I saw it yesterday and I like towards the end when that Fat cop tried to hold back the other cop at the back door, the cop said 'you need to back up, you're not even certified ' lol alot of these small dept have their 🐷 go thru a 6 week course and they dont really learn anything about law in that time. Nerys Cops & firefights are not under DOD ( Department Of Defense ) and are not subject to UCMJ ( Uniform Code Of Military Justice ), but civilian law. They are only required to inform you of your Miranda Rights. We had to win a case to even get that which is frightening. I guess the Constitution wasn't clear enough when it came to our 4th and 5th Amendment rights. Cops can still lie to you though and lie by omission they do with almost every interaction. Of course, I'm not sure it is efficient for a Cop to sit there an inform every person they interact with and it's probably not wise to act as legal counsel either because that can lead to charges and civil penalties if bad information is given to a person. I guess what I'm saying is the law is too complicated, and that's a good thing actually. Life is complicated and our laws should reflect that. You're right, they fail to inform you of plenty of other rights while interacting with you, but they are not legally required and will not do so. Here this Sheriff has absolutely no right to refuse the warrant. These Cops are being extremely nice to him. The Sheriff and two of his deputies here should be convicted on obstruction charges based off of this video. The Sheriff for not being timely, the Under-sheriff for aiding him, and a Constable at the side door for disregarding a lawful order during the execution of a warrant.

According to NM state Constitution, the local PD, WHO IS ALSO THE PLAINTIFF IN THE CASE THE WARRANT WAS ISSUED FOR, has no legal jurisdiction over the county Sheriff. None. It was an illegal act. Deleting something will incriminate him further, because they'll b able to show what was deleted and at what time. I don't suspect that's what's happened. When we were younger it was easier. Go to Bucks County , Pa. and look at those huge cannons on the belts of the Yahoo pickup truck and tractor drivers. Idaho allows open or concealed carry if you are 18 yrs. old. They do require that you are not deceased. The old ladies in NY state now carry concealed because the open carry guns were scaring off the tourists. NYC and N.J. require you to 'conceal carry' popcorn balls or cheese doodles to ward off violent attackers. California also. Though in N.J. cops readily admit many many people carry without a permission slip because police corruption coupled with Judicial corruption will not get a license to carry. Though bribery of someone works wonders.

Bryant, because the warrant was from a city MAGISTRATE . AN ARTICLE1 SEC8 COURT. MAGISTRATES DO NOT HAVE THE POWER TO ISSUE WARRANTS. The Sheriff has more legal authority than that magistrate.At the end where he told them to not go through the magistrate because they are NOT CONSTITUTIONAL COURTS.ARTICLE 3.

Wolf Locke The Sheriff was not actually served a warrant. It was null and void. It was illegally served. The local police are under the Sheriff. They have no jurisdiction to serve him. The sheriff must report to the county court to be served. If that fails, the court is to have a state or federal agency serve the Sheriff. The magistrate and local police were acting as criminals violating state constitution. Either we are going to follow the constitution for all, or not?

Further, the Sheriff, if he was within his county, had every right to commandeer that scene if he wished to. He has the power and authority to do that as Sheriff, it's pretty obvious the PD here not only didn't like it, but has vowed a vendetta and are showing THIS Sheriff that no elected official of the people is going to tell the cronies of the MAYOR what they can and cannot do! @@McCleod I saw little PD army men when they arrested him all suited up, ready for a gun battle with the SO, so they must have something like SWAT for their PD, put typically 100% correct; most SWAT teams for small to avg cities are left for the county to facilitate. Makes sense as they have jurisdiction EVERYWHERE in the county, and the SWAT in the city PD does not. They cannot leave the city.

Whitey Powers There is a guy here on KZbin who proved that the footage on an officer’s body cam was edited when he obtained camera footage from a nearby cctv camera that captured the incident as well. Their body cam video is not for protecting the people that’s for sure.

So, the police allowed 10-15 minutes for them to walk in the back with the phones, switch phones, delete the evidence, and then switch the phones back, and buy time. If only We The People, the citizens were treated with so much "respect". We're manhandled, threatened, beaten, until we give up our evidence, whether or not there is a lawful warrant, our own tax money used against us in the court of lawlessness, but we're told we have a Right to a fair trial? HA The Sheriff that grabbed the arm of the PD officer, would have been thrown to the ground, if it was any one of us. The officer in charge even admitted on video, that he called to give them advanced notice, but the Sheriff didn't answer. That would never happen with citizens.

It's amazing how calm and patient cops can be when the people they're interacting with are wearing the same costumes. Except for the fact that the execution of the warrant, even if the warrant was in order, was an illegal act. According to NM state Constitution, the local PD, WHO IS ALSO THE PLAINTIFF IN THE CASE THE WARRANT WAS ISSUED FOR, has no legal jurisdiction over the county Sheriff. None. It was an illegal act. Neither you, I, or this Sheriff is obliged to obey illegal actions by law enforcement. They later came back and arrested him. Watch and see what happens over this.

Crfor Freedom the court wrote the warrant. The warrant was valid and is legal. Not sure where you’re getting your info from, but the sheriff has now been arrested for interfering based on evidence collected from the warrant issued. I’m sure that’s illegal also, correct? By your logic the Sheriff can break the law with no recourse against him. Not how it works!

By the Constitution, the court should have called the Sheriff and ordered him to come in with the phones and surrender them and issue the warrant themselves at that time. PER THE STATE CONSTITUTION. If he did not reply with the court's order and the warrant needed to be physically executed, then an agency WITH AUTHORITY OVER THE SHERIFF like a state or federal agency should have executed the warrant, not an agency with no constitutional authority, and certainly, not the plaintiffs in the case the warrant was issued for!!! The warrant may be legal, but the execution of the warrants was as illegal as hell. From the point the warrants were issued by the court on.

The PD's interaction here was illegal per the state Constitution. That doesn't even include the fact they had a conflict of interest as the plaintiff in the case the warrant was issued for! Watch and see; the Sheriff, like you or I, have no legal responsibility to obey an unlawful order...... The PD per the state Constitution has no jurisdiction over the county SO. None.

Would you think that more serious than the actual firing/dismissal of a duly elected by the people Sheriff? So on that basis, he issues a warrant for his arrest. The next day, the president comes to town to hold a rally. The local PD approach the president and by force, demand permission to enforce the warrant and perform an arrest. What do you think would happen to these officers? What do you think the Secret Service and other federal agencies would do to these officers? STOP THEM. Of course, by any means necessary. He's the president of the United States! No local town's PD has the authority to perform an arrest or execute a duly issued arrest warrant for his arrest. Period. WHY? Because HE'S THE PRESIDENT! He's federal where the PD are just local city cops WAY beyond their jurisdiction to legally be able to execute ANY authority, especially by force, against the president. He's SEVERAL levels of authority above them. Wouldn't you agree? So tell me, what's the difference between one level or 10? Any number times 0 still equals 0!! 1 x 0 or 10 x 0 still equals 0! You can't take 0% authority, just because it's 1 level removed from the Sheriff and say it's "OK" to bend the Constitution! You might as well attempt to arrest the president by that logic! 0% authority means it is NOT LEGAL. Period.
