You are absolutely right about the fact that there is no rationale for computation on pro rata basis as it is purported to remove the ceiling limit for members opting for higher pension although EPFO has the authority to modify the formula. Nonetheless , it should be based on coherent logic which apparently is missing in the E mail dt 14.02.24 regarding computation of higher pension. Many many thanks for educating on the entire gamut of this controversy which perhaps is the best analysis so far.

If EPFO wants to change the calculation formula that too has to be approved by both houses of the Parliament and they cannot arbitrarily do it. Any changes regarding the calculation of benefits and the contribution has to be with the approval of the parliament.Even for minimum pension pro rata can be applied for the period of 60 months prior to exit of the scheme.Further after 30/09/2019 no pro rata calculation exists since 60 months have passed after the 2014 amendment.

Important thing is they are postponing final calculation of payment and pension. This must come together. In addition they must tell us when higher pension will start and arrerers will be paid. EPFO is avoiding to do this. In this process they are increasing the payment as interest payment will increase. And they are not obliged to pay interest on pension and arrerers. Pro rata calculation for minimum pension has to be calculated on pro rata basis at 6500 pensionable salary ceiling for the period of 60 months falling before 01/09/2014 and at 15000 for the period of 60 months on or after 01/09/2014.After 01/09/2019 no pro rata calculation exists and it has to be calculated at Rs 15000 pensionable salary.The pro rata calculation put forward by EPFO has no logic and it is an acrobatics by EPFO to reduce higher pension by another 30 % or more.

As per my understanding while calculation of pension on pro rata basis, EPFO is taking 12 months average actual wages without any ceiling of Rs.5000.00 or Rs.6500 for pre 1.9.2014 period and 60 months average actual wages without any ceiling of Rs 15000.00 for post 1.9.2014 period. This formula is already in existence with ceiling of wages. The ceiling is now abolished but the formula is the same. So is there any major problems? Please give your views for our guidance.

Sir when contribution was lower on lower cieling and higher on higher ceiling, pro rata was justified . Now you dont pay lower or higher on cielings. You pay whatever is actual. In case of the exempted organisations employees were contributing as per the actual higher salary since 16th Nov'95 onwards and the empliyer was contributing @ 12% of the actual higher salary by deductions at source moreover , it was never asked from the employees to opt for contribution as per actual salary badis to opt for actual salary basis, then how EPFO can debar a member for opting for higher pension at actual salary basis for no fault of the employee. Clarification on this aspect is requested for taking up with the EPFO.

pro rata calculation of higher pension to those who have retired on & after 1/9/2014 after collecting higher contribution with interest along with administrative charge of 1.16 from 16/11/1995 is definitely against of the Supreme Court verdict in this regard . It is not at all acceptable . EPFO has to sanction higher pension to poor persoiners as per EPFO circular 1/6/2023

Now EPFO making formula of higher calculation as per their wish and interpret Supreme court verdict as per own convince. Have anybody seen that 60 months average salary taken in account for pension.
