I'm not 100% sure. But i believe the plants are not patented themselves just the process that made the plant.

USPTO has been granting plant rights since the 1930s. Plant patents are very common, many ornamental flowers and fruits you buy are patented varieties which took the breeder hard work, time and money to create. Wouldn’t you want recognition/protection/and compensation for your hard work?

I just lost so much respect for Kevin. He danced around the real issue, which is Phylos LIED to everyone about what their intention was. And he keeps going on and on about how they aren't using anyone's genetics, but no one really thinks that's the issue- they are using their "Mt. Everst" of genomic IP to out breed the very breeders/growers who sent in their samples. And has he not seen the video where Mowgli says to investors, “All the cannabis around now will be replaced by varieties that are optimized and specialized, and we’re going to be the company that makes those. We have really huge barriers to entry protecting us. I think the main ones are that it would be impossible for anyone else to collect this data set at this point, especially since we have the Illumina gene typing array. We are fully integrated in the cannabis industry and I think we have more trust in the cannabis industry than any other science company. We have more scientific backing than any other cannabis company, and cultivators can’t really do their own breeding.” Just wondering if Kevin told all this to his clients before they used Phylos. Go home Kevin- you showed your true colors.

anyone can get this data... the internet... collaborations... phylos i dont know much about just passed by, but its like people ignore the fact they can collaborate together to get the same info phylos has, phylos was the first to utilise people willing to collaborate, would people share if they told the truth ? hell no, greedy people are at the bottom as well as the top, when people see no value in money, an explosion of infomation and creativity happens... while everyone chasing money, the smartest runner gets the win... phylos is doing that obvioulsy, people are pissed because of their genes... their strains... remember how you got them in the first placee... seeds from nature, but is nature kicking off ? oi give me my children back you theives lol world needs to grow up.

Why are people surprised? Kevin is right this is now modern agriculture and this is the name of the game. We as a country have sat back and ignored farmers who have been destroyed from patents on plants but now only get upset because it’s entering our arena. One needs more than fucking boycotting you need regulation on what can be patented. Not enough regular people involved in the governing side of agriculture just suits and juice drinkers. Great tool that will be used to dominate the game by monopoly agriculture.

I really appreciate Kevin's contributions but this interview feels like he is trying to justify a bad situation because he realizes everyone that's contributed have had their trust abused and he also really zed there is nothing anyone can do about it. Technically he is right about genetics etc but if people knew what Phylos would do Phylos would still be scratching around for "data". Human nature serves itself and this will continue to be the way. Question is what can be done about it? How does Cannabis genetics escape this horrific system of patents that is used as the worst expression of Capitalism?

L00NEY79 too right. I think China, India and other countries may give some conglomerates a rude awakening in the next 20 years. China has used cannabis for Medicine a millennia ago. I think it’s naive or intentionally misleading, even if technically correct to saw that they aren’t using your stuff just the information. The DNA sequences contribute tremendously to an understanding of what it takes to reliably creat a strain with certain criteria and then short circuit the process to mixing the genetics to get new strains. Maybe there needs to be the equivalent of the Linux EFF to fund lawyers to protect open source Cannabis genetics contributions. I admire Kevin’s openness, willingness to teach, pragmatism and almost unmatched knowledge but I feel there is some capitulation in the face of an almost irrational respect for highly educated geneticists who, like todays data scientists are shocked at the fact that they can actually probably make real money in their niche careers in their respective fields. More power but unless there is something like a Cannabis EFF which can represent all the contributors with well funded legal and research teams then big AG will do to us what monsters like Monsanto and others have done to countless others. Maybe this exists already but if not, we need the Cannabis Frontier Foundation. 🤔

@@chaacbze that is my point. kevin, Monsanto, you, me have the right in the US to exist either in extreme- small or large because the citizens allow us by LAW. If one doesn't like it then change the system -law, compete or not. In the US - study the 'organic' produce market or craft beer market. Even better study the Whiskey Rebellion until the repeal of prohibition. What most don't understand is that even tech that enables Phylos will undergo major change... Jodrey like Peter Thiel may not see it.

Just like with other agricultural products, there will be a continuum: you can get your vegetables and herbs at Safeway, or from the local farmer, or you can grow them yourself. There will be a place for all of these in the cannabis market. Maximize choice and access!

You miss the entire point- yes, all you said was true, but the point is Phylos lied and misled everyone, took their money and data, which they will use against them. The ONLY reason they received that money and data was because they lied and misled everyone. The only reason Phylos is “investable” by a “Monsanto” like company directly coincides with their deceit.

Lol I always thought phylos sounded too good to be true. They totally did a 180 on being a research lab but it makes sense. Kinda disappointed wit kevs position. I also think he makes an important note about the restriction of how many plants a person can hold when realistically there should be no limit if it comes to just holding genetics if you’re not flowering hundreds or thousands of plants what’s the difference if you have 100 different mothers. That’s why this battle of legalization is not anywhere close to over.

That technology doesn't exist yet and even if it did it would still be next to impossible for them to steal your stuff. You gave it to them to map, documentation that it existed in the public sphere. I think you have a solid enough understanding of this plant Mr. Steensland to realize all the difficulties that would be associated with attempting to clone a plant from a microscopic sample of it's genetic code. Having said that it will happen eventually, use phylos tech to help carve out a piece of cannabis genetics they can't steal from us!!

They are going to use the best genetic attributes of all the data they collected to create a far superior being than any of the strains in the database individually...this then they will patent...outcompeting your strain putting you out of business eventually... and since they have this large database they can create an infinite number of superior strains that will put all natural old school selection type breeders out of business...With genetic markers they will be able to create and engineer strains in a fraction of the time that you took to create your strain and hundreds of new strains that will be far superior they will then sell these and have licensing rights. These guys are going to be gazillionaire’s through this process and none of you are going to be reimbursed for your hard work you will be slapped in the face and put out of business

PHYLOS has the cookbook now . as we grow out 10-20 seeds to hunt a Phenotype for Breeding ,These guys can HUNT 20,000 in the same time , so they can bring a strain into the marketplace in 1 year instead of 5 years + that normal breeding takes . I worry that we will be back to Black Market status in a Legal state ,

I don't believe Phylos will recreate strains but they still lied and took advantage of people in order to obtain genetic data that will then be used to create NEW cannabis varieties, and all of this was done in hope of putting everyone else out of business. Imagine if I was a food critic and went to all of the award winning bakeries across the country and convinced them to share their secret recipes with me as long as I would never start my own bakery. I convinced them that it was for research purposes and verbally promised that I would never compete with them. Then, after I've gained their trust and recipes, I completely go against my word and then use said recipes/data to create my OWN recipes and bakery with the intent of putting every other bakery out of business. That's what they did. So... will they bring back the original Skunk#1? No, they won't. But they now have a priceless amount of data that will help them take everyone out the game.

corporations are not evil ... people are just cheap. When the california market went from 100% flower to 50% concentrates in just four years - and the majority is vape pens - it opened the market to cheap oil from asia. It doesn't have to be quality as long as it's cheap. The biggest beer brands are watered down rice/corn beverages. You vote with your dollar. as long as craft cannabis is around you can vote with your dollar. If people think the 4 plant limit will kill the black market, they were doing it when 0 plants were allowed.

great last point. Here in Canada, we (in some provinces atm) we are allowed 4 plants. If u are accepted under medical is different, with plant counts. But effectively, theve killed off any budding breeders here in Canada. Unless u have medical plant counts, and even still that will be woeful at best when big Ag comes in. As far as that goes, it gonna be an interesting year as we allowed 4 plants, BUT if they have not beenlegally purchased and taxes collected may make this a year to remember going forward. Could be prohibition 2.0 coming,

So lets assume the narrative being put forth is that Phylos is not stealing Breeders Genetics and are patrtnering with select Breeders to provide them with valuable data on their genetics. Is there anything that Phylos is doing to help Breeders to protect theit genetics and the genetics of small time Breeders so that it is not confiscated by Corporate Cannabis? I'm talking more like assistance with the actual Patent Process! I believe that all Breeders need help and support where this is concerned 🙏

DNA database can only be used to classify and identify. It does not support organic creation, but provides a guide for breeding goals.

I've smoked since the 70's.. We all are smoking on next-generation. ..very few original cuts existing of old . Until I started growing wild for over a decade. I have never had any weed ever help in blood flow Help in arthritis stiffness, ,like it really oil's the bone juice. Sleep all night in discomfort pain Nerve tingling blood flow in fracture bone in face,,trying to heal. The brain attack Lots more effects too. Like eye's on fire So,,yes,, By growing wild over years can CREATE NEW UNKNOWN VARIETY STRAINS THAT HEAL THE BODY .. That's my experience in growing wild I'll never doubt the healing power of cannabis.

I'd love to learn more about your experience with wild growing. It sounds like a good thing for growers to do from here on out. Did you just take landrace seeds, plant them outside, and let them open pollinate?

Hi! Interesting!!! I grow my weed and I only use plants extract: nettle for N comfrey for P dandelion for K and horsetail for calcium...I make bokashi and compost with leaves and weeds...and milk 10% twice a month and every week from week 4 bloom! My weeds are always smooth...it is always the first comment I have because here in France people smoke hash spliffs with a lot of tobacco and when I roll a pure they tell me that I am crazy that it is a waste of weed that it is going to be too strong to smoke that it is not going to burn well etc... They are not use to get properly flushed weed who do not burn evenly who make pieces of charcoal and who are very harsh and who always taste skunk but no great smell...so when I make 2 joints with 2 different weed who do not taste the same they are always impressed or the opposite and told you that is not weed...there is people here who believe that weed have only 1 taste 🤔🙄😉😁...because all the commercial weed taste the same...sad!!! Legalize it worldwide...when USA will legalize nationwide the rest of the world will do it!!! Only 2 year to be sure! Have a lifted one and lots of good vibes from France growers family

@@tsuobachi It's more cannabis philosophy, ,than how or where or even which seed . But I definitely wouldn't buy name brand seeds,,they are the controlled cannabis. Keep this in mind... I can't afford to travel the world looking for genetics. The world of cannabis must arrive to you. If there was ever a brother to cannabis, ,I'm sure I have found a relative. . There is one last secret to cannabis, ,,I have not revealed, ,it's so sacred to me,,for now ,,not to share. It refers to biblical time's of cannabis, ,it didn't even know I was creating or reviving the ancient cannabis. .

I'd love to learn more from you on this subject. I have a couple unadulterated landraces right now, so I've got that going. But I'm missing the entire rest of what you're talking about. What you've already said matches with the way I've been thinking already, but I don't really know how to achieve what you're talking about without some insight/help from someone who's already done what I'm trying to do (bring cannabis back to its natural healing state and create regionally adapted seed stock to share with others in my area).

The problem is, they don't need thousands and thousands of strains. They only need the "core" strain of the thousands and thousands of strains. As soon as they have the root of all varieties, everyone is screwed. They'll grow the strain, claim the patient and go after any growers that are using strains with their strains genetics. It's already happened with Monsanto and other companies suing farmers for growing Monsanto corn etc. It's complete horseshit, but they get away with it because they have lawyers that will kill if need be.

The future of cannabis is coming and those that don't look at partnering with companies like Phylos will be sadly misrepresented in the ever changing industry of Cannabis. We plan to work directly with Phylos on our in house breeding program here on my farm in Colorado. As a licensed state facility, we're restricted in what we can work with today but without companies like Phylos allowing us to put a name behind the genetics, we really have no teeth in the fight going forward.

Phylos is on the cusp of partnering with a company that will do to cannabis seeds what Monsanto has done to veggies. Get pollen from Monsanto grown corn on your heirloom corn? Those seeds can be confiscated and you put in jail for growing them.... Lost in the process. The marijuana business is lost in the process. Now do you think any old Afghani grower can tell you what his terpene profile is on his grow? Make me laugh. Nobody died from Mexican pot grown in Sinaloa. These growers can't tell you what temperature is to cure pot but somehow they do cure the pot. The pot they sell in dispensaries (Great name?) is pretty and alright and gets you high. The Americans are programmed by the big agri business to discount anything with a blemish as bad. God forbid there is a molecule of mold. Shut it down!

You can go either way here phyllos would not have had the data had it not been for the trust of those keepers of the genetics...sure they maybe could’ve got it through the seed companies maybe through purchasing clones... Remember they ascertained this big data basically for free the people who gave it to them were charged $$$$ for genetic testing they made money off of it... Think of the cost they would’ve had to lay out to get all these genetics if they did it like everyone else.... also some pretty rare genetics wouldn’t have been given to them had people known this would be the outcome....it just seems like another capitalist pig move... this guy being interviewed makes it sound like no big deal the future is here now...but I’m pretty sure money motivates everything in this world... it seems like they are motivated by profit like everyone else...they stand to make a fortune off of the data which is peeps hard work...no reimbursement for the information....This guy keeps saying using the public domain argument would’ve given them the data anyway true...data was handed to them under different premise...now suddenly phyllos is into the breeding business...and this guy is totally duped, There is a defense against this in America it’s called small breeders Cooperative’s which breeders can unite and form to protect themselves against this type of hostile take over... the purpose of putting strains into a database originally was so that people couldn’t come along and put a patent on something that already existed...here we have tbe tyrant phyllos doing just that...it just seems an underhanded way to take all this data and create something of their own which they are going to patent and that just seems wrong...All those people that did natural selection type of genetic breeding which takes time they are going to do in a fraction of a second with genetic markers they are going to create with all this data far superior strains and put all those natural breeders out of business using the information that natural breeders worked so hard to develop over the years

Hi!
