Just not that but refund all money paid and remove all negative marks on credit. They can't get the title its their loss. The only people they have a problem with is the dealer owner and the other bank. They can pursue them to get their money back. They made a bad decision. I did work for a used car dealership. The credit unions were the easiest and whom we preferred because they are efficient in obtaining the documents, finances and titles asap. They normally know what they're doing. We recommend joining credit unions over banks. In this case, ICCU dropped the ball and left their customer hanging.

At this point there might be a case against the bank. The bank had due diligence to acquire the title when the loan was paid to the dealer. At the very least, they should have known the dealer didn't possess the title within a month of the purchase.

This is a very urban area in the Salt Lake Valley area. The cars, rents, and everything including food too are way over priced. There are so many thousands of vehicles in inventory within walking distance of where I'm sitting, but I don't have one to drive. I hope most of em' go outta business this year going into next year. It looks like this ginormous RV dealership that just went in last year buying up all the lots around my apartment building is going to be going out as he's full to the max and not moving em'.

This happened to me about 12 years ago I bought a nice truck for cash from a long time car dealer that I thought was ethical. Turns out I wouldn't get the title for months. After finally receiving the title, I was contacted by the District Attorney and learned the owner of this car dealership had been buying vehicles out of state and not paying for them so he actually didn't own the vehicle I bought. He was prosecuted for multiple felony counts but I never got anything out of the case. You can't be too careful when car shopping.

I don't understand how it's legal to hold the car buyer responsible for a loan obtained fraudulently like this. As far as I'm concerned, if it's proven that the seller committed a crime with the sale and cheated the buyer, the bank should immediately eat the loss and go after the fraudster if they want to recoup any money. If the banks were held responsible, and had to suffer real consequences for fraudulent activities, you can bet those activities would be curtailed quickly.

I'm pretty sure the contract Hunter signed stipulated that the title will be signed over to him upon completion of payment. Since ICCU is unable to fulfill their part of the contract (signing the title over to Hunter), would that not relieve Hunter of his duty to fulfill his part of the contract?

Simple solution, and I believe this is the way it works in other states: 1) Customer signs purchase contract. 2) purchase contract is sent to bank. 3) bank providing new loan can see a current lien from another bank. 4) new bank sends out two checks; one to pay off current lien and secure the title, and a second check to the selling dealer for the loan proceeds in excess of paying off the current loan. Easy peasy. You’re welcome.

Only solution is for the state to raise the bond needed to get a dealer license to at least one million. When shopping for a used car ask to see the title, if they don't have it walk away. Dealer for 30 years and sold thousands of cars and trucks. Never floored a car and never sold a car that I didn't have the title for it.

they probably explained and I missed it, but why isn’t this on the lending institution? I thought that they held the title until the loan is repaid? How did they lend money without checking the title status on a used vehicle? doesn’t the lending institution have procedure for checking for outstanding liens? at a bare minimum seems like the lending institution should want to protect itself and its customers by checking for liens? I would fire whoever was responsible for issuing the loan, as this is a careless way (at best) to do business.

UNDERSTAND THIS: IF THE SELLER CAN'T SHOW YOU A CLEAR TITLE DURING THE PURCHASE PROCESS, WALK AWAY. Check the title to see if it is "BRANDED" - Salvage - Insurance total loss - Flooded - Vehicle reconstructed - TMU, total miles unknown. Do NOT BUY a vehicle with a branded title. States brand cars for a reason, to protect the consumer.

Other than getting a bad review on Yelp. I say it's time to reverse the phrase "Buyer Beware" and make it "Scoundrels in business beware." Bring back the axe, chopping block, and the hooded executioner! Let a few heads roll down the street, and you will see a complete 360 in the business community. Then it goes into collections and your credit gets ruined and then they take your to court and garnish all your future wages and you are no longer employable, because employers check if you have a good credit score before they hire you now. Then when you finally decide to pay it back that $20K has ballooned to $30K from the interest, because you ignored it. Then you spend years just trying to pay off the interest, because you can't get a job with bad credit, you end up being forced to file bankruptcy. Then your landlord finds out and kicks you at of your house, bam you are homeless.

my credit union does a title check to verify there are no liens; looks like they didn't do their due diligence and to top it off they screwed him even more by saying because he doesn't have insurance on a car he does not have they are charging him even more. Wow - that's one heck of a great credit union there. I think I would be posting some bad review on that credit union. They really should be taking the fault on this one. I would be suing the credit union. His lawyer is not that bright. Get a new one lawyer.

Its bad enough that he has to pay back money for a car which was taken from him with zero legal recourse, but he is also expected to INSURE the car which was repossessed and was probably already resold! Just think, someone else is probably going through the same thing with the same car!

The last dealership I bought a car from is a champ. I went with them because they were there when I moved to the area 15 years ago, so I figured they were doing something right. They have the titles to all their cars on-site. It's kind of an invitation to burglary to those brave enough to do it but also extremely convenient.

Oh yeah my wife just got a whole bunch of different checks from ICCU because apparently they were in a class action lawsuit and they had to pay out money to people who were affected and my wife happened to be one of them. So do you still bank it ICCU or you just pull your money out and say you don't want to deal with them That's what I did.

Sometimes once the dealership starts going under they stop paying off banks for titles. most dealerships get short term loans for inventory called “flooring”. Partly why a dealer is given more time to do transfers and able to give temp tags, usually 45-60 days while they pay off any flooring or trade in bank liens to obtain the title. It’s hard to know but there’s a few stories out there of dealers taking all customers money without paying off banks and flooring companies on their way out of the car business with a 45-60 day head start. Best way to protect yourself is know who you’re buying from as much as possible. Be safe everyone

I've lived by those rules, because if something goes wrong with the first one, I can still salvage the situation and my Dad taught me two things "If something is too good to be true it is" and always never buy until you see all the reviews on the place first.

Somtimes a carjacker takes it to the dealership and then they make a copy of the key, then sell it off. Seen it done before on another news clip.

Banks are in the business of lending and collecting oney they don't want to touch the car so they use a dealer to sell the repoed cars. Dealer had an obligation to forward the payment to the bank to get the lien released and the title transfered in to the buyer and new lending bank's name.

Not long ago, a friend of mine bought a used car from a dealer (not in this video's state and not this dealership). 3 months later she was still fighting to get the title for that car, and I feared something LIKE this might be in play... She got lucky in her case as the dealership finally produced a title.... lesson in her case as well as this video... don't let your eyes overwrite common sense. ALWAYS do your due diligence... research not just the dealer, but also the car for things like liens, common complaints, recalls etc.. all this can be done online for free through numerous websites

There was one in Trenton that sold a lemon to an immigrant. Guy made payments on the repairs, went to pick up car and they told him he now owed storage fees. He went home, got a gun and went back to make a citizen arrest but was charged with kidnapping :( When it came to trial, some woman says: Wait, that was the lemon I turned in ! State changed the dealer for manipulating the title, yanks their dealer tags. Datsun yanks the franchise. Dealer transfer ownership to his brother. News keeps tying the dealers past name with new :)

The dealer was selling the car for the bank. Dealer kept the funds reather than send them to Farm Bureau who would have then released thier interest and transfered the title to the new bank.

Simple: The guy with the car sold it to the dealer cheap without the title thus he screwed the bank but got some $ and ran. The dealer thus had no title but he did not care as he sold the car knowing the buyer would be Fuc...ed as he has his $ and he could run too. It's simple. Don't buy a car alone Charles.

This happened to a guy at work. They took his trade, he signed the title over for a better used car. They didn't have the title and they came and repoed the car a month later. Now he's stuck with no car and a loan on vehicle he doesn't have. This is a scam that has been going on for years that's why I never buy a car unless I can see the title in hand.

What's up with some of these states? I had to buy a truck in Oregon when my van broke down moving to CA. They told me they would mail the title to my new address which was on the paperwork. It had a year left on the original plates. Registered with my insurance and thought we were good. Called them numerous times over the months, never received title. I paid cash so no financing. I gave up trying to deal with the dealer and contacted Oregon licensing directly only to be told there was no record of sale or title transfer. The ONLY way I got my title after TWO YEARS was by going to a DMV Title broker in CA and paying them $600 to deal with it. The manager told me that his secretary earned every cent with NUMBER of calls, threats, and STILL having to send the dealer more money to do what they originally failed to do!

I have seen this before. Usually what happens is the original lien holder sells the vehicle to the dealer, but the dealer never pays. The check bounces or gets canceled usually. Then the dealer sells the vehicle. What will eventually happen is the car is not considered stolen and the issue is between the original lean holder and dealer. The lien holder will have to hand over the title and fight it out in court with the dealer.
