Those who have a concealed carry license and carry a concealed handgun for personal protection everyday carry (EDC), need to know more than just how to shoot to defend yourself. You need to know how to LEGALLY shoot to defend yourself. Sadly, there's a very big mistake that a lot of firearm-owners who get their concealed carry permit make when it comes to preparing their tactical edc plan and going beyond their everyday carry gear and firearm. According to the Warren Doctrine that all attorneys are supposed to know especially those that are being trained as criminal defense and Prosacuters self defense anywhere in America is not a criminal offense. All Americans are born with the RIGHT to defend life and property against any person that would seek to deprive them of this against their will. The standard of care you will be held to is the Reasonable man. Would a reasonable and prudent person have a reasonable belief to fear death or great physical harm in the present moment. Great boldly harm is any crippling injury. Some states like mine say any broken bones meet that standard. The assailant (s) must meet the 3 points of means either a weapon displayed or threatened or disparities of force. OPPORTUNITY. The aggressor is present in the moment to injure of kill you. Jeopardy. You are being attacked now. If the incedent is resolved when you reach for you're weapon or present you're weapon and either issue a final warning or the sight of you're weapon stops the threat before the need to fire you have not committed any crime as long as the dession was made to actually fire in reasonable fear. Displaying or menacing a weapon just to intimidate when no actual threat exists is a crime. Justice Oliver Wendell Holmes ruled that calm reflection is not required in the presence of an upraised knife. If you're assailant is younger, more powerful and obviously more aggressive this is dispairity of force. If you're set upon by two or more assailants all of them share equal jeopardy. Any objects being used as a weapon is a weapon. You have a legal right to be anyplace you are as long as not prohibited. No person(s) has the right or duty to deprive you of you're rights of life or liberty without due process or duty. More than one cop as been convicted of this civil rights charge even after being acquitted of manslaughter or murder. No person who was the initial aggressor can claim self-defense if they were defeated or killed in an unlawful assult. All civilians can only use equal force to defend themselves from unlawful attack. Civilians have no duty to lay hands on or apprehend another person. The right to use deadly force only applies to the eminent threat to yourself or any innocent person. There is no duty to retreat in most states. A wise person will always withdraw from any danger if possible to do so When no other lesser option obviously exists deadly force is lawful to use. Remember there is no codified law that makes it leagl to kill any human. The concept of the justification to kill is the competing harms doctrine, That is it will cause more human jepordy to violate the prohibition of killing a human than to not kill the human creating the need to be prevented from completing the act of murder. Deadly force is any force that will cause a permanent crippling injury or death. Drawing a firearm is using deadly force wether it's actually fired or not. The mere display of the club, knife or gun would create a reasonable fear in the mind of any rational person. If you are the initial aggressor in most jurisdictions this is a felony and can expect prison time. Never pick a fight or aggravate one. You could be the one locked up. Always as soon as you can report any confrontation even if no fight actually occurred. The first one to complain is the victim. That's about it on this topic.
