Though Rhode Fashion has first to use in commerce, unless Hailey is trying to do clothing, I don't think they will win.

In Zoya’s case, I believe they have to defend the name and color confusion thing, not that they necessarily wanted to. Because it’s so common to name polishes after people, Zoya has to file whenever there’s a possible infringement in order to keep being able to do that, basically. (I’m sure a lawyer will come and explain this better.)

@Eliza Socheata. Not the OP, but look at Black Phoenix Alchemy Lab's Claw Polish. They have official licenses for Polish based on American Gods, Crimson Peak, Overlight--game--(as well as perfumes, hair glosses, atmospheric sprays and bath oils with many additional licenses). They just moved their brand to the East Coast from California, so shipping time is still adjusting, but their products are amazing.)

RE: the ZOYA/Lights Lacquer situation; my very first thought went to Julep because all of their nail polishes were named for women. I did a little bit of digging, and sure enough they had a polish named MIA - and it was released in 2013. So ZOYA wasn't even first to market with that name; VERY weird that they got the trademark.

I found a blog post for a review of Zoya Mia polish from 2013. Julep Mia is also a pure silver color, Lights Laquer Mia is close enough to Zoya Mia.

Zoya seems like a bunch of hypocrites having a hissy fit to me. Like let’s be cry babies because she has a platform she can use to become bigger than us😂😂 they have names like Leslie, pippa, Jordan, Marley etc. so to point the finger is mighty funny. To clarify, zoya thinks it’s ok to use names but no one else can?! I’m an OHIOAN OVER HERE and I just want to say that zoya is irrelevant to me. Maybe they should do a better job at marketing and not hate on how another company who is simply doing a better job at getting the word out there about their product. She’s on to company number 2, is the immediate rise that much of a threat? Because that’s what we call competition, you work for your success not cry about it like a little baby when someone else is doing better.

I mean just to play devil's advocate, if you're going to dupe a large brand's trademarked colour, at least have the sense to name it something else? 😅 It might seem frivolous but its literally why trademarks exist - to protect large brands from small brand imitators. I do think actually proving confusion here is near impossible though, unless they have some search engine data that shows people searching for the Zoya shade were being directed to Lights (ie Lights using "Zoya Mia" as a keyword in their Google ads, which IS a thing people do).

Yeah lol. Like, first of all, they arent even being sold physically in the same state. And for people ordering online, obviously you’re gonna go to each of their own websites. As for retailers, if there is a retailer that carries both of these brands, the difference in bottle shape, font, and even cap color is way different. So it was definitely a reach.

It’s ridiculous. I own *hundreds* of bottles of nail polish, coincidentally mostly Zoya and both of Kathleen’s nail polish brands. I literally own both Zoya Mia and LL’s Mia. They are different, completely different. This puts a very bad taste in my mouth for purchasing any more from Zoya. Jfc, leave KL alone.

I met my husband in high school. I did wear makeup but very moderately because we went to a private school and heavy makeup was discouraged. ( it was the 60’s) We had not been dating very long when somehow the topic of makeup came up. I don’t remember the context, we may have been watching a movie. My husband casually said he really didn’t like makeup. I responded sweetly that, in that case, he probably shouldn’t wear it. That was the end of that. I continue to wear makeup daily and enjoy it.

When my sister was in 7th grade. Her and her friends started playing with makeup. You know eyeliner, lipgloss, some shimmer shadow, maybe a bit too much bronzer (it was 2002). And the principal tried to put a “no makeup” rule into place. But here’s the kicker, not just with the students. HE TOLD TEACHERS NOT TO WEAR MAKEUP!!!! FULLY GROWN WOMEN! The letters home went out on a Friday, and on Monday, her Catholic elementary school never saw so many Smokey eyes! Even boys had makeup on in protest (2002, we lived a very binary life) And and and the principal’s wife was a teacher at a different school and wore makeup every day! MAKE IT MAKE SENSE!

As a curly haired woman, the Elyse Meyers story struck a chord. I straightened my hair for a long time due to direct and indirect comments that my curly hair did not look good. To be fair, no one else in my family has curly hair so I didn’t know how to take care of it as a teenager. I am not sure anyone had bad intentions in their comments, but I don’t think there is ever a positive reason to say someone’s natural hair looks bad.

@@ambersmith2612 I'm white with curly hair and get the same, the worst is you'd be so pretty if you did your hair different. I also get other white people wanting to touch my hair, why I don't know. I really hate people who just touch like if I'm in a queue and I feel somebody stroking my hair. Thankfully covid seems to have stopped that but it makes me feel so small and singled out. I never know what to say at the time and then spend the rest of the day cross at myself for not speaking out. I've had to learn how to look after my hair as my Mum had the same issues with her curly hair and used to iron hers or wear wigs as in the 60s when she was a teen curly hair was considered bad. So she used to brush my hair out and turn me into a fluff ball! She did the same to herself so I didn't realise we had the same hair type until I was in my early 30s 🤣

I enjoy her old brand and especially her current one, Lights Lacquer. Congratulations on your first order with her brand… you won’t be disappointed. As for Zoya, well I used to buy their product for years too but stopped during the pandemic. I thought my money served better to those mom & pop businesses. Not to mention Zoya’s formula had been changing over the years and not for the better.

Thank you for discussing the human name trademark. Kathleen said that two years before she even released her brand and I really don’t think people are confusing her brand with another small brand. I think the brand wanted attention and to be takes about, so they sued Kathleen. I have never heard of them before, so it worked, because now I have heard of them😂 I won’t be purchasing from them because of this. Like you said, it’s not cool to go after another small brand.

It’s Zoya’s right to protect their trademark, otherwise it dilutes their claim on it if they let it go. KL should have done proper research, and then responded to the letter from Zoya before a lawsuit came about. And who’s to say KL’s brand wouldn’t become huge in the future, and cause problems in the future ? Become the next Estée Lauder? Better to sort everything out now. A lot of the language and terms, like “band confusion” are part of the legal terms, if you’ve looked at other trademark precedence, you would have seen. Everyone is getting all emotional about this, but it is just routine business. Zoya didn’t do this to be mean or be personal. They tried to work with KL but she let it get to a lawsuit. I think that’s shows worse on her business practices than Zoya.

That is petty af! And I don't even understand the outrage about her using the word. I can't be around young people without hearing the word every other couple of words 🙄 It seems to just be part of how people talk now and isn't even used with a racial connotation, unless it's used by black people for each other, though they call white people that too, so maybe not even that.

I just googled "mia nail polish" to see what came up. There is literally a brand called Mia Cosmetics and the first result is for "ella and mia nail polish". There are tons of pictures that come up. I have a REALLY hard time beliving that Kathleen's polish in the mix of those results would cause any more confusion than any other. I also feel really bad for her - adding a name to each collection was a tradition she had. Super lame on Zoya's part.

I think Zoya should be more concerned with the rapid rate at which their polishes dry out than polish names. I really like their pixie dust and leopard spots, but I have yet to have a bottle last beyond six months. Meanwhile, I have Julep polishes that are still good. I miss Julep.

I think the issue wasn’t just the name, but the fact that shades were similar to the ones with the shared names. When Zoya trademarked their products, they likely trademarked the shade & name(s) in conjunction.

As a someone who lives in the UK , who went to a UK secondary school, there is a lot of makeup shaming from teachers over here. I've heard teachers tell girls in my class that they shouldn't be wearing that much foundation or even making fun of them for wearing makeup. It's ridiculous that schools in the uk focus more on the uniform rules than actually educating students.

That’s so sad. I used to be a substitute teacher and I had a kid show up to school wearing right blue eyeshadow, hot pink lipstick and blush. Did it look awful? Yes. Did I say anything or shame her? No. We wore pretty bad makeup when I grew up too and we weren’t shamed by the teachers. But each other? That was a different story.

I went to an amazing school in the UK, the headmistress was particularly stylish and well put together. We had to wear uniforms, but the older students got to wear fitted skirts (looked more like business attire) and wear makeup (I think they got funny about certain piercings and tattoos - but to be fair, it was the 90's). A massive amount of focus was on being respected as young women and learning was celebrated and congratulated. They never infantilised us. Religious Education was actually about ALL religions - not bible studies (progressive for the time), and we would go on visits to Synagogues/Mosques/Temples to learn about different customs and beliefs and how to respect them. I heard that they have just been named the top grammar school for girls, so they're still going strong.

I'm no longer going to buy Zoya nail polish anymore. This lawsuit is insane. First of all Light's Lacquer is only available online while Zoya's is in store so how can you confuse the two? Second of all the bottles are completely different. Third of all the brand names are completely different, 4th of all the colors are different. Not to mention Zoya is a huge company who is making way more money than Kathleen's polish. It's so petty of them to go after a smaller company that makes way less money. Although Kathleen Lights is a relatively big KZbinr I still consider Lights lacquer to be a small business compared to these big brands. Super greedy of Zoya. I agree. Honesty and integrity is not about being malicious or tactless, or projecting your own bad mood or insecurities onto others. I will pay people compliments and be admiring of their makeup skills/accessories etc, but I'd never comment on someone's body or natural hair (even so-called 'compliments' can sound offensive and toxic, so I prefer to be cautious).

I have rosacea and was in the gym bathroom applying some foundation because I didn't want to walk out looking like a beet. An older women, bear in mind I am almost 60, told her friend she couldn't believe the time that "some girls" spend in the mirror putting on makeup. I was absolutely furious but decided to ignore the comment. And I am absolutely PRO Lights Lacquer if not just for the wonderful quality nail polish. No more Zoya for me. Infuriates me that they are claiming copyright on names.

It is a real thing. I’m team science, so I love ingredients in my makeup but, NOT dangerous ingredients. Talc has been known to hurt gymnasts since the 90’s. We should know better by now!

When I was in beauty school back in 2004, zoya was the "cool girl" nail polish.. now almost 20 years later, I honestly had no idea they were still in business..& I keep up with the nail scene a lot.. not as much as hair and beauty, but still keep up with the newest and latest nail stuff.. n honestly this makes me sad for KL... Names should not be able to be trademarked.. if Tana Mongeau trademarked the name Tana, I'd be pissed bc I was named Tana many years before her..only thing she has on me is she is famous n I am not.. but trademarking names esp for products, is crazy.. But most of all- bringing up Kathleen's past is taking the lawsuit way too far, imo. That happened years before lights lacquer was even created.. I'd never associate LL with Zoya...n I don't think anyone else would either.. this is a crazy lawsuit..

I do makeup videos on TikTok and in December I had someone get super upset that I wouldn’t listen to her and cut my hair short. I told her I didn’t like short hair and that I don’t have to listen to a random person on the internet. She was so upset over that that she started commenting under other people saying that I wouldn’t listen to them and being rude.

OMG that is so rude of them, you're not a doll you're a human being with thoughts and feelings. What a horrible human being. You can always do a TikTok explaining the situation and that it isn't appropriate behaviour from a stranger. I've noticed more and more people having to make statements on videos to say they will not tolerate these types of comments and they will be deleted. Younger people seem to feel like they have some ownership over the people they watch. As evidenced by them turning up at big KZbinrs houses and being angry when they are told to leave.

I am white with curly hair and people always feel the need to comment on it. What I hate the most though is the people (all white) who want to touch my hair and the people who just start touching my hair when I'm in say a shop queue.

i hardly even ever wear nail polish and i've heard of zoya, i see them everywhere! i also think unfortunately as a brand you just have to do your due diligence. that being said, i think there are so many nail polish/names that this was going to happen eventually. i think OPI has it right where their nail polish naming system is the same way fall out boy names their songs LOL

I honesty do not understand why people need to sue other peoples brand. It doesn’t even have a similar brand name, therefore I do not see the confusion for the customer to choose one brand or another. The names of the shades is not something I as a buyer think about, but buying the shades I think are pretty based on the colour of it. 😅

Maybelline Fashion Brow had the same spike ball brush! it made everything apply quicker, not as messy as you would think, and I bought a pack of disposable wands with the same spike ball and it does apply mascara well but needs some practice.

I have naturally curly hair very similar to her curl pattern and people have hated on it all my life, sometimes claiming that I lie about it being natural, even my mom (who has always chemically straightened hers and naturally is curlier than mine) bugs me about getting it treated lol. She's a hair dresser btw. People just really love to get into other people's business.

I have to agree with that statement about once you start wearing makeup you’ll feel ugly without it. It’s true. I’m 40 and been wearing makeup daily since the age of 15. Since we started wearing masks in 2020, I’ve started to wear it wayyyy less. I felt really ugly and self conscious. But today I embrace my natural face. If I could go back in time, I’d tell myself not to wear makeup as much. I would have loved my natural self much sooner.

I could be wrong about this, but what if you wore make up everyday specifically because of your insecurities with your appearance, and it was only during covid that you realized you had these insecurities, because it was the first time you didn't have a reason/excuse to wear makeup? Either way, there are many people who wear makeup regularly and who don't feel insecure about their natural appearance, so I think it's important to acknowledge that it depends on the person. I think a good way to explain it is that consistently wearing makeup daily is correlated with insecurity, so if someone finds themselves not wanting to go out without makeup on, that could be a sign that they have some deeper insecurities to address. Maybe it would be good to say that if you wear makeup daily, it's important to check in with yourself every couple of weeks or every month to make sure the reason you are wearing it is because you enjoy it, and not because you feel uncomfortable without it. It. It could be a monthly thing where you challenge yourself to intentionally not wear makeup one day, and if it ever becomes difficult where you feel insecure about the prospect of doing that, then you know to be careful so that your makeup habits don't end up enabling your insecurity and allowing you to avoid addressing it.

The problem is that it's not the same for everyone. I started wearing makeup because I loved the self expression and art of it. And I would feel just as great wearing a full face one day as I would not wearing a single thing the next day. And I still feel the exact same about it! I like how makeup brings out and highlights my prettiest features, but I also like my natural beauty. My point is that it's different for everyone and therefore we shouldn't put pressure on girls in any way; the focus should be on self confidence, whatever that may look like for someone :)

IMO, Zoya threw in the incident with the N word to see if it would stick. Using the technique of trying to make it inflammatory is something lawyers do when they are out of legitimate ideas. Kind of like a vain threat to the defendant of give in to us or we will win by public shaming. I kind of wish she had renamed them but still using the original names. Like “Mia’s Cappuccino” or “Mia’s Rosebud.” That alone would have been a reason I’d buy them. Lol I suppose though, that the settlement was clear enough that she couldn’t use the names at all.

I think ZOYA just screwed themselves. This is so petty and lacks proof. I only had one ZOYA nail Polish and it did not co Pre to Kathleen lights nail Polish. My money goes to Kathleen - add the brush is just the best!

There is a lot that I love about Jen, but I think one of my favorite things is the fact she does not miss a beat when there is a point to be made. I.E. Whenever bringing up sunscreen, she is not letting us forget how it actually works despite industries trying to game the system via omission. Also whenever she catches her own slip up like in 'with/without prejudice'... speaks a lot to her integrity as a content creator.

Name trade marking is something I became aware of awhile ago. There is/was a skincare line carried in Bloomingdales and also had a treatment room as well by a person called Adrienne Arpel. She stepped away or sold the company and started a new line she sold on Home Shopping Network. Unfortunately since she sold the company with her name, the original company would not let her use her name. She no longer owned her own name. The line is still sold on HSN called Signature Skincare.

The Too Faced Spritz palette from my experience as a WOC was horrible and barely showed up on me as far as the transition color shades. I wasn’t impressed thus returned it.

Girl I LOVE your grey hair era. It gave not only myself the confidence to stop dying my grey streak (I started to go grey really suddenly at 27, in these very discrete patches of 100% white hair, like piebald, one patch on my left near the crown, one about 3 inches behind my right ear and in a solid streak just to the right of my mid part, right on the hairline above my right eyebrow) and I was super self concious about it. My mum is turning 60 last year but had always coloured her hair as she thought that, because of her auburn/ginger hair it made her hair colour look kinda dirty, so she never let her roots grow out. When she asked me why I wasn't dying my white hairs, I showed her one of your videos, and a few other photos of women of all ages from teens to the elderly, all happily growing out their grey/white hair, and how you and they all were embracing their natural hair for what it was, and how on tik tok and your videos and even irl I have often seen teens and girls in their early twenties say "I can't wait to go grey, it looks awesome! It's like every white hair is an experience point in life!" and it really warmed my heart to think that the new generation is coming up without the stigma of greys = old, frumpy, let herself go, etc (I'm sure some still don't like it of course but I've heard far more positivity from younger girls and teens and even my peers, where as 10 years ago no one ever really said that sort of thing, and everyone assumed it was a negative thing to hide, because the status quo was "women can't age because it makes them unattractive" and yet those same people would say "oooh that silver fox is sooo handsome!!". As women we should believe for ourselves, and teach our daughters that women who age are just as beautiful and sexy, and that they don't have to be young to be valued, and that grey hair is something to be proud of, or even just neutral about, but not something to feel sadness or shame about, even if you do choose to dye it, because both dying and embracing it is all accepted because women have the ability to choose because their value as a person isn't just in their looks ❤

Regarding Zoya, they wouldn't necessarily need to provide "proof" at this point of legal proceedings. They settled before it reached the discovery stage. There were some exhibits provided, such as the mia name and shade comparison, which would generally be enough to file on, but in most courts you don't need permission to file a lawsuit. You can file your lawsuit even if it's built on twigs and proceed until it is brought in front of the judge. The party being sued still has an obligation to respond or risk a default judgement. I worked at a litigation firm for years, what you would typically see if there was a lack of substantial evidence is that the defendants would file a motion to dismiss, but it appears that KL's attorney believed that there may have been some merit to some of the claims, which is probably why the opted to settle. Another reason they likely opted to settle is because litigation is bonkers expensive.

That Cali Rae palette does not make good use of dimensions of pans which creates space waste. It makes it harder to want to have such a bulky palette in my makeup case. There are competitors using sustainable cardboard palettes, plus have efficient square pans where you can have, say, 16 different makeup pans vs. Cali Rae’s 7 pans.

The problem isn't that the talc is cheap. The problem is that it's very easy for contaminated talc to enter the chain, whatever the price. It's also very difficult to police the origin of talc. Insider Business had.a very good video on it. If I'm not mistaken, I think that most of the people who sued used talc on their intimate parts. This is not how the talc should be used.

The hate against curly hair is real! I had gotten my hair straightened at the salon once then went to see a guy I was dating who told me how much he liked my hair straight instead of curly. I asked him if he wanted to come to my house at 5am to do it since he likes it so much. He immediately shut up and never said a thing about my hair again. Also as a naturally curly haired person with no one in my family that has hair like mine, I had no clue how to do my hair or any appreciation for it until I was around 25

I am a formal CA paralegal of 15 years and a huge lover of pleadings and case law; I love that you cover legal content and get it right. I'm not a fan of content creators who cover lawsuits and not only get it wrong but also try to argue against the claims so confidently as if they know and what they are saying is fact and their viewers absorb it as such and that's dangerous, to me anyway. It is way outside his skillset and he should just stick to reading parts of a lawsuit he finds interesting and not attempt to comment that he thinks no one can sue for certain things. People can pretty much initiate civil lawsuits over anything; the complaint is just that, complaints; not necessarily facts. Anyway, I’ll get off my soapbox now.😑

My mother always told me never leave the house without makeup. One time I went and got my hair done and she says ya should have worn makeup and you would have looked better. And I have people tell me I don't need makeup and then when I don't wear it they are asking me if I'm sick....so annoying.

I wear makeup due to a life altering glitter deficiency. I thought it was an eye issue so I consulted Dr.Mom McGrath but it seems to have spread to my upper cheek area, I mean really how many karats does it take? 2 the answer is 2 well 1.5. One appears to be a mini. This is a chronic issue that flares up like ‘lava’ in the heat. I could help myself but I won’t. And if I need a touch up? Well almost every piece of glittery goodness comes with a mirror and no extra charge. Just saying, takings things away doesn’t really get the job done. Those pesky mirrors are all over town and taking them away from school sure doesn’t teach them anything about dealing with the desire for face time.

Re: talc makeup and asbestos….you mentioned that to be careful with “cheaper” brands, I see a lot of products that are relatively cheap that have talc products (ie: ELF, Rimmel, Covergirl, Maybelline, J.Cat, Wet n Wild, Essence..etc.) should I be worried about these companies? Or is it with smaller brands? I wish there was a way to tell if companies (Large, smaller, cheap or expensive) are getting their talc supply from a safer source. I’m frustrated as a consumer but also as a makeup lover. I’m aware of being mindful of this talc situation, but I also want to NOT be limited on my creative desire to use, play and experiment products (which a lot of them contain talc 😢) in my routine. It doesn’t help that talc-free products are a bit more costly too. …..Where do you all draw the line? How can we be safe but also not hinder our creative side?

Hey so to clarify on asbestos, talc is a type of asbestos which refers to the crystal shape. However, when we refer to asbestos in the harmful sense it refers to the particle size. That very tiny particle size interacts with our airways and lungs making people sick. When we mine talc, there is always going to be the small particles but it is up to the mines and companies that buy it to properly QAQC the talc

Just a comment on the lawsuit, $75,000 is a jurisdictional amount. Essentially, if you want to file a lawsuit in federal court, you need federal jurisdiction. The two most common ways to do that are (1) sue under a federal law or (2) something called diversity jurisdiction. Diversity jurisdiction means every party has to be from a different state. Now, I'm order to bring a lawsuit under diversity jurisdiction, you also need to have damages "in excess of $75,000." Now, for state court, that will obviously vary by state. Most states have tiered courts and which one you end up in depends on the amount in controversy. In Michigan, to file in circuit court you have to allege damages over $75,000. I assume it's similar in Ohio.

Also, a 2.5 hour mediation is not bad. Normally it's only that short if you don't settle. And that doesn't mean everyone was in a room talking. Mediation uses "shuttle diplomacy." Each party and their attorney are in separate zoom break out rooms and the mediator goes back and forth conveying the offers. And I'm sure that the settlement agreement contains a confidentiality clause, because almost all of them do. I assume that's why Kathleen can't talk about details.

I live about 5 miles from Art of Beauty's headquarters. They may seem like a "big" brand, but they aren't. They sell almost exclusively to salons and spas, so while their distribution is wide, they have less than 50 employees and less than $5 million in revenue. This is not L'Oreal. Most people outside of the beauty business haven't ever even heard of Zoya, which, btw is the first name of one of their founders. So naming their polishes using people's names has been a thing of theirs from the beginning. You can blame U.S. law concerning aspirin, kleenex, band-aid, saran, granola, trampoline, and post-its for AoB's lawsuit. About the worst thing a company can do for a trademarked product is ignore similar products using that trademark either as a name or in some other capacity, as it runs the risk of being genericized. So companies - especially small ones like AoB - are likely to fight tooth and nail to prevent that. It was Kathleen Light's responsibility to exercise due diligence before settling on names for her products to make certain that she wasn't infringing on anyone else's trademark. That's what lawyers are for, and they are expensive, so my guess is that she just skipped that step, thinking that it wasn't a big deal. It's a common mistake that start up companies make, and that often gets them into trouble.
