Order 1 rule 10 cpc is made for 3 rd party .. you said that pliantiff will intiate the said application . If plaintiff want to join 'C' then it will comes under order 6 rule 17 and if 'C' is not a party in a suit and valuable right is involve of ' C ' then C will file a application for 3 rd party under order 1 rule 10 cpc.. sir please correct it
