very good. I am a lawyer and he's got it right. 1) always ask, "am I free to leave". keep on saying it. 2) I object to searches, I object to being arrested, I object to being detained. Whatever the police want to do, object to it; 3) if they reach for the tazer, say "I have a heart problem and you cannot Taze me" doesn't matter if you don't have a heart problem, if they Taze you, you will, plus a whole lot more problems. Women can say they are pregnant. I think I may be pregnant and you cannot Taze me. A woman can be between 12 and 90 and you can say this. 4) I do not answer questions, I do not answer questions over and over.

Having listened to this attorney make his pitch, how would you like to hear some real world truth? I have been arrested, and beaten by the police, for insisting on a search warrant for my apartment. Then they took my keys, let themselves in, and searched my apartment. I spent about 27 hours in jail, and had to spend a bunch of money on an attorney to fight thru 2 court cases to keep me out of jail. Constitutional rights are great, but they don't mean squat on the street. Even the judge would not let my attorney talk about Constitutional rights and search warrants in the trial, told us that he would find us in contempt and throw us (my attorney and I) in jail if we raised that topic. These video attorneys can rant and posture all that they want. But the bottom line truth is that they will not be there when you have to deal with the police on the street and you try to stand up for your rights. And you don't have to have broken any laws to be arrested. Yeah, the attorney will be happy to take your case and represent you in court, as long as you are paying their hourly rate. Another harsh truth that you will probably learn? The truth and justice are not the same thing. Think about that one for a while.
@texasfossilguy5 жыл бұрын
You made a mistake hiring an attorney. If you fought it yourself and counter sued you could have won.
@bigk47555 жыл бұрын
@@texasfossilguy One lesson that I have learned long ago, and this applies especially when opposing C&C Denver attorneys, (but I suspect would apply in any case where it is a private citizen vs the municipality) is that if you represent yourself in court it will not matter whether you are guilty or not, (right or wrong) you will be found guilty of whatever you have been accused of. In this instance Denver was offering 10 days if I would agree to plead "No Contest" (credit for the one day already served awaiting for bail to be processed, probably have to serve 6 more with good behavior). Why would I ever agree to any kind of plea? Especially if I didn't break any laws? Especially if that deal included time behind bars? That was to big of a risk in my opinion to try and represent myself again. If I had tried to represent myself, C&C Denver was bound and determined to have me spend some time in jail. The DA had come in to the courtroom and had a private conference with the judge right before the trial commenced to explain how they (Denver) needed me found guilty of something/anything so that I could not sue them for police brutality. That was why the judge would not allow us to raise the issue of constitutional rights and no search warrant. Denver was also gambling that I would not be able to afford to pursue this case beyond district court where they could influence the outcome. On that count they were right, I did not have the means to finance additional legal fighting. If you are poor, then justice does not apply to you as much as if you have money. So in short, no. Hiring an attorney actually did keep me out of jail. And several months later at a separate trial when Denver tried to have my seized property condemned, that same attorney was able to force Denver to return that property. And for the record, the seized property was a legally sawed off shotgun.

this is a very informative video as these situations happened to me as a 24 yr old. Cops pulled up on me while i was sitting in my car eating a burger and drinking a shake. They proceeded to ask me every single question you mentioned in this video. At the time i didn't know my rights so i went along with it and they searched every inch of my car and work bags... and when they couldn't find anything they called in a k9 unit to further search the car. I had to stand in front of the police cruiser while an officer pointed a gun at my face telling me not to run or else they'd shoot. They even took the burger i had and tossed it on the ground. After they still found absolutely nothing they were like "you're free to go " and they drove the hell off. No explanation. No apology. I felt so violated, i just drove home crying. All because i simply didn't know my rights being young. That was about 9 years ago.

Outstanding advice. With regard to speaking and assuming the police are on the up and up, they are still human, subject to mishearing what you (the suspect) says or misinterpreting a comment. I would add, be polite. The danger here is that not talking WILL PISS OFF THE COPS. They may even "detain" you out of spite or frustration. Ultimately however they are not the district attorney and have to PROVE BEYOND A REASONABLE DOUBT your "guilt". Not only do not talk to cops, know your criminal justice system and rights.

There's a case out of Louisiana a few years back where a suspect asked for "a lawyer, dawg" and the judge ruled against him in court. If there is any ambiguity the cops will pounce on it. Even saying WANT may be too unclear. Say demand or something like it instead.

Good video, and I agree with you 100%! I was a police officer for over 24 years, then Workers Comp sent me to college, when a line of duty injury put me on the disability list. I became a paralegal, graduating at the top of my class, however what attorney in his right mind would hire a disabled former police chief who is over 50 years of age. A total wast of time, but it was a fun 2 years, and I learned a lot that would have been very useful if I had been able to get back to work as a cop. Now I am (presumed) retired by the bureau, they cut my paycheck in half, but still we have enough to return to our winter quarters at an RV park in Arizona. Anyhow getting back to your video, I loved it, wish I could get one of your cards, because people are always asking me about such things when they learn of my background, and they would save me countless hours trying to explain to just plain common nomads what they should do if they have an encounter with law enforcement, no matter what the circumstance. Asking questions like where are you going, where did you come from are to get a quick assessment you. Have you been drinking, are you possibly having a medical emergency, are you having an emergency, etc.. It may also help you receive a lesser violation or no violation at all. Don’t act like you know the law if you really don’t. Don’t act like the officer knows every law on the books. They also don’t, there are a lot of them and they change all the time. One last thing laws change State to State, if you think your State law violates a Constitutional Right, well if you have the money to get it changed great. If not you are going to still get charged.

Jay, I am a 1st amendment auditor and activist. I'm linking all of your videos on my KZbin channel! This kind of work is dependent on knowing your rights! I'm going to be spreading your videos and recommending your channel to thousands of Auditors around the country. We are currently trying to set up a non-profit fund to help with court costs and bail etc. For auditors who are wrongfully arrested. Any suggestions on that subject would be greatly appreciated. We're getting attorneys all over the country lined up to help us😎🤘👍💪

I'm so happy to get educated. I'm at 33 yrs old and am being harassed by a officer and neighbor but no one does anything. Even lawyers do nothing. I have now spent over 4 grand in legal fees for my innocence. And am so tired I wish I would have taken that money and moved. He's even taken my puppy. I live here in a nightmare right now afraid to let my children play outside.

Great video, just one little remark. Since 2013 and the Supreme court ruling in Salinas v Texas, if you are qustioned prior to reading Miranda rights, you must unequivocally and without a shadow of doubt invoke your 5th amendment privileges, otherwise your silence can be used against you in the court of law. Which means simply handing this card to the officer won't do the work, you must specifically say it. Also you can't use wordings like "I think I want to speak to a lawyer" or "Can you get me a lawyer?" since they are not unequivocal.

James: Don't fall for the semantics. What happens if your are deaf or dumb?
@jamesthurnwald92787 жыл бұрын
I honestly don't know what to do if you're deaf and mute. Even when you're not, you can just remain silent and you won't say anything incriminating. I'm just saying if you wind up in court, prosecution can use that silence against you.
@BatheHerWellAndBringHerToMe6 жыл бұрын
James Thurnwald *Even when Miranda rights are read to someone, the very first question **_always asked_** is -- "Do you understand these rights . . .?" ---- If you then give **_any verbal response,_** of any kind at all, you have just given up your "right to remain silent." It may mean little to nothing, in some cases. But certain cases can be dramatically impacted by any reply made after being given the Miranda rights.* Yes, people can then remain silent, but they should not utter any response when asked if the rights read are "understood." Sometimes when cops ask "do you understand these rights," and the reply to that question is complete silence -- cops have been known to say -- "well then, _you do_ understand your rights." Most people _do not understand their rights,_ and therefore are not equipped to fully exercise them.
@timsteinkamp22456 жыл бұрын
The actual question is, "Do you understand what I said?", as do you understand the English language, but it is not, do you know what they are. The American people should not have to know what the current Supreme Court ruling is on the terminology. We have lives to live raising our children and paying our taxes. Attorneys and judges love to dissect the law and keep changing it. It is pure argument for lawyer minds but is not for free USA minds. Instead of police learning and honoring the rights of the citizens, they can lie and confuse us with words that we have to know the current meaning of words in every jurisdiction of this great land. Don't listen to this crap here. He is putting the blame on us instead of the American Bar Association.
@BatheHerWellAndBringHerToMe6 жыл бұрын
Tim Steinkamp *The "actual question" which almost **_all_** police ask after reading the Miranda warning is -- **_"Do you_** understand **_these rights_** ... ?" They **_want you to speak any answer to that, it does not matter one whit what you may say._* _Any reply_ made to that question can be problematic, _because_ people all too often will speak further -- beyond answering that one question -- and that then can become a big problem for them. I know what you're saying that people should not be responsible to keep abreast of all the changes made to the laws or wording of laws. Though it seems strange, _"ignorance of the law"_ is no excuse. Unfortunately, in some cases. But the court system is something of a racket, as you know, and the court does NOT stand for the rights of the accused. I once saw a kid in court who got a ticket for reckless operation because he did a "wheelie" on his motorcycle. At the start, the "officer" approached the judge and told him that he had made a mistake & had written the ticket for the _next town over,_ and NOT for the town the kid was actually in. Any decent judge would have dismissed that on the spot, but coulld have still taught the kid a good lesson. But not that judge, a "cop's judge." That kid was about 17, knew nothing about his rights or court, and was alone in there. The judge tells the kid that "the officer made a mistake on the ticket, so do you have any objection to proceeding?" Might as well been speaking Greek to the kid. He said "no." I sure wanted to correct that, but I could not. The boy ended up with almost $200 in fines & points on his license. That was 20+ years ago. That judge is still doing the same sort of business in "his" courtroom. Cops do not ask "Do you understand what I said" after reading the Miranda. Those rights are not "what he said." Those rights are carefully worded for a reason, and still, people babble on after hearing them, without realizing what time it is by then.

All American citizens need to learn Title 18 U.S.C. sections 241 conspiracy against rights and 242 deprivation of rights under color of law and use the law against all prosecuting attorneys/DAs along with the actual text of the constitution of the united states of America against them in the courts.
