Well said, if JD turned up for pirates movie drunk what the big deal, the role he plays is that of a drunk but conscious captain. The person who cast JD for the role couldn't have done any better. He was spot on bcos that's JD in real life n everyone loves Captain Jack=JD.

I had the same opinion as you but in the past couple days watching more and more trials has educated me that they need to ask these questions to lay foundation otherwise of you directly ask the obvious question that you really want to, the opposition immediately objects for lack of foundation or hearsay or speculation. So they HAVE TO ask if they agree to or are aware of etc type of questions that fortified why that witness is even valid or why they can answer this particular question.

I can see what they are trying to do though. This is a defamation trial after all so they are trying to argue that Amber's article is not the main thing that ruined Johnny's career. They just go about it in a extremely stupid way imo. You have an expert there that tries to explain why the op-ed hit different and that it is all connected to context and the time it got published but all ambers lawyer is trying to do is to shut him up as much as possible. They are trying to get him to say certain things that are a bit more general, purposefully try to ignore the context and get him with some stupid gotcha arguments. They have nothing on Johnny and only make themselves look like a bunch of clowns.

@@anitaingram6297 if it is an article/report you can use it as proof, but in the article itself it usually says "reported" "allegedly" etc... which implies it's all speculations. So the articles themselves are saying that all that shit is unconfirmed

I read an article once which insisted that a London double decker bus had been spotted on the moon! Many years ago, my late Uncle worked in the news sector. I was telling him something I had read and he laughed, saying that was rubbish. I, young and silly said, "But I read it in a newspaper!" His reply? "Newsprint will take on anything." I often remember that comment!

He's trying to argue that the damage to Depp was caused by multiple articles instead of just the article in question at court, so Turd shouldn't have to pay any damages for her opinion piece. His argument is having problems since most of what he referenced used her article or her as a source for the things said to hurt Depp's reputation. To win he needs to show that even without the lies Depp's reputation was on a downward trend that would have caused the same loss in opportunities and that it was Depp's known behavior causing that trend (thus Turd doesn't have to pay) That is why he keeps bringing up the stuff from before Turd's article and why the expert damaged his argument by stating that Disney didn't care if he got drunk or did drugs (plus the hinted argument that getting drunk on the set of a movie where you play a drunk pirate could be argued as method acting... the "guy pretending to be drunk actually got drunk for the role" possible argument)

That's true, but he's not presenting his case, he's cross examining Depp's witnesses. It's quite straightforward - this is a case about defamation - not whether Depp was an abuser or Heard was an abuser, it is specifically about an op-ed that Heard wrote and the affect it had on Depp's career. What Heard's lawyers are doing is showing that even Depp's witnesses agree that there were many articles written about Depp that could just as easily have been the reason for Depp not getting work. When they present their case, they will argue that there is no evidence that it was the op-ed specifically that caused Depp to lose work. That means they can argue that the op-ed did not cause the damage Depp claims, and thus Heard should be acquitted. Even if the op-ed was false, even if Heard knew it to be false and was actually the abuser - if Depp's legal team can't prove damages then she should be acquitted according to the law. You may think they are stupid for constantly hammering on about these articles, but it is a foundational argument - did this op-ed cause the destruction of Depp's career, or was his career being destroyed by critical articles long before heard wrote her op-ed?

@@nehpets216 Except Depp is not suing for the "things said to hurt Depp's reputation", he is suing over a specific op-ed. All the articles read out in court by the defense lawyer pre-date the op-ed, so are not a result of the op-ed being published. The question then becomes, is the op-ed solely responsible for the damage to Depp's career, or was it just another blow in a long list of blows to his career. That's where the argument over damages will be. This witness said one thing that will help Depp - all those articles were typical 'rag fodder' and he considered it to be "background noise". That's important. If those other articles had an affect on his career, then it will be very difficult to prove that Heard's op-ed caused the damages Depp's team claim it did. If Hollywood in general did not care about the bad press surrounding Depp prior to the op-ed, then Depp's claim that the op-ed itself caused the damage would be justified.

To be fair, the articles are a follow up to the point that these rumors were around before the op ed and therefore it could have been those incidents that lost him money and not the op ed. And when the witness said is there any other husband who abused Amber in 2016 he almost put his foot in his mouth.

It depends. The issue here is that the lawsuit itself is about a written opinion piece. Depp's team is trying to claim AH's article is what tanked his reputation. So, AH's team is trying to show other articles about Depp existed before that, trying to prove the other articles may have been just as responsible for that and not AH's op-ed.

The judge called Depp a wife beater - that wasn't for him to decide whether or not Depp was a wife beater - just whether the Sun printed what they believed and could prove was factual. The most ridiculous thing is that a majority of the same evidence is being used to try both cases.

He just took AH word as gospel. Remember The Sun is owned by a very powerful media company and they have got away with a lot over the years. So even though actual facts were on JD's side they were ignored and fiction won. He even had the nerve to say someone who gave 7 mill to charity doesnt sound like a gold digger to me. That judgement was a farce. Thank god that judge is now retired. I think that was his last case. Also he and his family had connections to the newspaper. From what I remember I read at the time his son actually worked alongside Wooton who wrote the article. Draw your own conclusions.

In reality,they couldn't care less about what an actor does behind camera. When something gets enough traction that can make them look bad if they keep working with that actor. What’s a pathetic about attorneys in the whole court process is they try to squeeze human experiences into a rigid table of black and white “yes or no” answers and they try to ignore the context. Which by the way makes absolutely no sense when you’re trying to piece a story together and find the truth. I’m sorry but I really have no respect for attorneys that operate this way. They lack so much intelligence and the fact that courts consider this line of questioning as a means towards justice is pathetic. Our justice system lacks so much real process and it’s run by complete and total clowns.

That's her job. None of the lawyer has done anything out of line that needed to be thrown out of court. She can only intervene if a side object another side's questions. She cannot ban a lawyer from asking questions based on his or her previous nonsensical ones assuming the next will be just as ridiculous. That would be speculation.

He is. He's trying to use known publications as 'evidence' of something, and then asking the opinion of an expert. He's left it to the subjectivity of opinion, rather than sticking to fact. What he's trying to do, is a timeline of a sort of 'self-destruct of persona' rather than the actual implied libel and slander that JD was subjected to. He's trying to lay snares, but he's falling into them, himself. DUR-DUR-DUR...lol

IF a statement is on record - either by video or audio recording, or in print - then it is possible to use it as evidence, regardless of how outrageous it is. If a statement is NOT on record, there is no way to prove or disprove its veracity. Edit: slander IS actionable, but the laws are pretty specific regarding how evidence/testimony is handled.

majority of people use a substance (alcohol or drugs same thing) day to day consistently. Whether or not you believe you're of mind to "work" is completely down to the individual. Personally i draw the line at physical danger, so i wont get in a car or use a knife (chefing) under any influence. I'll happily sit in a booth selling tickets to randoms high of my face. Substance abuse has a correlation with being abusive, theres a beer called Stella Artois nicknamed wife beater because of it. However (big however) there's a serious case of individualism here because give me a few pints of stella and ill be a bubbly happy idiot, hand it to one of my mates completely different story.

My partner of 30 years was drinking and going home late after work when with his first wife. She was quite like Amber. He stopped cold turkey even though he thought he was an alcoholic. Then he left his wife. He drank no alcohol for about 20 years. About 10 years ago I said “you could have a drink sometimes if you felt like it, you’d be fine”. For the past 10 years he has red wine with dinner occasionally and he IS fine. I feel sad for Johnny and it has been shown that he was okay with the other two women in his life.

There's only one side in any argument that doesn't want witnesses to say everything they believe is relevant in the most straightforward way possible. If you think their testimony helps your argument, you want them to say it in a way the jury will understand and to clarify any points that may be misunderstood. Alternatively, if you believe their testimony undermines your case then your only hope is to try to twist it without letting them clarify anything.

Why, oh why are the defense lawyers constantly trying to prove that JD drinks excessively? What would be amazing and really embarrass the defense would be for JD to have his lawyers recall him to the stand, ask a few bullshit questions which they have the right to do, be in his drunken character mode which he can do without a single drop of booze/liquor, seemingly being drunk, and when the defense on cross examination attacks/claims that JD is drunk while in court, JD drops out of character to being his sober self and have his legal team (before all of this goes down) subpoena an expert, not a cop, on breathalyzer testing to do an actual live in the courtroom active test on JD, which would give a reading a 0.00 proving that JD can appear drunk which would bring into question and cast serious doubt that any "evidence/statement" that was placed in court records, can with100% certainty be legal evidence, or just fabrication, on the very fact that JD was only showing off his acting character in front of friends and colleagues, just to prove that JD can pretend to be drunk yet not be legally drunk at the same time, or having had any alcoholic beverage whatsoever, on a whim in public, or on a movie set! That would force the defense to stop with the argument that JD is a problematic alcoholic, which at this time is half of the defense councils claims! Anyone else agree? Respect to JD!

As a brit, this witness's opinion of the Sun "newspaper" is bang on the money. From my pov, the Sun is no better than the US's National Enquirer. They are so much of a joke that quite a few major football (that's soccer for the Americans) clubs here, including Liverpool FC, have signs on the enterences stating that the Sun's "journelists" are banned from entering the grounds.

She has a contract and depending on the stipulations of it pre dating this trial they may not be able to do much. But the movie may suffer once it hits theaters which means she'll be known as an actress that sinks films. So, whatever career she may have had is pretty much over.

That’s why we the public need to make sure they make no money off this movie, if ppl just stick to their guns and even though they want to see it and not punish the other actors who worked in the film, it will show Hollywood we won’t tolerate this one sided shit when the real victim hasn’t worked and was cut from everything except a few things while the abuser gets to stay in a movie. What do they think ppl will show up and just not watch her ten minutes? I think what they’re going to do is have 5 minutes in the beginning and then again at the end thinking their playing ppl who believe if they show her in the first half they won’t have to see her the rest of the time. I guaranteed other ppl in it want us to boycott the shit and amber, they just can’t speak on that. But the minute their contracts are up they will.

We also need to boycott advertisers who advertise on media sites that are spinning negative headlines and lies about Johnny and favoring amber. I think the reason they’re doing this is bc they also wrote lies about Johnny over the abuse allegations and their trying to win the public over in ambers defense hoping we will see her as the victim. No matter what they say or do it’s to late everyone heard those tapes and never once was Johnny physically abusing her, he was trying to get away. We heard her admit to hitting him. She comes off as a liar on the stand, she can’t even act, everyone sees right through it, now we know why she got parts in movies b4 Johnny married her.

I have thought this too. He asks questions like he's just ticking boxes and not really even listening to the answer, but the second the witness responds, he jumps on the answer (starts asking his next question) before the witness gets his last syllable out. He's such a boob.

How is quoting news articles not hearsay? I mean the reporters have no obligation to prove their speculations. A small news outlet can literally wrote anything without repercussions.

Quoting a news article is not hearsay because the article is on record - anyone can check whether it actually exists, and if it actually said what the witness claims it said. Further, unless they are editorializing or merely giving opinion, reporters definitely have an obligation to prove what they report, unless they want to face charges of libel. (That's a pretty simplistic explanation - the laws regarding slander, libel, and defamation are numerous.)

Technically, it's not hearsay, but only because of why the articles are being presented. They're not being presented as fact, merely as reputational examples. Basically, Heard's team is trying to convince the jury that those articles were proof that Johnny's reputation was already trashed before Amber's article was posted. It doesn't work, though, because the expert witness (as well as anyone with more than 50 brain cells) knows that tabloids aren't worth the paper they're printed on. Hollywood doesn't listen to tabloids. Hollywood also doesn't care if an actor uses drugs or drinks heavily. TL;DR The articles aren't considered hearsay because they aren't being used to prove Johnny's deeds.

I loved this guy. He’s right! Who wouldn’t want a film to flop and gross 800 million. Sounds good to me. His point was since the ME TOO movement Hollywood will not tolerate any type of abuse towards Women. However, behavior such as being tardy, partying, doing drugs, and alcohol, arguing with individuals of the same sex is just considered DIVA/Artist behavior and is tolerated.
