1st case: If you are seeking counseling from anyone, regardless of their credentials, you expect complete confidentiality. If the Defendant was being paid, there was definitely an expectation of privacy and she should have been held to that standard. No matter how she felt about wiccans or any other philosophy, the Defendant overstepped her boundaries. The loss of her daughter screwed up the Plaintiff, but the Defendant made things worse.

Councillors/psychologists/psychiatrists, etc are supposed to contact “authorities” or CPS if they feel there is a threat to their client, their family, their children or any person. She had no right to go to that house at all. It was none of her business whatsoever to personalize the situation. She did however, have the right to call authorities which she did not. Bad judgment call.

I think the client and therapist had a very loose client/ therapist relationship and crossed Boundaries . The therapist mentioned something that angered the Client and the Client didn’t have to search far for client privilege break down. To me they were both equally GUILTY.

The first case you don't divulge counseling sessions to others it's hippa. If she needs her license taken. She is supposed to have a non personal sessions. You don't go the house, and you don't shove your way into their home. The plaintiff should have called the police to remove her from the property. The defendent seems off going calling relatives to discuss her religious changes. The young man should have been able to describe the assault.

It's NOT HIPPA but it is a breach of ethics. HIPPA has to do with electronic or printed/written health care records and the responsibility of the provider to maintain their confidentiality when being shared with other providers. Try reading about it.
