I took a lawyer class back in high school so I’m gonna break it down as easy as possible. 1. Rainbow Friends came out Nov. 14,2021 for ch.1 2. Fan art of Purple came out during that year. I cannot say if the dev had sketches of Purple during the pre alpha/beta of the game, but mostly like they did. 3. In 2022, Oreo made a design of Purple for FNF for the dev, Roy. However, Roy unfriended him a few minutes later without an answer in August on the 8th. (This is what we call stealing character design and claiming it as yours when it’s not.) 4. Oreo released the FNF version of their Purple model(it’s in the credits), which means, Oreo has 100% ownership rights to their design, even if Roy stole it, there was no agreement/settlement to transfer that ownership. Roy then proceeded to copy strike Oreo for false claims, which is also against copyright law because Oreo never officially sold the character. 5. Oreo made a lawsuit(which is good) to keep his design of Purple(Cause in 2023, it is now the official toy design, not the in game design.) Roy tried to counter and lie on Oreo’s ownership with a counter lawsuit. If anything, Roy owns the vent and hands of Purple, but full body wise in design no, he doesn’t. That design is by Oreo who took inspiration from the fan art and the community of Rainbow Friends. I’m not an official lawyer, but I gave my statement of the matter. Hope Oreo wins this case.

BUT! all Oreo did was create a model of the character, not originally create the design. As kreek shows, there are hundreds of fanart of the community design of Purple, and oreo was simply one of them. Oreo wanted to sell "his" design of the character when you could just look up "purple" and find the same design on images. Oreo used a community wide design for his model of Purple and claimed that he made it, and when they blocked/unfriended him, continued to post it on Twitter saying that they copied him. the creators of Rainbow Friends may or may not have adopted the community design as the official design of Purple, and when PhatMojo created the toys, they used the design because when they proposed the toys design, Rainbow Friends accepted it.

@ True. But when when you are transferring ownership over creations, whether you made it or got inspiration from the community, you have to make sure the final decision is made in the end. Which Roy didn’t. He instead took it without a final say and that is basically stealing. Whether by Oreo or the community, Roy stole it, tried to claim ownership of it and now a lawsuit against him. All Oreo has to do is show the evidence that he made it, used it and have ownership of his 3D model and Roy would be in big trouble.

I’m pretty sure the rainbow friends devs get the copyright to the humanoid slender purple design because at the end of the day, the name of the character is purple. Why are video game companies like this? I mean, I don’t know much about the law, or charges. But I think if they just said “sorry, I didn’t realize you would be so offended by this. We’ll take down the purple toys”, they could’ve avoided being sued and they could keep doing what they were doing

I am with rainbow friends (no favoritsm) but the reason why is that rainbow friends worked on purple like in 2020. Then the game realeased on 2021, but for Oreo’s he created purple from 2022. So rainbow friends created purple first. Oreo has been copyrighted by rainbow friends because of purple. (My theory)

Reasons I am against your arguement: *1.* The jumpscare clearly shows the mouth on the face, while the the fan-art shows the mouth being the whole head. *2.* The body and legs were 100% fan-made, while rainbow friends might have made it similar in a secret file somewhere, it was not offcial until it was made by fans. *3.* They accused oreo of stealing green too even though there is nothing about that. *4.* Oreo did not profit (as far as I am aware) off of this fan-art, yet they, as people who have made thousands off of this game are demanding *500,000* from a person who is probably making like 10-20k per year. This could leave him in dept for years, likely in jail over basically nothing. *5.* They blocked him, if they actually had nothing to hide they'd have no reason to do so. If they thought that the design was basically what they made, they could have talked to him about it and not automatically blocked him. Or they could have just easily bought the design for 20-100 dollars as they are very rich off of this game.

OK personally purple was a fan design, kinda like pink or old yellow. And then out of nowhere like months after this fan design was created, Oreo just straight up said it was his. The creator of Rainbow Friends liked this design, so he used it. This is one of those desperate situations like how Lego sued Nintendo. I think if Oreo sues he would have no other choice but to counter sue. But here’s the thing a lot of other people used that purple design also, he didn’t argue with them. An obvious fact when making a character like purple (only part of it is shown), is to ALREADY HAVE A FULL DESIGN FOR IT!
