Johnny actually stated at the beginning of this trial that he was the first to start recording their fights. Because Amber would argue the next day that she did not say whatever he claimed she said. She kept lying or saying she did not remember. So he told her he is gonna start recording it to play it back to her to remind her of what she said. He always told her when he was going to record their fight to have her permission. Then she started to record it as well without telling him.

@@murasakinomorado7210 depends on the state’s laws. Here in Arizona, only one person has to be aware that the call is being recorded. Amber’s use of the recordings proved to be Johnny’s very best evidence, and considering the unrivaled value those recordings normally provide and the unbiased information they provide (assuming they’re not edited) they should be legally allowed in every state in the country, imho. But I’m speaking from a civil case standpoint. Criminal cases I’m less convinced the tool would be used honorably and not lead to Patriot Act-like consequences like violations of everyone’s privacy just to arrest the few.

I went through DV and the last thing on my mind at those very hard moments, the last thing I thought of was to record them. I had an ex who would scream at me and push me but then when I made a point, he would walk away and I would follow because I was so enraged at him that I felt the right to have my say. When I told my therapist about that argument, she got really upset with me and said that was controlling behavior and I needed to stop it immediately. I asked her to explain what she meant and she said that if a person chooses to walk away from a heated argument, they have that right, ESPECIALLY if there's a real imminent threat of physical violence. She said it can always be given 5 or even 30 minutes for both parties to cool off and try talking again. When one person is dead set on being right (me in my anecdote,) there IS no reconciliation. Thankfully, I have learned to do better now.

The problem with audio, especially when only one party knows something is recording, is it makes it quite easy to paint a narrative. We don't know whats actually happening in these recordings. Like when she's says, "Get off me" we don't know if he's actually doing anything to her or that's just her trying to be manipulative. The fact that she's has so many recordings shows some level or planning, but not enough for video? Just seems kind of sketchy.

I feel like a major reason he doesn’t do anything to deny her claims in those recordings when she makes them - aside from knowing that if he disagrees with her she will absolutely not stop until she wears him down - is that she does speak very theatrically and I feel it’s completely reasonable to assume that she was speaking metaphorically. Sort of like claiming that someone hit you where it hurt or kicked you while you were down. You don’t mean their foot physically contacted your body, you mean they said something that hurt you when you were already upset. I feel like that’s how she was framing it during the argument, but the small snippet they decide to play for the court doesn’t give any of that context.

Yes if there were really beatings from JD at least she captured even 1 of them from her numerous recordings but there’s 0 beating incidence! all JD did was tried to walked away from her to not escalate the fights she started all the time!

I'm sorry Johnny that you had to go through this. My son once had a girlfriend that played games with him, cheated on him, beat him, and tried to make people believe that he was the bad guy. One of the guys she was cheating with was one of my son's friends. She ran off with him, the cheated on him with someone else. She was an evil witch and thank God she is out of my son's life.

In the one the lawyer tries to claim you can hear her saying "get off me" it sounds far more like she is going for him and he is desperately trying to escape. His "I'll come back later" is full of panic

That is another desperate situation which I would describe as/ say he sounds like he is stating emphatically that he will be back later ( reassuring her ) and being very clear to her with his actions and words , that he has to get out of there ; because it’s another circular argument where they get nowhere.
