Nip It in the Butt?

The plaintiff says she first met the defendant at a racetrack. She claims the defendant was naked and intoxicated, and then bit her when she tried to help. She’s suing for the assault and balance due on restitution. The defendant says she has since gotten sober. She admits to biting the plaintiff but denies being drunk and naked at the time.
