The plaintiff is in the wrong court. She should have an attorney going after half of the estate (assuming there are no other heirs). The defendant has clear power of attorney to make decisions, but she can't cut the sister out of the proceeds if the mother died without a will. Even if the plaintiff wins, she'll get pennies compared what she should have received, and be barred from further actions.

@@neelampal4955 i applaud you, that's more then most people in my country have to show for but.........the laws in India are very different then in many other countries. the education needed to practice law in many countries like America, England and so on are greater then a lot of other countries.

If the defendant sold the house using POA then it was sold before her mother died. If both children inherited a portion of the house from their father the mother would not have been able to sell without them both signing off or in some states going to court to force a sale then giving them a portion of the money. The Mobile house was probably left entirely to the mother.

@@peacheskong2245He died. It's really not as bad as it seems. I joke about it because it sounds dark. My grandmother was 14 when my mom was born, and my mom was her 2nd. So the age difference wasn't a lot. My grandma married Bob when my mother was 40, and she passed within 10 years. The marriage between my mom and him was never romantic. He needed someone to take care of him, and she needed financial help. They slept in separate rooms and were simply good friends. It's just a somewhat shocking thing to say. Lol It did completely tear the family apart, though. That part sucked.

A notary fully explains what the document is to someone who is blind or sight impaired. The witnesses attest to it as well. You generally can't pull a switcheroo when notorizing something(as the Defendant suggested). There are STEEP punishments for the notary. It sounds like these sisters didn't get along for years. That is exactly when a mother needs to make sure there is some sort of will. A handwritten one, anything. It will have to go through probate(if it doesn't follow the states' guidelines). But 99 percent of the time, the courts follow the intended wishes of the deceased. Edit to add: After part 2, I think the Defendant did somehow get those papers notarized without the mother fully understanding what they were. The Defendant bought the house and put it SOLELY in her name.

Our laws state if no will it goes to next of kin after taxes taken. So since my siblings just screwed me on my mothers estate. I'm creating a will that ensures it takes care of me, and if anything left it goes to 2 charities, that way my bratty neices and nephews don't benefit nor siblings. So check your law before thinking it just auto goes to charity. I was surprised myself.

This is so wrong. When it comes right down to the nuts and bolts of life, your family is all you’ve got. Don’t mess that up because when you need help one day down the road, you won’t see your friends holding you up on the toilet, wiping your backside or spoon-feeding you mashed potatoes, cooked puréed ground beef and pudding. Your kids will be too busy with their jobs and their kids to help you day in and day out. But your sister or your brother (or both of them!) will be by your side. Keep that bond healthy and strong any way you can.
