A group of local neighbors claim their homeowners association had gone rouge, and was acting more like a dictatorship than a helpful community organization.

Some poeple love to live under extreme rule. The country you live in has rules, then the state, then the county, then the city, then the neighborhood... Our jobs have rules, our households, language, math, physics, etc... all have rules. Then... people join religions with even more rules. Humans are naturally unruly and self-serving, yet addicted to tribalism, so... the rules are layered very deep out of necessity.

There are now new subdivisions advertising no HOA's to attract home buyers. That's how bad it has become. HOA started out as a good way to keep neighbourhoods tidy property values up. But in too many cases have become a source of over policing targeting certain neighbors ignoring your buddies blatant violations etc.

@@neil999ishI worked in HOA. It's not the HOA board that has the Lawyers on retainer. It's the property management corporation that pays for the lawyers. Just a quick heads up. When you by in to an HOA, your not buying the land only the house. The property corporation owns the land, your just buying the house. So that being said..the HOA board answers and does the bidding of the property management company and lawyers. The board's job is to line the property management bank accounts and pockets. I worked in enough of them and went toe to toe with board members & even the lawyer. I even got 2 layers from a HOA/property management company disbarred in FL. Yeap the only security guy who kept videos, pictures and lots of notes and copies of incident and daily activity reports. In one case, the HOA president was banning the married property management lawyer. In lue of not having to pay his dues and fees as well doing her bidding to go after only certain people. The other the HOA board and the property management lawyer tried to do everything they could to turn the community pool in to adults only. They made the pool club house area a swingers deal with family and kids in the community. She wanted the HOA to find ways to force the family out with kids.. The lawyer, all the board members went to jail most got 1-3 yrs prison time..the community no longer run as a HOA. The city and county took legal action and got the HOA disbanded.

I lived in HOA in Suwanee Georgia. We had a sex offender on the board, and the board tried to use their power to force someone to move. It took us an entire summer, but we finally ended up with enough proxy votes to completely remove the board and put in new people who were just and honest. After that we put our house up for sale and vowed to never live in an HOA again. In today’s climate having a homeowners association actually seems to devalue your property, as no one wants to live in one. As for buying a house, if you inquire as to whether or not it is A homeowners association neighborhood, They are required to tell you. If you feel you’re being lied to simply ask neighbors. It’s always best to meet the neighbors before you buy a house in the neighborhood anyway.

Our hoa got taken over by real estate agents and they hired someone to drive around and charge neighbors for petty violations like a few small cracked paint spots on gates, or a few small brown patches in grass when we r in a drought and it’s the 4th week of 100 degree weather, or having a trash can sitting at curb 2 1/2 days after pickup. 🤦🏼‍♀️ We only moved into an hoa neighborhood because 20 years ago it was run by neighbors complaining about next door neighbors. When we didn’t do it enough, the hoa started getting tough 😡

I got hooked into an HOA, out at Cedar Creek Lake in Texas, I bought a little bitty lake lot, and suddenly I was trapped with taxes to 3 different counties, and they at those tax offices , all had a part in this scam to take advantage of American Taxpayers.....Next thing I know I was sent a letter said I had 24 hours to mow the lot, else they would charge a fee of $ 275.00, I lived 6 hours away from there..... I DONATED THE LOT TO A PREVIOUS PASTOR AT A CHURCH IN Dallas, Texas, Took the whole price of that tiny insignificant lake lot off income taxes, No one would buy it because of the criminals in charge at Cherokee Shores HOA.....The pastor got it, and since a church owned it they couldn't stop him from selling it to an out of state resident I think, don't really know how he got rid of it, but he did because he was a nonprofit organization....I will NEVER have ANYTHING to do with ANY HOA again as long as I live... Ended up costing me over a $4500.00 loss on my income tax that year....Once was enough, I won't be fooled again by those horrible people...I warn everyone to stay away from HOA scams !!!! Had a drunk in charge of the HOA when I first bought into that problem....He took care of all his beer drinking buddies, he didn't like the idea of a Christian family being around interrupting his loud wild BBQ weekend parties with kegs of beer....This has been years ago !!! The music was so loud you couldn't talk to people standing beside you, as no one could hear anything but the loud bass noises......

My neighbor across the street is a past HOA President. She’s never been married (I can understand why) & feels like her duty to walk the upper part of the subdivision to observe & report back to the now Property Management Company on ‘infractions’; but to pry into everyone’s life. She tried to get me hitched to another older women in the neighborhood. Came home once to find dead flowers pulled up by the mailbox & another was pulling up to my home seeing her walk into my yard & pulling down a tree branch she didn’t approve of. I’ve had discussions w/a lawyer & will consider trespassing charges the next time I catch or suspect she’s been in the yard. So looking forward to her passing.

Frightening. I only have experience of an HOA at my friend’s former subdivision townhouse, and she experienced none of this, though I am by no means disputing the claims of these residents as I’ve since heard more horror stories. Hers could sometimes seem a bit high handed but always provided a warning or an update on their portal whenever changes were implemented. I’d been tempted by HOA neighborhoods after visiting hers and seeing how nicely kept and regulated it was, but now I’m rather glad that I did not go down that rabbit hole.

Bad HOAs exist, we had one but we got rid of them. Had corruption, highering relatives, $35000 storage shed that only cost $1200, Theft, and a HOA president that held grudges. Charged my neighbor $1600 for complaining to the property manager about the flooding that cost over $2000000 to those living on the first floor. I was glad to see them go, but it took about 4 years to make it happen. One we have now is good, save one nosey security guard that oversteps from time to time.

I was under an HOA in the past and despised all the rules but based on what I have seen in news coverage ours was fair. They did not micromanage to the point of what flower pots or what flowers you can have and you received a notice to comply before being fined, something that seems not to be the case for many of the other HOA's since no one mentions getting a notice to comply just getting a letter with a fine.

I've lived in an HOA house and didn't have a problem. But, I wasn't given the rules binder (a 3-inch binder stuffed with documents) until I was at the signing. There's no way I could read all that while there and the people there at the signing said they wouldn't allow me to sit and read them for several hours in their office. It wasn't until I was in the house that I had the documents and time to read them. It should be a law that you have to be given ALL the HOA and county documents at the time of offer of acceptance so you have that 3-day window to back out. Those documents should include county docs like flood zone, hazard reports, etc. that I didn't get until the signing. That gives time to read and get answers before being locked in. That isn't the way it currently works. The whole process feels like a huge bait and switch event.

In Florida all a homeowner in an HOA needs to do is accuse the HOA of selective enforcement and prove it. Plus homeowners can go to mediation at zero cost to the homeowner to prove selective enforcement. When that happens the HOA gets fined instead of the homeowner.

In most states HOA board meeting are open to owners recording it in both video and audio. They should never object if not hiding anything. And most associations financials are also open to all owners. Only communications with the association attorney are usually more private. Of course laws vary in different states.

An HOA can work well if there are well-publicized elections held on a regular basis, if their meetings are public with minutes taken, and if all regulations are explained to prospective buyers in the community. An HOA is restrictive only if the members vote to make it that way. Run properly, it's more democratic than most governments!

An HOA only benefits the developer financially. The residents that move into an HOA pay the same property taxes as if it weren't in an HOA and have to pay the dues and special assessments as well as put up with "the boys club" of rules for you but not for me 🐂💩. Been there done that sold it. I was nearing retirement and the boneheads were discussing plans that will cost x amount to do. Down the road I could see problems that would happen, voiced my concerns and was basically told to shut up. Several other things had gone on before this, unchecked dog barking, dog shitting in my yard, neighbors yelling at each other out front, neighbor dumping his yard waste on my property. Nope. That house was supposed to be my retirement home. My retirement is based on a fixed income. I wasn't about to be playing with those knuckleheads and the expenses they would incur because they wouldn't listen this time or in the future. Sold it and now live on 10 acres in the woods. Glad I moved here because people are getting nuttier every day.

in most cases, buyer is supposed to be given the hoa documents after the bid, and BEFORE you close. buyer is allowed to back out of purchase if they do not like the documents. also, buyer is supposed to be given copy of financial statements. since hoa usually signs off on the purchase, the buyer should know in advance if there is an hoa ... also, realtor should make that known.
