Hindi: LETTER-BAAZI is the key for getting REFUND OF TOKEN & BOOKING AMOUNT from builders

Many flat-buyers who book flats are succeeding in getting refund of their token / booking amount from builders, even after they say that the amount has been forfeited. Quite often, builders agree to give back the money only after we publish a video on my KZbin channelToday I want to focus on the numerous cases where flat-buyers have managed to get their money back without making videos or going to social media, based on only email correspondence.
Correct and persistent email communications with the company's higher-ups, and a repeated request to ESCALATE THE MATTER TO THEIR LEGAL TEAM, is very important for getting back your token or booking amount. The emails should repeatedly emphasize the legal position i.e. that until a contract and/or transaction has happened, the builder has no legal authority to confiscate or "forfeit" YOUR money even if it is lying in his bank account.

Sir Very True also when we go to their office they give free tea & coffee tell everyone never to touch these things as they are money of buyers who lost their money to these scrupulous builders, these builders never use their own even 5 paisa to give anyone anything.

In RERA without registered agreement to sale (BBA) , no application fee/form can be used to forcefully forefeit booking amount. If any builder is claiming to do so, a simple legal notice can get you back your booking amount. But if you have signed BBA then you are stuck legally, builder can and most definitely will forfeit 10 percent of the total cost of flat. Be careful , read every terms and condition before signing BBA , if not convinced get it vetted by a legal professional for a fee. Better to pay a few thousands to have a peace of mind then have tension later

hi Sanket, I have given booking amount to a pune builder and the sales guy told me on watsapp chat that if i cancle the booking with 15-20 days i will get refund of the amount i have paid after giving the booking amount i had some questions and when i started asking him specially about the agreement value where he mentioned 5 lakh extra and will not add that in agreement value i asked him to add it he said ok but i will add on to the tazes but during sale he did not highlighted this point untill i digged on it and asked 2 times alter on watsapp and then i decided to cacel te booking on 13th day and then sakes guy mentioned ok they will refund but need hand written letter and cheque will be issues after 30 day and i have to come and collect it in perosn but i live thousands of kilometers away from that city and i told him can i send email for cancellation and my freind can pick the cheque that he said is not thier policy thwy will nt accecpt digital communication as i can claim something later i dont have any allotment letter how can i claim anything i told that i can send hand written letter but please allow the cheque to be picked on my behalf there also he said no its not the olicy and he has not shared the legal team or sales email id he just gave his own email id and he is earlier he said for digital communication he has to check with legal team and later no update on that and keeps on repeating that i have to come and collect the cheque its not feasible for me and even sending hand written letter from thousands of km away wont be cheap i think he just wants to make sure i dont get my amount back so easily

What if builder has got our signature in blank pages in between application form.Can they use it in their favour?

Thanks krishnarao by this technic i got my full refund from 1 of reputed builder which was 1 lac. as first they sent amount forfeited letter due to i signed terms & conditions so they were not ready to refund token amount, after finally i escalate to all government body including CM & rera, mmrda & many more now finally they release my check without any deduction

Sir iam sheetal from bangalore.... We had given the token amount to a builder but after seeing the documents we got to know that its a deviated property and we will not get oc so we didn't proceed further... Now the builder is not giving back our amount

Dear Mr Rao I am doing correspondence with a builder since 2017 and they are not cooperating. They say we will refund but when PATA NAHIN. I have not signed any Aggrement with them. Pls can you share any format of letter which I can forward to them. Regards

Dear Sir, What if cancellation request as per builder form on Notary signed stamp paper has been submitted with reason of financial constraints etc. In my case no response has been received so far even after 8 months of my cancellation request
