In this episode of Know Your Rights, I discuss whether passengers in a car stopped for a traffic violation are legally required to provide ID to the police.

My nephew and I were coasting in his classic Volvo, bearing the marks of our adventurous weekend of fishing and camping. Yet, our relaxed drive hit a snag when he was pulled over for going eight miles over the speed limit. As a passenger, I was asked for my ID, and I explained to the officer that as a passenger, I was not obligated to present it. He insisted it was a state law, but recalling my legal studies at university law school, I couldn't recall such a statute I told the deputy. The deputy gave me a funny look and said not worry about it, tore up the ticket and said watch your speed.

I informed the officer that I studied at the university's law school, but in truth, I wasn't a law student there. I frequented the law school library for my studies because of its proximity to my apartment.

:"Driver" is one who is PAID or COMMISSIONED for it. As in BUS DRIVER, TRUCK, LYFT, UBER, TAXI, POLICE DRIVERS. THEY ARE "FOR HIRE". Your everyday back & forth is "TRAVELING" = PRIVATE, NOT FOR HIRE.. Drivers have Passengers but TRAVELERS have GUEST.. Drivers use VEHICLES or MOTOR VEHICLES but TRAVELERS use AUTOMOBILES.. So if they presume you as DRIVER FOR THE STATE OF....... Ask for verification of INVOICE of money PAID TO YOU BY THE STATE OF....... They can't 😂😂 The STATE aint never PAID you PER HR, OR PER TRIP FOR DRIVING.😂😂IF THEY CONTINUE.. GREAT, THEN MAKE UP A LEIN, BILL, CHARGE, FOR THE STATE OF.... TO PAY YOU NOW. YOU'VE BEEN DRIVING SINCE 16yrs old.. Now your 40, whew THEY OWE YOU BIG TIME.. 😂😂 TURN THE TABLES as they say.. $1,000,000 will suffice Your CLAIM, BILL, LEIN, CHARGE,ETC..

15:30 past curfew? WTF Parents give kids a curfew, Not government. Government does not have the delegated authority to tell anyone when they have to be inside. Thats crazy!

While I live in CT (no stop and ID law), based on your 3 videos and our broad “interfering with an officer” statute, your advice to provide only your name, but not ID, seems to be the best course of action. Previously, I would probably have politely suggested that the LEO kick rocks. Thank you for the legal analysis.

Counselor, I am a layperson but find it unbelievable and shocking that practicing attorneys do NOT FOLLOW THIS ADVISE OR THEIR TRAINING AS A COUNSELOR OF THE LAW when they are being detained and/or arrested and make it on TV…… they seem to be as confused or arrogant as the law enforcement you are eluding to in your videos. And, I don’t believe the cops are that ignorant anymore. They just don’t care!

So if Obstruction = interfering but Interfering = Wrongful Conduct Wrongful Conduct = physical or emotional damage If you ask an officer if you're Emotionally damaging them and they state "no" and you're not physically damaging them, does that throw officer safety out the window?

I will tell you exactly why they ask for the "license". That "license" attaches you to the "Infancy" of the "Birth Certificated Character". That "character" is not you, biologically. It is a "LEGAL FICTION OF THE LAW", a State created and controlled, commercial character that when One lays claim that "Yes that is me Officer", One is agreeing to be the infantile fictional character that the officer presumes to be you and now you must perform. It is all FICTION and know this, "No fiction shall extend to work an injury. Its proper operation being to prevent a mischief or remedy an inconvenience created by the "General Rule of Law." - William Blackstones Commentaries. A "rule" by definition will take you to "Cut". Ask yourself what is a fiction? Look up the definition. What is "The law"? The law of Nature and Natures God, i.e. creation, reality, substance. So, "no license? Well what is "Your Birthday?"" Chapter 12 of the 67th Congress for the United States tells One all he needs to know. "I, for One, am all present and accounted for from fertilization to last breath." I have no "Birthday". Does the "extra-embryonic material" receive the "Date of Birth"? I arrived to the "New World", the air breathing world, whole, as One has evolutionary due process known as the moment of fertilization. To-day, I am always present from the moment of fertilization until this moment now and always present until I take my last breath. I, as One, will always be the author of my story as I am the One authority over my entire biological kingdom and never will I accept a "Prescription" written by another man that will Unduly Influence me and alter my forward progress which is biologically evolving by the day. yes. but vice versa like a non indian getting a ticket from a tribal cop. tribal courts have no jurisdiction over white man or non indian

What about the little speed trap towns? There is one in the panhandle the deputy was supposed to be super cop. I saw him driving in Oklahoma and I was in Colorado so I smoked a marijuana cigar in a smart ellick way to make him mad. He charged across the state line and Cimmarron county couldn't do anything because the fight occured in Baca county. The Colorado highway patrol said it was mutual combat.

In my opinion , at least where I'm at the cops don't have an oath of office and therefore are acting only in their private capacity and therefore have NO authority to do anything. This not an opinion necessarily, It's a fact, the question is can a private individual demand anything from you ie. ID without a Public office. Public means government. Is a verified, authenticated oath office and a bond needed?

What do you mean you don't know? If a court has never ruled that they can demand ID, then there's nothing granting them that authority. Which means you do NOT have give them ID. Remember, consent of the governed and innocent until proven guilty. The default answer is NO.

If I saw a cop car on fire with the cop in it and its a jurisdiction that never gave me any trouble like the highway patrol i would call it in and see if I could get the cop out. If its one of those speed traps I would just call it in keep going

we need an attorney with balls to fight the civil right violations my ancestors did not fight and die for a nazi country where your required to show papers. those cases that lost did not have proper representation. i see defense attorneys like E. Lutz get special treatment from judges and DA''s he has had a long and successful career because he will never go after the police for rights violations or any kind of corruption. so if you pay enough $$ y7our charge will be dismissed or greatly reduced. yet when i told my public defender to do the same thing Ed did they act like its impossible. PD says jail and no way around it but the second lutz is the attorney many options appear. tulsa courts are corrupt as hell

Based on your very handsome beard, cops would say they have reasonable suspicion that you have drugs on you. They also might push you down, handcuff you and beat you because you " fit the description" of a certain terrorist guy who is actually already dead.
