This litter warden hasn't got a clue. Handing out leaflets is not an offence. Throwing the leaflets on the ground would be an offence but as it's just an "ACT" they have no powers to prosecute you unless you give your consent. GAME OVER.

I would have thought that if a person who received one of the leaflets from the above man then threw it on the ground, THEY would /should be charged under whatever litter laws we have. I fail to see how the person handing out the leaflets is breaking any laws. If he was, then is stands to reason that all the fast food joints on O Connell St should be charged on a daily basis for THEIR litter ,which is thrown on the ground by customers

Apparently, in this country where nothing makes sense, Dublin City Council think that if you hand out a leaflet and then the person who took it drops it, that you - the leaflet hander-outer - is somehow responsible for the litter. That's like going to the ammo store and arresting the guy who sold the bullet to the man who murdered another man by shooting him. Insane! DCC are also under the false impression that the Act they are referring to (about litter) can not only be construed to mean that a person cannot hand out leaflets, but that it supersedes the European Convention of Human Rights Article 10. DCC should stand for Dumb Clown Circus 8-)

Ah the good old Litter pollution act 1997 :) I remember getting a fine in my door from a Litter warden once because they claimed that I had rubbish in my shed and bins hadn't been emptied in a while and also my Garden was over grown. it actually said that on the fine. I simply wrote back and said that the length of someone grass is not covered under the litter pollution act and also that in order to see what was in my shed or in my bin (the lid of which was fully closed in my drive way), the litter warden would have to come on to my property, which is a private fully owned house and he never sought my permission to do this. they had been threatening to take me to court. When they got my letter i never heard anything again. It helps to be familiar with the law.

I have been involved in a lot of campaigns and I always advise supporters that they can ultimately be held responsible for litter law infringements if their flyers are carelessly thrown about, even if they are not directly responsible. For example people still don't realize you cannot thrust a leaflet onto some one, nor can you put it under the wind wipers on a car. Context is everything and I don't know the full context of this video, what happened before it, etc I am naturally cautious in jumping to a conspiracy conclusion that they are all against us, i.e us who are fed up of a failed consensus of socialism for the rich.

If the Garda knew the law they'er supposed to be upholding then they wouldn't embarrass themselves by getting schooled on the law by law abiding citizens that seem to know the law better than them on the streets! but he didn't know the law John, he was talking shit. He was rambling along about Human Rights and EU law when local law supersedes EU law. All that was said was that he could not allow the paper to become litter. That's all that was said don't break the Litter Pollution Act of 1997. Then he launches into this big "Human Rights" issue. The Garda was being very tolerant and appeared to know the law and was doing her best to de-escalate a situation between a whiny cry-baby and an ignorant lunatic of a litter warden.

It was off camera. Sorry Kathleen but they don't "know their shit". EU law does not supercede local law and IF that chap or any of the other protestors were dropping leaflets then they were breaking the law and name and address can be demanded by the Garda and arrest without warrant can be made if they fail to supply name and address. This is all contingent on an offence having been committed i.e. they must have been dropping leaflets. Perhaps they were not, perhaps that's why the Garda did not pursue the matter.

Actually he doesn't "know his rights" Irish legislation states Litter Pollution Act, 1997 PART II Litter Pollution Generally Prohibitions related to littering. 3.-(1) No person shall deposit any substance or object so as to create litter in a public place or in any place that is visible to any extent from a public place. If he was handing out leaflets and they were being dropped then he is responsible for creating litter So if he was dropping leaflets the Warden and Garda were right

Also according to this law Litter Act 1997 in the section "Offences involving, and powers of, litter wardens, etc." The Garda had a right to demand name and address and could have arrested without warrant both the man with the glasses and the guy with the scarf for interfering. You guys got off light and are too foolish to realise it. I know it is only a "Litter Act" but it is still the law and perhaps they were breaking it. They are exempt from this law if they post the flyers.

People should obey authority figures. I suspect a lot of these argumentative types are spouting their perceived interpretation of the law or the constitution or as a last resort they adopt some freeman notion of being above the law. Gardai should feel free to use brute force and the power of arrest on anyone who disobeys them and the courts should praise them in every case. Compliance with Garda instructions should always be a non debatable duty. They should have the right to appeal a Garda decision in writing after complying with the Garda order but in almost every case the Courts should uphold the Garda decision and no sanction such ever be made against a member of the Gardai for giving an order even if they make a mistake. The Gardai must be respected and they need teeth to be able to enforce the most authoritarian interpretation of the law. Overcrowded prisons should no longer be seen as a problem but as a solution because fifty to a cell would be a good deterrent to those who disobey Gardai and criminals generally. The next recession will bring anarchy and Gardai need to be able to do their jobs without fear of reprimand. It is unreasonable to expect Gardai or even lawyers to know every law and so debating with such people is not an option. If Gardai had the power to thump their skulls with a truncheon it could save an awful lot of time, agro and things would get done.
