One thing I have learned in this trial is that no one can spend more time more throughly proving things that aren't in controversy than Lally can. I now 100% believe that John and Karen went to the bar and then to 34 Fairview and it was snowing. So glad we FINALLY cleared that up
@DyslecticAttack
@DyslecticAttack 4 ай бұрын
To be entirely fair, it's worth proving this one in my opinion. Because ever since Jen and Kerrie testified, there was a possibility that Jen could be the sole source of Karen going to Fairview, and I don't trust Jen. I had no other theory, but there was an inkling of dispute there. So now the prosecution at least has something more than just Jen's words and disputed shards of taillight that Karen went to fairview.

The mitochondrial DNA from the hair is also consistent with John's niece and nephew. John and his sister have the same mDNA from their mother. John's sister passed that mDNA to both of her children, who now live with John. So, it doesn't tell us much at all.
@Shangori

Either way it doesn't say much. They were in a relationship. Chances are his dna was on the car to begin with. If that hair could withstand 60 miles of blizzard, who says it wasn't there before he allegedly was hit as well?

I really wonder if any of them are thinking "Can we go home now? I think we know what we need to." Because, unless the defendant is a warewolf with a magical car, there's nothing prosecution can say to convince me beyond a reasonable doubt. And defense hasn't even started their case yet!

@@DyslecticAttack They could have 4k video of KR turning into a werewolf and mauling John O'Keefe and I wouldn't vote guilty. There's literally no evidence that would make me vote KR guilty, because the prosecution has poisoned every bit of evidence that's on the record. I'm almost doubting that it really was snowing that night, since Lally said it. Lally is a shameless liar, incompetent and lacking human decency. If I were a juror on any case that he's involved in, I would immediately confess my bias- that there's no way at all that I would ever vote in support of his case.

I have my own "most likely" explanation as to what happened to John from the evidence so far. It's different to either prosecution or defense theory of the case, and I'm angry because the investigation was so botched we will never ever know for sure. Anyway, my theory for anyone interested goes as follows. Karen dropped John off at 34 Fairview, he entered the home, some sort of heated exchange happened between John and someone at the house and the dog grabbed his arm causing him to fall (could have been a verbal argument cause GSDs can become very protective even just because of raised voices) and he hits his head pretty badly. John then gets up and leaves the house but collapses in the garden. The dodgy butt dials etc are the Brians wondering what will happen with the dog if John decides to take action about it. The following morning Karen is stressed because she knows there is no reason John wouldnt be home unless he's been hurt, she thought his blood was her own period, thats how much sense she was making so even if she did say she hit him I don't think it means anything. The Alberts then find out John died on the lawn and Brian knows, if they admit he entered the home that places them as the last to see him alive, if they say he never entered the home that places Karen as the last to see him alive. As for things like the shoe being off, maybe that happened in the house and he carried it out rather than putting it back on. With that type of head injury people can act weird. He could have even been so disoriented that he keft with both shoes on, couldnt work out how to use his phone, sat down in the snow and took his hat and shoe off when hypothermia started setting in but passed out from the head injury before he removed any other clothing (feeling too hot is a known symptom of hypothermia and it's well documented for people to undress). The tail light most likely was Proctor making sure the homeowner wouldnt catch any "shit".
@GenuineUntelligence
@GenuineUntelligence 4 ай бұрын
Perhaps Karen and John did argue in the car about the Higgins sexting and he threw the glass at the car after getting out, breaking both her tail light and the glass, that would also explain how an argument happened when he entered the house.
@valb3094
@valb3094 4 ай бұрын
I have a similar theory regarding the injury and the fact that the Alberts panicked. Then Karen not remembering the previous night gave them a way out without much effort. I think they agreed to keep their testimonies on « John never entered the house » without getting in any details. It may have been an accident and if John would have had proper medical care he could have survived. Regardless of what happened, it’s a very sad story. The bright side would be uncovering how unprofessional the police officers can be.

In any investigation you folliw the simplest possibility As Well as witness statements. The statememts take a backseat, though, because guilty people lie and memories aren't perfect. Especially memories that are effected by an ingested substance &/or possibly corrupted by discussions with others. That's why we seaprate/isolate witness. We need the freshest and cleanest memories of the witnesses. Once they talk to each other there's more and more grains of doubt added to their recall by us. Unless, of course, someone is trying to force a specific finding.

Watching today with EDB, I think she misheard some of this. Some of the unknown DNA was too small to match to another, but some they said was of unknown males because they didn’t have anything to compare it to. If they had the 2 Brians and Colin to compare it to, they could have because there was a large enough sample to compare to the Troopers. She either misspoke or misheard. I did hear in another recap that when Tully says he gets the time wing he fails to say that Lucky told them prior the time might not be correct. With 10 women on the jury, this won’t be a ’wow’ moment, it will only sound ridiculous. Like did you hear this clown, testifying to being a Yeti? But besides this...Tully wasn’t the most stupid witness we have heard already. To his credit he was one of the most prepared of all, did display some intelligence... Which begs the question of how he was able to stomach Trooper Proctor’s misplaced comments? Clearly there is something in Canton stinking incessantly more than Denmark ever did.

1:01:35 The hair to me is totally irrelevant!! Who'd be surprised to find someone's hair on their significant other's vehicle, that John was using that night, a snowy night requiring wiping off windows like the trunk window, one that's always parked in John's home garage... then stored as evidence, in the totally heated, ultra secure sally port, only accessible with logged key cards... unless the overhead doors open, then it's party time for the neighborhood... and the Sally port turns into the Waterfall like Proctor's magic evidence voodoo, and the surveillance system memorialized their fun acid tripping night, manifesting a perfect preexisting "Lexus sized" snow pile delineation outline... despite the "heated" in "heated garage", people randomly appear or dissappear and oh... Ya, a garage where John used to work!! To the shawk and whoreur of no one, a tiny hair laid lightly on this Lexus... surviving intact, after said lexus traveled / was towed... and brushed off multiple times in a blizzard... by people who were close to John... thus easily could've transferred a hair NATURALLY... STILL, the hair laid lightly on the lexus trunk area, defeating all travel and weather events, despite all the trunk/taillight tampering by officers, who testified on the stand to opening the trunk during their "investigation"... Likely more than just once. But by golly, that tiny hair, totally not transferred or planted, clung on by a few middle cells, while the hair ends partied and blew in the 60 mph tow in a blizzard. Oh, that hair also only shifted slightly to the breath of the evidence photographer. (surely, a much stronger breeze than flying thru a blizzard hitched to a tow truck!) Proving it's determination and strength. 😏🙄 Shure. 🙄 John's clothes and girlfriend's Lexus were obviously stored in his home/garage... and then stored in the "Evidence" garage... where he WORKED... SHOCK, it had one of his loose hairs lightly laying on it, in an area he likely touched that night, or shady officers with access to his evidence, work locker and areas of the building which John frequented, accidently or knowingly could've planted it. 1:18:07 this guy's been waiting forever to use octillion, in public with purpose. 😂

My best theory of that night... John enters the main front door, everyone else had been using the side door by the driveway. Keep in mind John may have been reporting on drug activity involving people they're connected to and this could've been a total set up. That said, here's one of my theories which could be true regardless. John begins taking his shoes off in the front door entry way, as he normally did at his own home. (shoes could've alternatively fallen off in the struggle) The dog was let in from being outside, but they weren't watching the dog/front door interactions since everyone including Jen on dash cam, used the side door... Dog startles even more from the unexpected front door anomaly, and stranger/John, attacks John, John defends himself and guys there jump him, or even if they don't but are up in it, pulling the dog off him, in the struggle/fight, John falls down basement stairs... which are close to that front door... Falling down those stairs, John hits his head on the stairs, basement doors or the weight equipment at the base of the stairs and his phone flies off his person in the struggle, maybe the phone falls under the stairs or amongst weight equipment. (if they intentionally jumped him, any version of John in the basement works as well.) John gets knocked out from the fight/attack/fall and vomits, convulsing... They try just letting him recover, maybe even wash his clothes while he "recovers" but he doesn't. After 2:30am... They led him out the bulkhead door, while he's possibly barely alive to set him out in the yard by where he was dropped off, either to kick him out in their anger, or just get him out of their home. "Drunk man in snow" or hit by car /plow or maybe he got jumped before even entering home... might have been their initial plan. Telling each other "he never entered the home"... Higgins goes to the station to field any calls, etc., while they clean up 34 Fairview, etc. The 22 second call, I've shown in my short, was plenty of time to communicate the cover up plan. They make a bunch of calls trying to find the phone. They find it and possibly search thru it and delete incriminating things, ether just from the struggle or also anything from John's undercover drug investigation. I still wonder if Higgins or McCabe tampered with John's phones, surely he had two, work and home, no? I also wonder where John's gun was recovered. Was it on him? Just curious. Karen showing up was a gift to their plan, did I hit him?? Uh, yeah, sure, yup, totally. Exactly.

I don't travel with my cellphone within arms reach, I often leave it places because I'm clumsy. (see my name, I really am a clumsy fairy ). I don't have any issue with the idea that 'most' of us do, but not all.. I know it's nit-picky, BUT it's a court case, kinda need to be precise?
