t listen. (4) Claim officer safety. I was just so scared of this women I had to do something. J/j. But there are probably a lot more made up situations this pig could try and argue. (1) can you slam a person on the concrete face first for not following an order in this situation? (2) What did she say and what did she do for you to claim she was resisting. (Watch body camera) (3) How did she interfere? Was there a crime scene? And if so was it a secured crime scene. Demanding her to go across the street , was it a lawful order? (4) officer safety, courts… why you such a pussy? Bottom line is slamming a person on the concrete face first a crime. I would argue yes. That’s not what qualified immunity is for. So basically I’m asking on what basis do you think he would have to ask for qualified immunity?

To me case law is a double edged sword. You have cops wrongly citing "Pa vs Mimms" to force people out of their car without any reason. But IF you can cite case law on point to a cop in the middle of an interaction, especially when it is being recorded, it will absolutely strip away their qualified immunity.

The problem is that most obstruction laws are vague, and the mantra of officer safety gives the police unlimited power to define what is obstruction in their mind. The old police "you have the right to film but where I say you can film". This is the problem that really needs to be addressed our rights vs. Officer Safety. Are we a pseudo Police State or are we a country of people with rights. You really should prepare an outline for your speeches. It took you ten minutes to get to the subject of the video. On the title, case law is absolutely useless. You have to rely on courts to get any benefit from it, often after a protracted appeals process. That takes years. Justice delayed is justice denied. I find that useless.
