On 12 October 2021, the International Court of Justice delivered its judgment on the maritime dispute between Kenya and Somalia. However, while the new boundary was immediately welcomed by Somalia, Kenya flatly refused to accept the ruling - arguing that the Court was prejudiced and that it would not give up its national interests. So, what lay behind the case? Why has Nairobi so openly refused to accept the ruling of the world’s highest Court? And is their maritime dispute still unresolved?

While we often think of territorial conflicts in terms of land borders, maritime disputes - covering territorial waters, exclusive economic zones (EEZ) and continental shelves - are in fact far more common. In fact, it is estimated that there are currently between 200-400 such disputes around the world However, while many of these are resolved peacefully through negotiations, sometimes it requires the involvement of international judicial bodies. The most important of the se is the International Court of Justice (ICJ). One of the more interesting cases to come before the Court in recent years was the maritime dispute between the East Africa states of Somalia and Kenya, concerning their boundary in the Indian Ocean. Brought by Somalia, Kenya contested the case from the start. However, after a number of postponements, it eventually withdrew form the proceedings in early 29021. Then, with just weeks to go, it announced that it no longer accepted the jurisdiction for the Court. So, what does all this mean? Is there still maritime dispute? And what happens if Kenya continues to refuse to respect the ICJ’s judgement?
