Everyone hates lawyers until they need one. However, this attorney knew darn well that even though the actual wording of the Order may have given the basis for the extra garnishment, he knew it was wrong and did it any way. He should have called the Judge's clerk to clarify. There were many times when we asked for an amended Order for clarification, just based on a particular word needing to be added or deleted. This is not an uncommon practice. I would definitely categorize that attorney as being unethical, and unkind. Making them pay to send their payment by Certified Mail instead of hand delivering and giving them a receipt, is just spiteful.

Normally when it's discovered more was taken than should be, the additional amount taken, will be returned. This can take several weeks to several months. When my wife's account was garnished illegally, our senator got involved and my wife's money was returned in days back into her account. What had happened to my wife, our provider failed to report a data breach, and my wife fell victim when a woman in another state, a state neither of us ever been to committed welfare fraud and used my wife's information to list her as a father to the fraudsters children, had our bank accounts frozen, and several thousand taken for that child support. After we were given the run around, our senator got involved and every penny taken was returned to us, plus accounts unfrozen. Woman who committed the fraud in the other state was arrested as well. Normally this could have taken months.

@gregoryk.9815 No such law. There are laws that restrict how much can be garnished, depending on what state they live in, like 30% of a weekly wage. Years ago a garnishment could be 100%, which despite the fact it took years for the government to learn that taking 100% would result in person losing home, Job, and result in off the books work that gained them nothing. There is no limit to how many garnishments that can be attached. Only how much they can take. Also the order of garnishments doesn't always reflect on which case won first. Again state law decides. Here is an example. Let's say Sears is the first to win a lawsuit that pays them back for home heating installation not paid for. A second lawsuit for 7 unpaid workers gets a judgement in its favor. Those workers will get paid a larger % than Sears, again not to go above 30%. Some states 40 or even 50%. Cost of living, children, decided those amounts.

@@jayschafer1760 Federal Law does not allow that to happen, unless you owe multiple (more than 1 debt) garnishment at the same time. Even if there are multiple levies on that 1 debt, it is illegal to be fired over it.

@@buggiebuild1 It's not always about failing to read the room, but about thinking they're right and have a case to push. If they can prove to the judge that the law supports what they've done/are doing, then it doesn't matter how upset the judge is, the judge has to accept that the law allows it. It's also sometimes about establishing on the record certain statements that can then be used in future cases/appeals. If you make a statement about a defendant in court, and they don't refute that statement, you can then reference that transcript when making an argument in the future. If they do refute it, you just don't mention that part later on. They're not always oblivious to the judge's ire, they just think they can profit from the situation either currently, or in the future.

Landlords throughout the US have started refusing to accept checks or money orders, demanding payment by credit card or prepaid cards and then charging a convenience fee of up to $75.00 per month for “accepting” the digital payments. By demanding payment by certified mail, they are adding to the costs. I’m sure Judge Simpson is aware of what is going on here. Now the landlord will have to wait for the court clerk to process the payment and forward it on. In the fullness of time. Mr. Mack done screwed up.

I had one that was a nightmare; despite the fact I never even laid eyes on her! She was my landlord and lived in California even though I live in NORTH CAROLINA! I never saw her once. But she certainly saw me. She was watching through surveillance and questioned me about who I had over, what I was doing it where i was going. She “required” that I deposit her rent into a personal Wells Fargo account at the end of each month. She gave us an account number and we were supposed to just walk in, give them that number and deposit it every month. (She refused a mailed check) Thing is, my local Wells Fargo HATED her. They said they’d no longer allow us to just deposit money into an account we didn’t own. When I told my landlord she said “They’ll accept it. You need to just refuse to leave until they do.” Thing is, if I stayed and kicked up enough of a fuss, they actually would take the money. It was so weird.

My rental company wanted to put a charge on my lease for an app to pay my rent via direct deposit. 3% credit card fee always, i understand that, that comes from the credit card companies. I got them to write it out of my lease. But no no no, I will send a check by certified mail OR drop at office. I refuse to PAY, to pay them.

That was so satisfying to see the judge be like fine if its an issue we will the care of it. Its so awful with scummy landlords doing everything to make it impossible to pay just so they can charge a late fee. I stopped using the website at !y last place because they gave me a payment confirmation but then never actually took the money. When I asked them to wave the late fee they said no and the only way to fight it was to take time to sue them. Screw it now I pay with a cashier check and put the receipts in my safe.

One of the great things about Judge Simpson is how he doesn't let his emotions from one case color the way he handles subsequent cases for the rest of his day. Some judges, once they get riled...woe betide anyone who has to come before them once they get their dander up...But not Judge Simpson. He lets the anger go..That's a good judge

Oh I hate slimy lawyers. I had to deal with one in 2015 when I was in housing court, and a slimy lawyer tried to pull some tricks and ended up getting the eviction case against us dismissed and we’re forced to refile, and gave us a whole year longer in our apartment and the judge told us not to pay a single penny in rent until all repairs were completed and a third party inspector passed it. They tried to get their own inspection and the judge threw that out too.

When I did collection work for clients, if the defendant was paying anything on a regular basis, we thanked the defendant and continued the case as long as they needed, as long as they were sincerely trying. You cannot get more money than the defendant has. I strongly suspect that this attorney has tried shady stuff before in Judge Simpson's court.

I have so much respect for Judge Simpson, he gives the same level of condemnation to court officers who break the rules as to people guilty of their crimes.

This case was a good catch. I like Judge Simpson, and always have. You can tell he's no nonsense. That Atty is not the brightest bulb in the box. I love it how the people now pay into court escrow.

Paying into the court is the BEST F U a tenant can give a landlord. The landlord has to wait for their money and they can't do anything about it except wait 😂

@@henrysmith180Probably not that much more inconvenient to go to court and lay there vs paying $15 or whatever at the post office for a certified letter, either. And once the court clerk gives you a receipt that they received your money, the other party can't argue that.

@jayschafer1760 I did that to my landlord. My rent was paid up to date, yet he still filed to evict me for non payment of rent. The form I received for the hearing said we could pay into court, so I did. He never asked me for rent until the day of the hearing. When he found out I was paying into court, he complained about how unfair that was. Seeing him bend out of shape like that was AWE SOME!!

In the military I had the authority to enter into contracts between the US and a business. Was a LT working long hours in Saudi and one of my business owners shows up and asked why he didn't get paid last month. Looked at my file and he should have been. Told him give me a day or so to figure it out. I finally when over to Finance and a Air Force technician told me that she stopped the payment for some reason. I yelled at her, wanted to drag her around the office. Her boss another officer shows up, I like that guy, I told her, That is my authority to make the decision, you had no right to stop the payment and cause harm to the vender. So, I know where the judge is coming from, his ruling is the plan and you don't mess with the judges' plan. Great video

Had I been that judge, I think I would have vacated the whole thing. All owed monies would have been nullified, and the garnishments/payment plans would have stopped. This was a case of a corrupt attorney literally trying to make them poor. That's inexcusable in my eyes.

There's only one other time I have ever seen judge Simpson this mad. And that one was also with another attorney. He had a client that did not show up for court and there was a warrant out for his arrest. He contacted his lawyer months later to turn himself in. The lawyer told him that he did not have to do that since there was a hearing on that case in 5 days. When the judge heard he went bonkers. He went from talking to yelling the whole time and even told the lawyer that at that point he was trying to decide if he should contact the bar and make out a formal request of a hearing on the lawyer's behavior. They hurried up and finished with the person that was involved in all this and then judge Simpson said that the court is at recess I need to take a break. The lawyer tried to apologize to judge Simpson and he told him I don't want to talk to you right at this moment. And and judge Simpson hurried up and went behind the door. I don't know what happened to that lawyer. He is an older man so he was not new at being a lawyer.

Oh boy, do I remember that like yesterday, reason being because Judge Simpson is always composed/caring, yet firm and fair, you expect it from a defendant, or a plaintiff, but not from attorneys, they need to teach them to read the room, do some homework on the judge u r about to stand in front of before you piss him off😂😂…✌🏻

There's a reason pro se litigants are treated differently than attorneys. Attorneys have no excuse as officers of the court. Most judges were also attorneys and they understand better than anyone else how a lawyer should act in court. They know all of the dirty tricks. So when Judge Simpson saw this lawyer was playing games it rightfully infuriated him...because if he played those games then he'd get the same treatment. Cases are lost due to these tactics.

if i recall correctly, in that case that didn't happen. the defendant was making weird comments, which the prosecutor overheard and repeated to the judge, to which the defense was just like, "yeah, whatever" because he wasn't completely prepared for court and came in with a bad attitude. once he spoke to the defendant and double checked his stuff, he came back and explained to the judge that he had been under the impression the defendant had seen judge simpson _that week_ as opposed to before his bond was revoked. i don't believe he actually committed a sanctionable offense, but he definitely was disrespectful of and not listening to the judge or the prosecutor.

Plantiff's attorney screwed over his client. Payment to court escrow means plaintiff will need to wait even longer to get the money - and the defendants do no wrong (since they are paying directly to the court, so payment is confirmed on the spot).
