I feel bad for him. He’s clearly a young attorney comparatively and has no senior council with him. This is a high profile case, and he was hired very late and is trying to make up for the lost time. He’s so flustered and has to try to keep it together and help his client even though they he had inadequate time to file. As a legal assistant, I can attest to the time it takes for documents to move through the courts for filing. I feel for him.

I have nightmares like this. Except I’m back in High School or College. It’s usually either a dance recital and I have no idea what to do once I’m on stage. @@robertmoody1615 Well..."non-lawyer" I would not characterize it as "great" but he did what he had to do for his client...and 13 minutes into watching her testimony I can see the situation he faced was not simple. If in fact his incarcerated, possibly drugged up client, who he may have been involuntarily appointed to represent, did indeed not inform him of the totality of her situation he could easily be behind the eightball on knowing all her court dates and what specifically she would be testifying about. Would that surprise you that a Florida courts appointed attorney might have so many indigent clients that having a new one sprung on him might slip through the cracks in the system that has seen MANY innocent people convicted only to be later exonerated because details were missed in the legal proceedings?

This trial is to determine if he’s getting life in prison or death. The state is trying to pass the death penalty and Cruz is fighting for life in prison, hence the trial.

I’m not a lawyer but upon watching this, it appears that in Miami there were concerns raised about the sisters competency to stand court. She is a witness in this trial so the lawyer is now claiming she is incompetent to serve as a witness. It seems like they tried going about it in a shady manner by filing it on a Friday in attempt to squeeze it in and rush it through. Judge wasn’t having that.

Basically the dude lawyer said the sister of the dude murderer shouldn't have to testify because she had 5th amendment rights , The judge said if she wants invoke her 5th amendment she can do it in court while being grilled by the prosecuting atty. Dude lawyer knew the judge would toss it but he made a play anyway because it got him on natl news and got his name out there as a lawyer who will do whatever it takes for his client. Currently sister has been claimed incompetent in her own criminal cases and why he filed this motion to protect. In reality if already Florida criminal courts to be claimed incompetent to stand trial, she would not be eligible by law to give testimony that is considered truth of the matter for any other court proceeding. Meaning this judge needs mental health records with that protection order which he did not provide.

This judge has been wonderful, standing firm on all issues. I don’t know how she does it! We need more judges like her! It’s ridiculous why we have to torture the families affected by this criminal, he’s admitted to the killings, we’ve seen him on video , witnesses that saw him that day kill testified. Why must we go through all this for some worthless human being that has 5-6 lawyers for what? Just put him in prison for life without parole. And end this torture! Plus all the money being spent on the trial and the expense the school has spent to recover!!!!!!!!!!!

@lisacapuletco: The judge referred to the witness subpoena document as vague, not the lawyer’s motion which appears to have been derived from a poorly worded or ambiguous subpoena from another lawyer. This lawyer was trying to protect the rights of his client.

I would not characterize it as "great" but he did what he had to do for his client...and 13 minutes into watching her testimony I can see the situation he faced was not simple. If in fact his incarcerated, possibly drugged up client, who he may have been involuntarily appointed to represent, did indeed not inform him of the totality of her situation he could easily be behind the eightball on knowing all her court dates and what specifically she would be testifying about. Would that surprise you that a Florida courts appointed attorney might have so many indigent clients that having a new one sprung on him might slip through the cracks in the system that has seen MANY innocent people convicted only to be later exonerated because details were missed in the legal proceedings?

Doesn't the 5th amendment only apply to incriminating yourself? If you are a witness, you have to answer the questions if a judge says you do on anything unless you would incriminate yourself by doing so.
