The new form of marriage hasn’t been accepted. There’s not been a vote since the Supreme Court pushed it through. It’s absurd to on one hand question the 14th amendment basis for roe while at the same time assuming the 14th amendment basis of obergefell is sound, given both are overly broad readings.
