@@OSGCourtWatch If you listen back and try to ignore the jail background noise after the question the defendant asks "So a quarter million dollar cash bond?" and the judge then affirms that and repeats it "Yes a quarter million dollar cash bond."..... The reason you didn't catch it is because it's while the judge is turned away compiled with the jails crappy speaker microphone picking up everything in that tin can they have him in.

Yes, the defense lawyers argument was stupid. Of course the accusations were only that at that point but that's because until the trial itself they're always going to be accusations. However they're still clearly relevant to the question of bail. On the lawyer's logic everyone charged with something with a previous good record should get bail because nothing has yet been found true at trial. I could kill a thousand people, have to be extradited from a foreign country and go to court and he'd say "but at present it's all accusations, we don't know why my client and this isn't a trial so my client deserves bail". What the heck.

OSG - I love your videos. I love that you’re the first one to get them out and you just get the information. My quibble is that at the very end, the defendant was talking at the same time the judge was talking and the judge said quarter million dollar bond, not 1 million. Easy mistake to make - I had to listen to it twice to make sure what I heard but I just wanted to point that out. Keep up the good work! I look for your videos every day :-)

I try to keep in mind that it is the defense attorney's job to shine a good light on the defendant, but to bring up other drivers who drive suspended is wrong. Also, the other drivers did not kill a cop. The others did not kill a person and flee. He knew his license was suspended. He was out cruising at midnight, and the defense attorney wants to state, as a fact, that he was not drinking or under the influence. How does HE know?

@OSGCourtWatch I know news reports indicate that the van driven by the defendant was abandoned a short distance away, and a firearm was found inside. Was this collision the result of some other felony? That would make this a felony murder rather than an accident. Plus, as the Judge stated, we dont know, and will probably never know, if the defendant was impaired in some way (which would also move it from an accident to murder). And of course, regardless, he still left a man to die on the side of the road due to injuries he caused.

Usually I am very sympathetic to defense attorneys in situations like this, but the way this guy presented the "actually he was on his way to turn himself in when he happened to be pulled over and arrested" was just awful, and immediately turned me against his client. You need to acknowledge the weakness of that argument for me to give it ANY weight - like "Judge, I know this will be hard to believe," or "I know you probably hear this all the time."

I hate when a good program gets scammed. Family caregivers are a great solution to the elderly staying home not in nursing homes. Then without oversight or accountability some woman or man child in the family subverts it. It is a one on one program, not all the old people in your family for one monthly payment. He either is the mother Teresa of hit and run or he’s somehow getting paid for all the people he says he’s taking care of.

Defense lawyer dropped a clanger saying "he's not going to be a risk to the public because his license is suspended so it's not going to happen". That just drew extra focus to the fact that his license had been suspended when he killed the Policeofficer! It just enforced that he doesn't care about rules and is unlikely to ignore anything put in place with probation. Massive own goal IMHO.

If notice of suspension is simply mailed to last known address and it's not reasonable to assume the driver saw it, that's a hole in the system. Maybe they need to be served, or summoned to court to hear about it personally.

It was no accident. The guy intentionally drove while knowing he didn't have a valid license. Every inch the vehicle moved was an intentional crime in progress, and the crimes got worse and piled up as the trip continued.

FYI, in setting bail, the judge can presume guilt - it is pre-trial, but to protect the community from possible harm, the judge assumes the worst of the accused, not the best. The trial is a different matter, and the prosecution must prove guilt beyond reasonable doubt, but not in a bail hearing.

Them saying he has no adult criminal record implies he may have a criminal record when he was under 18. Was it an accident, or did he kill the officer because he hates cops for his prior arrests?

The public defender is doing his job, the prosecutor is doing her job, the judge did his job in weighing both arguments and finding the circumstances warranted the bail amount.

@redwarpy the public defender is going beyond his oath by saying that we can't assume guilt. The law states that bail amount is based on the worst fact pattern and assumes guilt.

I'm a lawyer and high bonds are very rare for my cases because I don't usually work cases involving deaths. But, my neighbor across the street was arrested for the death of his husband between Christmas and New Year. I got the 3am call before he went to jail. He was distraught, and it was a bit of a mess, but we had court the next morning, and he was ordered held without bail. Ouch. 3 hours later, additional information from the police and coroner's office was available, and after some back and forth, the prosecutor filed an emergency motion, and we were back in court at 3pm, where the prosecution asked the court to release my client without a bond on some very reasonable terms. They have since downgraded the original murder charge to a negligent manslaughter charge, but I am pretty sure that they are going to dismiss the charges based on the evidence available or charge him with misdemeanor drug charges since both were high. It's so sad knowing them both and not knowing that they used. The entire situation is tragic because someone in their 30s is dead, and his husband didn't want that. As soon as he saw what happened, he called 911 to get help, but sadly, it was too late. I'm happy that the police released updated information about the situation quickly (which is really their obligation but it doesn't always work that way), which would at least give my client's self-defense claim merit.

thankfully it sounds like u had a reasonable prosecutor with a heart. kudos to u for being there for your neighbor. hope it all works out as it should...
