Case 1-if it’s a loan then how is he breaching by changing the business plan without asking?

because the judge made the money which was given to the deffendant as a gift and therefore they become partners in the buisness that is why she said to the defendant at the end if you have inventory from the business it basically belongs to the plaintiff which is his share. Because without the gift the defendant would have never started the business in the first place. Also the defendant breached because if the plaintiff is a partner which the defendant keeps saying, then he should have consulted the plaintiff when he decided to go online and sell, not go online and the business comes crashing down and then ask for advice.

The judge did not make the money as a gift she said the money wasn't investment therefore the plaintiff or a part owner and that's why she said if there was any inventory left that he should give it to the painter even if he doesn't want to because he was a part owner of the business and not a gift if it was a gift the defendant wouldn't have to give anything up
