For everyone that is not understanding the process, here it is. 1. The individual for the position of Special Counsel is recommended by the POTUS (Smith has never been recommended by Biden or any other former POTUS) 2. The individual is then vetted and confirmed by Congress (Smith was never vetted nor confirmed by any sitting of Congress for employment as a prosecutor in the United States, and is therefore a private citizen) As Judge Thomas clearly pointed out, a private citizen has no authority to prosecute any one, let alone a former POTUS and the front runner in the next election. Since this ruling only pertains to the Florida documents case, Judge Chutkan, who is presiding over the J6 case brought by Smith against President Trump, should agree with this ruling and dismiss the J6 case as well. Some people are questioning the appointments of other Special Counsels but to date Smith is the only one that was never recommended by a POTUS or vetted and confirmed by Congress which makes AG Garland's appointment of him as Special Counsel illegal. All the others had been and could therefore be legally appointed by the AG.
