I have seen so many clips where this judge is clearly in the wrong, and the comments are filled with “yas, queen!” Anyone who practices law can see that this judge’s behavior is out of line and shouldn’t be commended. I feel like it should be obvious to everyone, but the comments have shown that most laypeople view trials as entertainment and have no understanding of our judicial system.

For those that don’t understand what the defense did wrong, watch the video Steve Lehto did on it. Basically they acted like they were gonna have 40 witnesses, which would have taken weeks to get through. Instead, they then abruptly rest their case and the state - who expected to not call their witnesses for a long time and did not bring them to court that day, could not and were ready. Not their fault. Just some type of scheme played by the defense. And the judge called them out on it

The prosecution calls their witnesses BEFORE the defence. After the defence rests the prosecution can bring in any rebuttal witnesses and if there aren’t any it goes straight to closing arguments. The defence acted in the best interest of their client. This judge was unprofessional and showed outright contempt for the defence. It was bizarre to see her argue with the defence. She appeared argumentative, unprofessional and overwhelmed with the requirements of her position. It is up to the defence whether or not to decide to rest. They decided to do it early. This judge should have asked about the status of witnesses well before then to ensure that court scheduling was progressing. She failed to do that.

I'm a court reporter. This is INSANE. Never see this kind of disrespect from attorneys towards a judge. I'm wondering it's got to be because she's young, pretty, and a woman. It seems like a lot of the attorneys have a problem taking orders from someone younger than them. Male judges are never, absolutely never treated like this.

I don’t usually support the claims that women get less respect than men. I think, as a woman, we need to assert ourselves and set clear and concise boundaries. It does happen, but my approach is to blatantly ignore it and have zero tolerance for it. I also show others the same respect I am demanding. This is not one of those times. I do not believe the defense’s behavior would have been like this if the judge was a man. The total lack of respect and professionalism was mind blowing. This judge should be praised for the way she kept the trial on track, despite numerous attempts by the defense to derail it. These attorneys are utter garbage, as lawyers and as people.

This isn’t chess meaning you can tell me the next witness as it won’t effect their next move. As in chess you can’t tell ur appointments anything, or well shouldn’t. Then the state person in charge for “22 years” starts rudely arguing with a judge that outranks her entirely.

The defense wasted everyone’s time, and there was no reason for them to play coy about their decision to rest. Jurors were called away from their jobs (and probably aren’t getting paid more than a couple bucks to be there), and the defense couldn’t give the Court advanced notice of their decision to cut their witness list by greater than half to avoid that? I understand the Court’s frustration here; it was very unprofessional.

@@hp2474 Yes, but if they called 40 more witnesses that's not "wasted" time, that is what they are there for. This was an unnecessary delay and a complete waste of taxpayer dollars, the time of the hundreds of people that make that proceeding happen every day, and a day longer that everyone invested in this trial has to unnecessarily wait for closure. Furthermore, I think part of their idea was to embarrass the state by making them look unprepared (which I think was part of what the chess reference was referring to), but the judge rightly called them out on that. So this was disrespectful, costly, and just generally scummy lawyering.

I don’t think they expected the judge to force the State to immediately start closing arguments after they rested. This is just my opinion, but it seems the judge is furious that the defense didn’t extend her and the prosecution a common courtesy. Usually if one side closes early they will let the other parties know outside of the courtroom so that it isn’t a shocker. Also just my opinion, but I think the judge has taken all of the calls for a mistrial as a personal affront to her abilities when it’s just a common strategy in DP cases.

I would add that the defense attorney who was assigned to tell the Court about this (poorly thought out) decision sounded personally unsure of this strategy & in presenting it to the Court, sounded as uncommitted as possible. This strategy showed poor thinking and decision making on the part of the defense. For me, the Smell Test in this situation involves asking yourself if you would want this defense team representing you in court. My answer is a resounding No.

@@hp2474 I have a lot on that, sorry. First, more money spent isn't the equivalent of it being wasted. Wasted is unnecessary spending, it was unnecessary to waste the time and effort of these hundreds of people just to rest their case before the day even starts, but had the witnesses been called then that is not a waste because the court is doing its function. This prevents the court from doing its function for an entire day; even if the prosecution would never have been ready, other hearings could have taken place rather than having nothing else scheduled that day, so you are wrong, this was a huge affront to judicial economy. Second, it does delay closure, it delays it a day longer then it would have been had they done their job and informed the court and prosecution ahead of time of their intention to rest, so they could have proceeded with the trial on this day rather than having to cancel everything for the day. Third, I do not know if you have been watching this trial, but there have been times where the defense has been intentionally contemptuous of the judge's rulings and acted disrespectfully and in a childlike manner to protest her rulings. For example, there was one point during this trial where the defense objected to certain witnesses all being allowed to testify on the grounds that it was cumulative evidence, which is a valid objection that the judge overruled. First, let me tell you what should have been done. Every time a new allegedly cumulative witness comes up, you say, "I renew my objection, your honor." That's it. The defense instead objected by saying, and argued with the judge when she ordered them to stop doing this because it was unnecessary and she had already ruled on their objection, something in the manner of, "I object to this witnesses testimony on the grounds that it is cumulative because it is cumulative with the testimony of A, B, C, D, E, F, G, H, I, J, K, ..." and the defense would proceed to add a new witness name to the list, lengthening the objection, every time a new witness was called and then proceed to reargue their already overruled objection every time the state added a new witness, something every seasoned lawyer knows is unnecessary to preserve an objection. They clearly did this for the sole purpose of delaying the proceeding and childishly showing contempt for the judge's ruling. That's just one example of their unprofessional and childlike behavior.

I'm from the UK so I probably don't understand the legal system in the USA, but the sort of behaviour I've seen in this court would never be tolerated in a UK criminal court. And then on July 28, 2023 the Florida Supreme Court disagreed with every commentator posting here and ordered this judge to be publicly reprimanded for her poor judicial demeanor in this case. The judge, seeing what was coming, resigned before the ruling but the Supreme Court ordered the reprimand to proceed anyways.

This will form the basis of grounds for a retrial. The judge even states that she’s never experienced such unprofessionalism as she’s seen by the defense. If her statement is accurate, as it should be as it’s made by a judge during a trial, then Cruz has all the evidence he needs to claim his defense was incompetent. If his defense is deemed to have been competent then the judge must not be as proven by making such a statement .

No one is saying that what they are doing is right or good. We are saying that it is effective. Her lack of judicial maturity to see that they are playing her in order to garner a retrial is hard to watch. Defense wins in the appeal. That's not a good result for anyone and the judges approach has brought it on.

No matter how she is treated as a judge she should maintain dignity and decorum and should stay calm and professional at all times. Go look at how the judge behaved in the Ted Bundy case. She is obviously emotionally affected by the case and should have been taken off it.

Obviously she didn't have the right to demean the defense because she got in trouble and they didn't. She can never be a judge again but luckily her daddy could get her a job. That's the facts.

It’s a fact. They may have won the case by remember they only one because 2 jurors didn’t want the death penalty even though the majority did. The minority vote was allowed to override the majority vote in this case. That’s why they won. That’s another fact.

The defense was found to be completely professional and the judge was sanctioned for being unprofessional. If the prosecution had won the case, it would have been overturned by an upper court. I feel like the lawyers acted disrespectfully intentionally. They were defending a very clearly guilty client. In order to make sure the client can appeal, to give their client some pity points for having stupid lawyers, by focusing the judge/jury/court's attention on the lawyers and not on the client, and give themselves as much time as possible by being disruptive, they might be able to lower their clients sentence by distracting from the depth of the atrocities committed by the client. They are playing a long and dirty game here.

it's the judge who is at fault. she has been bias, prejudice, rude and unfair since the start. All I see is frustration on the defence side because the judge rulings are not fair. She isnt letting the defence lawyers do their job properly. She is constantly rejecting all, even valid objections from defence. while allowing every evidence or motion no matter how absurd it is in law. the defence at this point has simply given up because there is no point to be there when the judge is so openly bias and one sided. Also this judge doesn't realise that a death sentence is actually a win for Cruz. he never wanted to live. that's the part of his plan. he is a snowflake who cover ears while listening to 911 calls from his victims. he want this death sentence because its the easy escape for him. his true punishment would be to live in prison. rott in ADX Florence with nothing but his thoughts and himself for rest of his life with no escape from himself.
