JS is released by the police after his initial booking not because the police want to 'observe his behavior', it's the normal legal procedure here in Korea. He's released until his arraignment, the equivalent of being 'released on bail' as in the US, particularly since the crimes he's being charged for are non-violent crimes. You can't detain a person by force against their will if they haven't committed a crime, and at this point, JS is only accused of committing a crime(s). That's what a court 'trial' is for, to determine if one has committed a crime, and if they're convicted then they're sent to prison. Until then, everyone is 'presumed innocent until proven guilty', so you can't just keep someone locked up.

What people don't understand the US is not legally obligated to represent you in a situation when you have been charged under another countries legal system . The only thing they are legally required to do is provide notification support to the prisoner's family in regard to the status of the case legal representation is not provided you have representation is from the country in which you have been charged. Yes. Most Americans don't realize how other countries value civility (and enforce it.). Even in Thailand, people rarely get in a loud argument. Even after an auto accident, the two people will discuss the incident for 'hours'. If one were to raise his voice he would "lose face". However, that said, if they "snap", their version of self-defense is very quick, brutal, and decisive. Their prisons have brutal conditions. (Prison conditions in Cambodia are also brutal.) I imagine South Korea is similar.

I went to the Korean DMZ like 10 years ago. First of all you needed to provide a copy of your passport 2 months in advance and then when you finally go you have to go with a recognized tour company and on the way there you're stopped twice by military police and all tourists are checked with ID before let in. You can't just walk in there. It may have changed since I was there but probably not made easier.

It would be interesting to track down some of the children appearing in Somali's TicTok post and ask them if their cries of delight were in support of him / his actions, or whether they were simply excited to get a selfie with someone so widely recognised, and a chance they too might get a short moment in the spotlight when the footage got posted. Also, just occurred to me, the US Embassy is technically US soil, isn't it? If so, each time Somali goes into the embassy then he has left SK. When he comes back out, there should be some sort of additional charge for breaching his bail conditions.

Difference between a privately aquired lawyer and a public defender really comes down to one thing. Time: The private lawyer spends all his time focusing on your case and only your case in the time frame you pay for The public defender can very well be part of several different cases at once and by that they will not have all the time in the world for you or be able to achieve as high of a standard as a privately hired lawyer.

This whole incident with "johnny" is sad,, meaning that he didn't have the capability to understand his conduct would, sooner or later, come to bit him in the ass. To think he did this in other nations with the result being he had to leave before the justice could be started. It would have been more compassionate to had down justice the very first time he acted out with his brand of disrespect in an attempt to create income via the internet. The act of a "slap on the wrist" by officials just created a mindset of a "Game" in his mind. At this point with the world looking on, the Justice System must make an example of this case to stop copy-cat attempts in Korea and in other nations that finds this kind of disrespect unacceptable, plus I hope the Court system/Government move to write legislation to hold the platforms airing this brand of nonsense liable as well.

That is why South Korea needs drop the hammer on him and set the precedent and not be lenient. If SK lets him go, others will see that and copy it because they think they will get away with it too. SK is letting him roam around on his own dime while they investigate, and if they do throw him away in jail for a few years, this would be a great way to deter this

In my country public defenders are a rotation of ALL lawyers to take turns as a public defender; It is called Legal Aid and it’s a requirement. So they DO get quality lawyers.

Just a question. Could someone close to the presidency try to influence the trial to give an exemplary sentence without considering the normal penalties. Like 30 years in prison without parole or more, so to not lose face and send a dissuasive message to anyone who would try to imitate this idiot?
