If you read Justice Thomas's concurring opinion in the immunity case, he so much as signals that this issue is ripe for appeal and ultimately the Supreme Court decision. My personal feeling is that the special counsel with its special powers and unlimited budget need some rules. This is the domain of the legislative branch as was previously set forth in the special counsel law and the Constitution.

This will get appealed and most likely overturned at the appellate level. It will then either go to the supreme Court or get kicked back down to the lower court most likely with a different judge overseeing the case. If anything it's just another handout delay by Cannon, however, if it goes to the Supreme Court Thomas has already written his opinion (and gave Cannon the roadmap for what she did) so at least one judge seems to think that Special Prosecutors are not constitutional. Honestly, this who thing stinks like corruption, cronism, and political pandering....

Jack Smith is already ahead of Cannon with his July 12th filling, telling the judge that Thomas was wrong in his opinion. Now the case can move forward to appeals as it should have months ago.

And should it be appealed (11th circuit) and overturned, you can well imagine an emergency appeal to SCOTUS. Emergency appeals are handled by the Supreme Court justice assigned to the the circuit. In this case, for the 11th circuit, that would be Clarence Thomas.
