sounds just like the red flag laws someone makes a "claim" They go to court behind your back and then you lose your weapons without even having a chance to defend yourself in court.

a 2nd committee is "appointed" by the 1st committee to investigate the 1st, HOLY SHIITE, what could go wrong with that? Like asking the biggest bully in school to set up a group to investigate the bullies in the school and he gets to pick the people he wants to investigate the claims.

Any attorney that can't tell from the Judge's line of questioning....where this is going....is completely up her own rear end....with no self awareness at all....or I guess that describes most attorneys for the "state".

She's arguing, *_"That's the way it is, and the system set in place works."_* That is her position. To her, it doesn't matter about the judge's line of questioning or how he "feels" about it; she's sticking with the facts as they are. ... You can't expect he to change her battle strategy mid-hearing just because she's run into some opposition.

If it was dismissed for lack of jurisdiction, it was filed with the clerk of the wrong court. Was the petition filed according to the Administrative Procedure Act of the state where this occurred? I see each state should have their own version of the act. My assumption is that this would go before an Offfice of Administrative Hearings or similar since these are administrative officers. *Correction: I listened again and realized the dismissal was due to the attorney’s assertion that the APA didn’t apply in this case. I haven’t read the APA to see why, but I suppose the plaintiff can appeal this dismissal if they still don’t agree. It wasn’t an issue of filing with the wrong court. I get that people in power do dirt, but a lot of the time we don’t get the results we’re looking for because we don’t follow proper procedure and they can’t tell us what the proper procedure is because that constitutes giving legal advice. READ CAREFULLY. I’m not saying this person didn’t follow procedure since I don’t have all of the facts, but I get annoyed when people automatically respond with “the system is corrupt” and give up without considering the possibility that they did something wrong. That type of sentiment is prevalent in the comments of videos like these. The system is the way it is mostly because the People are the way they are. Be the change you want to see in the world!

Taken at face value, her argument serves to render the ethics commission as nothing more than a "complaints dept" box where people can file their grievances but not really have any expectation of any just outcome. Try another example, counselor... "Mr. X, thank you for coming today. We have heard your complaint. Have a nice day." "Aren't you going to rule on it?" "Oh, no. We've decided that's not our role. We're just here so that we can say you had the opportunity to complain. Now that you have complained, the process is complete, and there's nothing you can do about it. We are the first, last, and only step in the process." That's her argument. The commission is omnipotent and not subject to oversight. Sounds like a typical governmental position.

What is Not even brought up yet is that The Constitution Is THE LAW, By Which ALL COLOR OF LAW (statute, ordinance, regulation, Code or custom) Can Be Ratified (Established). this is a good example of Administrative law in action where the government agency makes laws without Legislative authority, adjudicates agency law without Judicial authority, and enforces agency law without Executive authority all in violation of the "separation of powers"....

I'm in Washington setting up an agency that cannot be appealed to court would be a due process violation as it could set you up to loose in court because they wrongful ruled against you and then used it against you in court when you sued yet you cannot have it ruled incorrect.

Washington has 4 branches of government we have an erected administrative branch in most areas the governors do appoint some but we didn't want corruption so we vote in most positions even the clerk of the court

Speaking of ethics, I thought we were all free Americans and any law enforcement or any government worker has swore an oath to the constitution. I’m not sure why these people are trying so hard to take away the freedoms of an American when they swore to uphold such freedoms, any patriot who sworn us to the Constitution would be disgusted and would try everything not to take away the freedoms of an American While still doing their duty if you have to you have to it’s just like when you watch a game and there’s some referees that pick it everything to make the team lose and there are other referees that overlook stuff but we are all on the same team there’s no reason to try to go out of your way to put someone in jeopardyso what is the motivation? Oh yeah, it’s money. You in trouble equals money and there’s the bias.

To be clear, due process means following the rules that have been created for a given procedure. If there is no appeal procedure written in the rules, you can’t appeal. If there is a need for an appeal procedure, a request should be made to the governing body according to its procedures to do so. The governing body could be the legislature or an Administrative Committee. In this case there is no appeal process, but the petitioner filed a petition for administrative review because the person(s) that handled his complaints used a stricter review process from what administrative policy called for. They probably have a good chance of getting the complaints looked at again if they get this in the right court.

If a rule is not written, there is no rule that must be followed. You can’t say not allowing an appeal is a due process violation if there is no appeal process in the rules.
