The crime commonly referred to as "jaywalking" is when someone crosses the street outside of a crosswalk. California's new jaywalking laws went into effect on January 1st of 2023. Under the new jaywalking laws, it is no longer illegal to cross the street outside of a crosswalk in California, as long as it is safe to do so, there are no oncoming vehicles approaching you at a close distance, and as long as a reasonable person would see that there is not an immediate danger of collision.
However, even under California's new jaywalking laws, it is still against the law to jaywalk in an unsafe way, and people who are cited for this infraction will face possible fines.
However a skilled and experienced jaywalking attorney can fight accusations of unsafe jaywalking by utilizing the following 3 defenses:
1.) There was no oncoming traffic and jaywalking at that place and time was perfectly safe
2.) Someone else jaywalked and you were misidentified as the offender
or 3.) There was an emergency situation that caused you to have to jaywalk, such as flooding in the street, a fallen tree branch blocking the sidewalk, or an unsafe pedestrian that was threatening or intimidating you

Finally rational pedestrian rights! When vehicles hit pedestrians impeding the flow of normal traffic unaware because pedestrians aren't vehicles, who is liable? As a former serial jaywalker I always thought it would be bad on me if I was dumb enough to let myself get hit.
