Just a point, ask them to produce the evidence of the data pings for your phone which will show you were not making or receiving a call or texting.

I agree with your sentiment, unfortunately it is now illegal to even touch a mobile phone let alone pick it up ! It's a new law. Where it is placed in this case the belligerent cop is to dumb to realise his mistake!

My point is producing evidence that he didn't use his phone for texting is making calls won't help! The cop didn't say that's what he was doing. The cop said he was holding it in his hand! He didn't have to be making recieving calls or texting. The pings you refer to will only tell you if the phone was in the vicinity. There are "other" things you can do with a mobile phone that do not use data or phone signal. Even if the phone is switched of and you chose to touch it or hold it in your hand that is considered breaking the law now that is my point! I don't agree with it but there are people either don't understand like you, or don't care so that's why they changed it. Minorities ruin it for the majority...

As to the cop saying you were holding your phone, you should get a car cam like the one I have. It has 2 cameras..1 for the front of the car and the other films the entirety of the inside of the car. Next time you could prove just by showing the inside of the van vid and then tell the copper to jog on. The fact the copper could not get your number plate correct seems to demonstrate that he is not very good at seeing what is around him anyway.

I had a similar thing, the police officer claimed that the in-car camera wasn’t working and that the mic was faulty on his body camera. The police summoned me, but put the wrong reg number on the summons. I went to Crewe magistrates court, and on the day the prosecution applied to the magistrates to change the reg number, which the magistrates granted and after a 1 hour hearing, I lost. Points and a £600 fine. There’s no justice in the magistrate’s courts, the magistrates are often very senior in their years and out of touch, they almost always believe the Police..

I’ve been there dude, we once got stopped for racing (yes young and stupid) it was 2 XR2s and it ended up with both of us in court at the same time answering to dangerous driving. Yes we were going faster than 30 and I would have accepted that but the 5’0 took us to court and were unprepared. It was a sting of inaccurate evidence given by them from the wrong car colours to seeing a driver with blacked out windows. They even said my mate had no insurance and he was in court for that and racing. They swore under oath that they had done a vehicle check and it turned out they had written the reg down wrong. He was insured and we were acquitted of any offence as some of it was made up. FIGHT it, take it to court and discredit him as he clearly says the reg wrong, he is mistaken about the phone also as he can’t be relied upon to recall what happened if he can’t even read the registration on a vehicle!

Good luck with the cops, I stood my ground when i was stopped for going through a red light, that wasn't red, despite him telling me i might get a worse fine/points if i went to court. A lot more too it than that, but the court found in my favour and he stomped off in a huff, luckily I've not bumped in to him since!! 😂

If you get a good solicitor you'll win hands down. Do you have legal cover on your insurance? If so use it! Did the police officer follow all the correct procedures? Did he tell you that he's body cam was recording when he stopped you? You can say no and they haven't got the evidence that he said otherwise. Little things like this will all add up to say that he didn't do he's job correctly and that he is incompetent and needs further training. 👍 Good luck

Hi, take some advice from a 53yr old that has won against the police on many an occasion. The only way to win is to make the police look incompetent and or dishonest. One thing I would question is how he could be sure, when for instance you were both travelling at 30 in opposite directions in vehicles at differing heights. It would not be possible to know what if anything was in your hand in a split second view. The trick would be to question him on what else was in the cab etc as he had such a good view. I would also question him on what is a driving licence as he asked you to produce it. It is not possible to produce your licence, as in law it is the record that the DVLA have. Question everything, road speed, pedestrians, other vehicles, the weather etc. I would also ask him if your windows are tinted, they are but chances are he will say not. Honestly, I guarantee that the only way you will win is to make him look foolish or for him to lose his temper. The court will be preempting to believe him, they are not your friends. Hopefully he doesn't read my proven advice and good luck.

The audio was cut because that’s how body cams work. They’re always recording and when turned on the audio for the first 30-60secs will be muted. It then kicks in and you’ve got audio and video

Go to court. Its word against word. Remember the prosecution have to prove beyond all reasonable doubt you were on your phone. I think they will drop it before it gets to court. The copper didn't caution you when he pointed out the offence yet he still questioned you about it. Yet he then cautions you and asks questions. He doesn't tell you that you're not under arrest and you're free to leave at anytime. He doesn't explain your rights to a legal entitlement, and he doesn't explain the caution to you. All a breach of code C of PACE

If the officer didn't have the observational skills to correctly read your registration plate when it was stationary just a few feet from him how can his ability to swear on oath that he saw you on your 'phone from a distance whilst moving be trusted? The burden of proof is beyond all reasonable doubt and I would say there is reasonable doubt.

I do most of my camping on my own and I still enjoy it. But my favourite things are the van life events because that’s where I’ve met everyone. That's the big disadvantage of being in England. Here in Scotland the policeman's evidence needs to be corroborated - one officer's word against you won't be accepted by the court as proof, in fact the Fiscal wouldn't consider a prosecution for one second.

Back in my army days ( communicate specialist radio operator telephone linesman among other things back in the day such as devices that would send code and you had a book to decode the messages lol yep I am getting old ) We called dead ground when radios would not work A number of things can cause this such as a big deposit of iron ore in the ground We would have to set up what was called radio rebroadcast Put a radio that was hooked to another radio on a different frequency so on radio could talk to another one You would set up rrb just outside the dead ground area so the signal would be received from one radio then sent buy another one to a radio on the other side of dead ground

I don't think it was muted - police bodycams record constantly and when the officer presses a button it then starts logging audio and video, but it includes the previous 30 or so seconds video as a buffer, that's why there's no audio to start with - you'll notice the audio kicks in when he appears to fidget with the bodycam which is almost certainly the point he manually started it

PC dyslexic also appears “blind” to criticism of his opinion regarding you using your phone whilst driving. With no video evidence it is his word against yours, and remember that he has to prove beyond REASONABLE doubt that you were using it, and surprisingly his in car video wasn’t working - remember to ask why this was during your court case. Make sure you also ask for your expenses for attending court when found not guilty!

Sorry fella but I have to correct you. Radio signals was my job in the military. You can be stood 100 yds away from your oppo and not be able to speak to him on the radio due to the terrain. Radio signals find it hard to pass through solid objects. So yes your radio signal could be crap while in a woods.

Always get a mugshot , name , number and the station they are attached to of the officers who interact with you , then post to youtube as we the public police the police now . this way we can track the officers behaviour and see if this is a habit of his or simply a genuine mistake .
