In this episode of Know Your Rights, I talk about Stop and ID laws. There are many myths and misconceptions about Stop and ID laws, so I hope this video clears it up for people.
The short version of what I talk about in the video is that the police must have reasonable, articulable suspicion to detain you. Only after being legally detained, are you at least required to give the police your name. But the Supreme Court has not said if you must give more information and the law can vary by state to state.
During this video, I talk much about the United States Supreme Court case of Hiibel v. Sixth Judicial District Court of Nevada. The deputy in that case had a dash cam in his car, so the incident was recorded. Here is a link to a low quality video from the deputy's car: • Hibel Arrest for Refus...

Bro, two points; thank you very much for your service to the citizens of the U.S. We need more attorneys like you. Furthermore, your videos are not too long. If people complain it is on them. I would suggest they do as I do. Listen to your video while driving, fishing, hunting, working on your hobby, working in your garage, or doing housecleaning. It will make your longer videos much more enjoyable. These are very important constitutional lectures. No one should be complaining about their lengths anyway.

Oh. Also, thank you for my KYR cards. I keep one in my wallet and gave the others to close friends. That was awesome. Greatly appreciate that and that you actually did it. Must have has thousands of request and that's alot of damn stamps, envelopes, and cards that you paid for out of your pocket. Very impressed at your determination and drive to get the word out to people. I consistantly find that people have NO clue what their rights are and end up locked up over the simplest BS they could have avoided just by simply, knowing their rights! Glad to know you're on our side! The police state still continues to grow stronger daily though, it seems.. sigh

One time, years ago, I was picketing a road block. It was the first time I ever saw a roadblock in California, so it was a spontaneous picket. (I’m a teetotaler, but I love our constitutional rights, and I am libertarian when it comes to rights.) I went home and made a sign on a piece of cardboard, came back and stood on the sidewalk, picketing. I got a couple of fingers, yelling to get a life, etc, by motorists and an occasional honk or thumbs up of approval. After a few minutes, a cop from the roadblock approached me and gave me the spiel about not blocking the sidewalk, etc. Then he said, “do you understand?” I replied with my name and address and added, “I’m going to remain silent, I want a lawyer.” I repeated three or more times exactly the same thing.” He then said, “You’ve been warned,” and started walking off. I sort of mocked the cop with my name, address, and assertion of rights as he was walking off.” I would not have identified myself except the cop already knew my name and where I lived, and it was too fun asserting my rights, no matter what the cop said.

I have a question, what if your a passenger in a car, can the police question you? If not, what do you tell them? Also, if a civilian has an intoxicated passenger, can they ask questions/ search the passenger purse? Or if an passenger has a purse, and there is liquor inside, can they still question the passenger?
@DuckinFeloniez

unless youre on paper (parole, probation)... they cannot ask you shit... you tell them "officer, i am going to respectfully envoke my right to remain silently" thats it.... just keep repeating if you have to

Continuously repeat, "I do not consent to search"... that's critical... cuz they'll prob do it anyway... keep saying that... and record on your phone if you have it

if you're 21 its ok.. if its open... not ok... but again... I DO NOT CONSENT TO SEARCH.... SAY IT LOUD ENOUGH FOR WITNESSES AND CAMERAS TO HEAR YOU... You're case will get thrown out in court for illegal search.... check out the ACLU videos

I love Jay and I’m not gay, and I’m a poet and don’t know it. I hope he continues these videos. They are excellent Jay reminds me of Richard Glenn Boire, an attorney, who used to use the “Cops” show to analyze how they are violating the Constitution. This was before KZbin, or at least before I heard about KZbin.

how do people deal with car insurance without a license? and all the other thousands of things in life that seem to require a license?
@DuckinFeloniez
@DuckinFeloniez 3 жыл бұрын
if you dont have proof of insurance on you... TELL THEM "Officer, I am going to respectfully exercise my right to remain silent." and repeat as much as you have to... it he gets hostile... start recording on your camera. if you have it then you have to give it to em... if you don't.... plead the fifth... don't admit to not having it or not having it on you.

I want to challenge that you do not have to have a "personal" license to drive, pilot, captain, operate, conduct, etc. (or any other thing you want to call it) to drive you personal vehicle on the roads? Will you help me challenge it?
@DuckinFeloniez
@DuckinFeloniez 3 жыл бұрын
from my understanding... if you have it on you... you have to hand it over... if you don't.... then plead the fifth ... don't admit to not having it on you. I learned that from ACLU.

I commented on your one of your other videos about I got manhandled in the courtroom by the security guard for standing up and taking two steps forward to ask if I can approach and the judge was on Zoom he wasn't even in the courthouse. Security guard got up and stood I'll be right back to me and stood right in front of me his shirt was touching me and he was face-to-face with me and told me to shut up and sit down and I said excuse me I was talking to the judge not you and he goes who do you think you are so who do you think you are and then he grabbed my arm and make me sit down I said get your hands off of me so he did and then tell me tell me to get out of the courtroom and I sat down and then I to judge let me approach and he freaking condoned that security guard told me I was disrupting the courtroom

Jay what does "abroad" mean? You just can't skim over word because words mean things and you you have to define this word in the legal dictionary because it's a legal issue and it's the letter of the law which is relevant to the issue. Please define in a next video.

Wow when I resend my United States citizenship to a corporation that's trillions of dollars in debt and all that debt by the way belongs to the people and other countries😂 Don't have a driver's license because I'm not dictionary 4th edition, driving is operating a vehicle to make money with it so even if you deliver pizzas we are making money for somebody that is where you need your driver's license or if you're a Uber driver or a bus driver, I'd be traveling and I'd have a passport and a 1099 a in the car car insurance because if you register your car you're giving permission for the state to tow it and everything it's a total in the private if you don't register it
