Never, never, ever allow them to verbally assure you/ tell you something regarding a written order unless it is in writing. If ever there's a dispute, you must be able to prove it. Otherwise it's their word against yours. Unfortunately, "don't worry about it" and "tear up the notice/throw it away' will have somebody on the street homeless.

@@kakishisfriend1126 yes a verbal agreement is still an agreement. However, to become legally binding, an agreement that was written must be modified/changed in writing (new agreement). Conversely, a verbal agreement has to be modified (if there are changes) with a new written agreement. What the management is saying to the current tenants cannot be substantiated in a court of law if it were to come to that. They (the tenants) cannot just forget about a legal matter that hasn't been concluded in a court of law. She doesn't have the power to do that.

The key to this story is, a NEW company bought the property-in there lies the problems and issues. They want to get them out of there, and triple the rent-end of story-so that they get return profit on their investment. That is why they imposed those mysterious 'fees' to give them legal grounds for an eviction. I know not everyone is able or willing to own a home, but the BS landlords put people thru is unacceptable. Ms. B. Churchill

I live in a different state, but I've been in my apartment for 15 years and was only late on rent once by 2 weeks over 10 years ago. I got caught up within a month and on time since. Paying rent isn't just wasted money like some people think. I don't have to pay for or worry about MANY issues that go along with ownership. To me, its worth every penny.

When a rental unit or units are sold, the lease is still in force. The new owners don't get to change or cancel the terms. They might not renew, but the old lease is still the contract.

That depends on where you live and how the lease is written. Some leases can have an early termination clause if ownership of the property changes hands.

@@anye76 Exactly! It's fine to want to upgrade and make more money. But do it the right way and not send out bogus eviction notices saying that the tenants owe money. That's illegal and those evictions should be dismissed immediately.

@vickieclark5931 They tried that one on myself and the other tenants at my old apartment claimed we hadn't paid the rent when we had and a girl had cried as she was frightened of them and I had said how if she knew in her heart she was telling the truth that yes the rent had been paid in full and on time then that's all that mattered! With myself I had proof on my bank statements that yes I had paid both in full and on time and I had rung them up and had insisted that I have it confirmed in writing that yes I had paid in full and on time and I had demanded an explanation of why the letter had been sent out and they had threatened me with court for supposed rent arrears! I had said to them go on then take me to court but court will laugh at you and you will be the ones that look stupid and get charged with wasting court time! Court would have told them to get stuffed and they were just trying to bully! Say if I really was more than 2 months in arrears then yes that would have warranted an application to court to evict!

The SAME thing happened at my complex years ago. They used all of their printer budget to print those off then paid someone to actually walk the property and put those on so many doors, that the line in the office took an hour to get through. Many of us were late to work. Some of these property management companies are so sneaky, unorganized, and unprofessional. Its a job to them but these were our that homes they threatened to take away due to an error on their part. I was so glad to leave.

In the late 1980's I moved to Delaware into an apartment complex. The manager told me they don't accept checks so I paid my rent every month without fail, most times with cash but sometimes with a money order. Fast forward 2 years later and the new manager wanted to know why I was living there.The apartment I was in showed vacant on paper. They old manager had been throwing the money orders away and pocketing the cash. I'm damn glad I had all my receipts but it was BS because I had to prove I had paid my rent for those 2 years all because of a thief THEY hired. Especially since there were about 10 other people that it happened to.She was charged with embezzlement but I never got my cash deposit back either. POS corporate apartments.

people engaging in misconduct will insist on communicating in ways this isn't possible. It's why so many employers are so anal about getting rid of work from home. It's impossible to control the creation of evidence, so then when the company is caught doing illegal shit like creating accounts for people who didn't sign up for them you can't pretend it's not managment pressuring employees to do so.

Many people don't know that they need to do this. The tenants involved did the right thing to go to the courthouse. They also need to be sure to document all phone calls that they make to try to fix this "error."

Totally agree. I’m old school. I save almost all paperwork and receipts. My dad was like that. My wife was impressed when she was looking for a receipt from 7 years ago and I was able to produce it in 5 minutes. You just never know when you will need to prove something financially and your word won’t be good enough.

Then the democrats most of you complainers voted for just let in another 30 million people into the country that need homes also. That's not what happened and there is no law against raising rent. As long as you do it legally. At the end of any lease agreement when terms expire or after any violation of the agreement the OWNER has every right to Evict, Raise Rent, or change terms of lease.

@kybble that's not what happened but that looks like what they tried to do. Probably wanted her out so they could remodel and charge ridiculous fees for the next person. Instead of doing it ethically or waiting until her lease expired, they tried to speed up the process with fees that weren't in the contract.

@@chinaarlene7035 Like is mentioned this would never stand up on any court if you show your leasing document and you not in violation of it's terms. Property cand be sold at any time. But your lease is a contract that can't be broken without consequences. I wouldn't be in the slightest bit worried. I would rather have this happen to me a 100 times. Versus what government did in 2019 with the eviction moratorium . That was completely illegal.

@@strangerinastrangeland3613 Let me say it again then. The EVICTION MORATORIUM was completely ILLEGAL and a BAD THING. The government has no right to breach a contract between 2 full gown adults. We all went though the exact same thing. I worked though the whole thing not a single day of work missed. Not a single person should have been told they cant go to work not a single business should have been force to close because of government telling you to do so. There is no such thing an essential worker. If your job puts food on your table and pays to keep you in your house(rent) it is an essential job. As stated before, right before this all started I removed a tenant from my rental. I let the rental sit empty for 2 1/2 years happily paying the mortgage, utilities, and did all the lawn care. While all the time as I was there doing upkeep was asked many times if wanted to rent the house. I told them all Hell no. Not until the idiot president and governor lifted the eviction moratorium. I'm not a building Supe I'm the landlord/owner. Not renting home unless I can remove someone for violating lease terms. To make it even more clear to you Idiot refers to both Trump and Biden but more on Biden and the Governor of Illinois Pritzker.

After this, tenants need to have regular monthly meetings. It’s obvious these are shady and unscrupulous land owners. They’ll try another trick and if you’re not connected with your neighbors you’ll never know what’s going on the NEXT TIME something happens.

It sounds to me like that lady (the building manager) was embezzling money... and when the building was sold, and someone else took over the building's finances, it looked like some tenants hadn't paid rent. She then tired to fix the issue, but probably couldn't, and she was just buying time to cover her tracks.

"she could have bought a house" is not always practical. if you own repairs and maintenance are your responsibility. i have always rented. the landlords mowed the lawn, shoveled the snow, and repaired/replaced anything that was worn or broken. in the past few years they have replaced the refrigerator and entire hvac unit plus many small repairs. now they are replacing a window. i have several medical issues and could never do all this myself!

When purchasing a property, I tend to dismiss any small moneys owed to start fresh with existing tenants. Although the rent may increase, I offer a six month notice to allow tenants to make proper arrangements. I'm not in the business to lose tenants but try to create a better relationship. That's my part.

My parents built an affordable set of apt. unit (Maytags in all suites) in a new arrival area─ and would NEVER behave like Trumps relatives: destroy their credit rating by buying the old bldg. along with owned monies. New Testament stuff; you just don't do that as a matter of Code and behavior as nice people. We were never stiffed on rent. Some renters relocated and a year later showed up and paid, thanking my parent for their understanding and compassion, in COMP~ARison to some of Trrumps relatives and their CULTURE of money.

They dont need a class action law suit if they have a lease agreement the terms cant change unless they violate the terms. End of story. Any judge will though an eviction notice out under these circumstances.

That is not how that works. In Georgia, you have to go to court and prove you have been paying on time and you have the paperwork. But if you have not been paying. The apartment complex must go to court an notification to appear in court. Once you appear in court, if you lose, the court will give you 30 to 45 days. When the time is up, you will be evicted and all of your property will be out of the apartment, in the street.

GURL! WRONG! Once the fil you may have 10-30 days before court but once it goes to court the judge gives you only 7 DAYS TO VACATE!!!!!!!!!!!! IF YOU DO NOT GO TO THE COURT DATE THE JUDGE WILL GRANT IMMEDIATE POSSESSION TO THE APARTMENT AND THEY WILL THEN HAVE THE SHERRIFF ACHEDULED TO COME OUT ANY DAY AVAILABLE AND THEN THEY TOSS YOU STUFF IN THE STREET! After you don’t show up or or told to leave there are no more warning or time! You gotta bet it! Also, people will go through your things if you not there or did not prepare to move with a moving vehicle! I’ve seen it happen a few times!!!!!

21 years…she practically paid their mortgage and has nothing to show for it… landlords shouldn’t be able to exploit people like this and then kick them to the curb. The advice she got to ignore the letter is deceitful-they know that if she doesn’t show up to the court on the court date specified the lose by default.

May depend on the state. In my state, if you turn in keys before the constable shows up to boot you out, it's not an eviction.

This is why everyone needs to keep thorough records of everything, whether it's statements or even conversations with the leasing office or landlord. It's unfortunate, but people really need to think like an attorney/investigator and gather as much evidence as possible, even if you think "oh it'll never happen to me".

At my previous apartment there were a couple of times when I got accused of not paying the rent when I had and thankfully I managed to dispute this and make the letting agents look stupid as I had my records and bank statements that said in black and white yes the rent was paid both on time and in full so that made them look stupid and incompetent when I had physical proof that I was telling the truth! I had asked the agents that I wanted it in writing that yes the rent was paid and in full and on time and yes I did get it in writing and I did receive an apology as well!

That's become a norm for a lot of people. I used to work with a guy that has lived in a tiny 1 bedroom apartment for over 24 years. I actually talked to him the other day and he is still living there.

if the fees are not on your lease then they are not your fees - I've gone through that BS - a new company bought the apartment complex I once lived in & tried to say free basic cable would no longer be free - according to the lease free basic was included for the entire period of the lease - there was nothing the new company could do until the lease was over

That should be illegal. Serving an eviction notice should be served personally, not stuck on a door. In California, we have tenant laws that would make that an easy case for intimidation and harassment.

When someone tells just ignore it, don’t. Find the source. I did this on a spa contract and dues were due or lose my membership. A friend told me it’s ok to do it later. NOT. I was 22 and stupid. Always take care of business at hand and listen to a friend, family member or spouse. You take care of you!!!

There was a neighbour at one of my old places that lived in his apartment for 36 years until he got turfed out back in 2017 as they wanted to redevelop the place but thankfully I had moved out off my own accord before that happened!

Back in 1997, it was cheap the prior 5-7 years. It was a buyer’s market. I only accidentally found that out and it was cheaper to buy than to rent. It was one of the best things I ever did for myself. Financial stability.

And this is helpful how? I own my home, but "affordable" comes with a lot of costs. Just like the people that say drive a car forever, it's not that simple. You can easily spend double your mortgage in maintaining an older home, which even 20 years ago were the only homes "affordable" to most people. And some people just want to be able to pack up and leave a neighborhood, city, or entire state, and that's okay too. I'm sure the lady didn't plan on living there 20 years, this is life.

@@iNick500 You are delusional to assume you have insight into this woman's plans. Yes, this is life, and we can ignore it, hide from it, participate with it. We know we get older, we know we can't work forever, we know expenses increase, we know one day a paid off house no longer has a mortgage. Some use that to prepare for their elderly years and have generational wealth to leave their children, some watch TV. instead hope things work out. My house was built in 1949 and was built like a brick. In 20 years here I've replaced the hot water heater and an HVAC both I knew would need to be replaced eventually so I created sinking funds for them early on, that way it's an inconvenience not a catastrophe when needed. We all have 24 hours a day, 7 days a week, we can use that time or waste it.

You all did the right thing, you went to court to inquire why and contacted the media for answers. In the future never throw any document or receipt of anything for a couple years. I know that sounds crazy but it has saved my life many times! Even a parking ticket that had the wrong time on it, i had just been to Walgreens across town and bought stuff that proved, by the time and date on my receipt that I couldn't have been parked there at that time!! Thankfully with myself when I was accused of not paying rent I had my bank statement to prove yes the rent had been paid and yes in full and on time which made the letting agents look stupid!

I just use the lease I signed. It usually has what you're going to pay for the remainder of your lease term. However, if you switched to month-to-month, especially verbally, you might be SOL.

I was just offered a good amount of money for one of my rentals. I currently have a single mother of 3 renting it. I keep the rent low, because I know she’s struggling. I no longer want the house and the offer is more than fair. I’m probably going to sell it. It’s just unfortunate that the tenant will be the loser in this deal.

When I had my first apt I made sure to keep ever cancled check when I paid rent I even to photos of them being handed to the apt manager. After my first year in that apt my lease was month to month with a 30 day notice of moving out which is common in most states. This management company for my building hired a new manager who most of the tenats thought was questionable ( sleazy ) this guy would accept the checks or money orders and cash them for himself. After 3 or 4 months some of the tenants in the building along with me got an eviction letter saying hadn't paid rent in months, we all contacted the real property owner what was going on and we had proof we were paying the rent. The lady who owned the property looked into it and found out we had been paying ( mostly because we sent her copies of our cancled check and copies of the money order stubs. The new manager was fired and later charged with grand theft. I gave notice after that and moved out along with two other tenants. ( kinda funny that now I work for a property management company in a different state )

My experience owning a home was horrific. I'm happy to only be tied to a place for the duration of a lease, I'm happy to need only make a phone call when something expensive breaks. When renting you just need to make sure you document everything. When signing at a new place I always list, photograph and document every mark and just as I'm getting ready to sign the lease I present my findings and have the potential landlord sign. If they refuse, I walk away. Owning a home isn't for everyone but when renting it's important to cover your ass.

Exactly! I'm all for you evicting someone if they aren't paying their rent. That's your right! But it's not the right of any landlord to falsely evict someone and claim they owe money to break their lease. That's against the law regardless what state you live in.

A mind that only sees money as the end goal will not understand why some people will chose their living arrangements based of off factors other than money. This woman may live alone. She could have certain physical challenges. She could have mental challenges such as paranoia. She may not have family. When certain things are a factor, communal or apartment living may be a better option. Some of you may be narrow minded and can only think of what YOU would do in certain situations, which is OK. But it’s a sign of why American society is on a moral decline, because people can only think of themselves and have little empathy for the situation of others and cant see the other side. Some of you may not be a homeowner to realize that lawn care is involved with homeownership. Home maintenance, pest control, home security, etc.

Business has no empathy, just like her. What if she was asked to cut her pay for someone else? She would say no. The property owners are entitled to make money. Period. And as far as people’s problems, how come landlords seem to always be required to ‘take that into consideration’ and no other business? If you don’t pay your car note what happens? They take the car. If a mortgage holder doesn’t pay the mortgage, what happens? They take the property. Renters just stay and complain for months while property owners lose income. People seem to understand that but expect landlords to give them housing. How is that fair? It’s not

@@dcg590 You’re comparing apples and oranges … a car has a designated price and “other” fees aren’t tacked on after the purchase. Also, your monthly cost doesn’t go up because of inflation. Finally, there are “lemon laws” for cars and there should be lemon laws for property owners. Today’s renters are being treated like vagabonds, and a handful might be. But for the most part the government has failed in building more affordable housing (like apartments), and zoning laws, of which almost 80% are for single house dwellings, limits a city’s ability of providing housing for its citizens. So, as the population grows housing doesn’t. What kind of sense does that make? You’re the kind of person who sees with cloudy eyes.

Renting no matter how long, does not make you an owner ever, no guarantee you get to stay forever where does that mindset come from anyway? Owning costs more always, most homeowners insurance has doubled yet rents are being controlled to a point where maintaining isn’t even possible, I suppose some folks think a landlord should start paying people to live in their properties. The ‘Nobody should be landlords’ notion is a pipe dream. Most aren’t even responsible enough or want to be, let alone could afford to be an owner, homes require constant care/maintenance that love to surprise you and the taxes/insurance are always lurking around the corner going up up and away…be careful what you wish for

Their rent is now going to be increased until they're forced to leave. This happened to 3 apartment complexes in Florida when they changed ownership, but the news stations didn't care, because they're corrupt too. Many disabled veterans were evicted.

They "said" don't worry about this, nor that. OK, but did you get it in writing? Did you follow up in 24, 48 hours after being told "don't worry about it"? Shady as an a landlord can get, but seriously get things in writing. Otherwise is word bs word.

You have to be served to go to court to get evicted. Taping a notice to the door is not serving. Further they can go to court with the original lease and copies if their paid rent receipts and it will get tossed in two seconds.

@@hollystiener16 it is absolutely true. You must be served. Now if you don’t go to court then yes the eviction will be granted and the sheriff will evict or lock you out. If someone told you they were evicted with a simple note they were lying. Now it’s possible an unscrupulous LL might falsify serving the notice. Many tenants also think if they avoid service that they won’t be evicted. In some areas if the server (often a sheriff deputy) knows the people are home and they refuse to be served after some number of attempts they will send a letter instead. It seems to be a head in the sand situation. If I ignore them they won’t evict me. You are much better off going to court and asking for an extra 30 days. I am shocked at the people who claim they didn’t know they hadn’t paid rent in six months and had no idea they were being evicted. The only time that has happened is when a bank forecloses and the person renting doesn’t know. That was generally addressed by requiring advance physical notice on the property. My sister in law found out their apartment was being foreclosed on by physical notice. She asked me what to do - stop paying rent? I told her to call the bank and they gave her the contact for the new property manager. She paid rent to them and no problems. She was not evicted. One of her neighbors paid either the old owner or just didn’t pay (hard to say) and was evicted.

@@BusArch42 If you receive a 3 day notice in LA County, you must go to court or the sheriff will lock you out. I experienced it. I was in Paris and made a mistake and paid my rent from the wrong account so it didn't go through. When i notice on the 3rd of the month, I contacted the landlord, which was a huge property manager in LA and he said if it is not paid by the 5th I will get the 3 day notice. I was in Paris and he would not take an electronic payment and there are no American money orders. I went to the US Embassy and everything. It didn't matter to him. I was coming back on the 12th. But I did have a 3 day notice and I would've been evicted had I not begged him I not go through with it until I came back. It was a notice to vacate and there was nothing that I could've done barring going to court or crying to him on the phone and begging him.

The note on the door, is just the "notification of intent to evict" not the actual eviction notice. Think of it this way "hey leave the store we're closed, or I call the call and tell them your trespassing". When they're actually evicted, ya goes to court. Given this court already had paperwork to be "dismissed" sounds like the owners were doing automatic processing. There's more to this story.

@@erickyle5604 agreed. Some places will allow you to serve by attaching a physical notice if the process server has made several attempts to physically serve the tenant. Some tenants foolishly think they can avoid eviction by refusing to get served and ignoring the court date. If you don’t show the eviction is granted with whatever the judge determines to be sufficient time to get out.

My sister and her husband have rented a house for 27 years. Why? No one really knows. Her husband was totally against buying a house or moving out of the house. They do all the maintenance issues that comes up.

So true. After this plandemic, the rent went sky high. I was very thankful that I have a fixed rate mortgage. My mortgage hardly ever changes. And when it does, it's by 15 or 20 dollars, not hundreds. And half the time it goes back down, when property taxes drop. So I can safely say that my mortgage is pretty stable.

Yep -- new owners looking to upgrade. Twenty years tenancy is long and hard on the unit. Hoping the new owners realize cash-for-keys is better than eviction on trumped up charges.

You have to wonder about the company that bought the place and suddenly tacked on new fees to all the apartments. That sounds like grounds for a joint lawsuit by all the tenants as doing that is not legally allowed. Oh when a lease comes up for renewal the company can then proposed a new lease with the fees added and you can agree or move out. But doing so on a change of ownership of the property is wrong and I suspect any court would award any fees paid back along with damages. And any lawyers for such a company should be telling them do not do this!

News team should had done a better job. Law requires 30 days notice for eviction. Time doesn't start until Judge approves it.

ALWAYS take a picture of every rent payment. Then if there's any question, you have the proof literally in your hand. Also, always pay with a money order. That way there's a physical paper reciept, and nobody can claim a missed debit or something

Georgia Don’t play ! Scan and file and make copies of your receipts! Once the file for disposition , you may have 10-30, maybe 6 months depending if they are backed up or not days before court but once it goes to court the judge gives you only 7 DAYS TO VACATE!!!!!!!!!!!! IF YOU DO NOT GO TO THE COURT DATE THE JUDGE WILL GRANT IMMEDIATE POSSESSION TO THE APARTMENT AND THEY WILL THEN HAVE THE SHERRIFF SCHEDULED TO COME OUT ANY DAY AVAILABLE AND THEN THEY TOSS YOU STUFF IN THE STREET! After you don’t show up or or told to leave there are no more warning or time! You gotta beat it! Also, people will go through your things if you not there or did not prepare to move with a moving vehicle! I’ve seen it happen a few times!!!!!
