I am in Halifax, Nova Scotia, Canada. I actually talked myself out of getting a possible DUI charge, BUT I was NOT drinking...not a drop. I have been educating myself for over 10 years on Canadian Law and mostly interactions with police on different levels. I was stopped very late at night because I get off work at midnight and like to unwind by driving around my City while enjoying a coffee. Even though the police need no reason to stop you or give you a DUI test, he said I was driving very slow past the closed businesses, so I looked like I was prowling. I know how to keep a cop calm, as he approached my car, I had all the tinted windows lowered, all dome lights on, paper work on the dash, and my 2 hands protruding out the driver's window to show I am not concealing anything in my hands. He asked me for my paperwork, then asked where am I coming from. I explained to him that, respectfully, I will not answer any questions not relevant to the traffic stop until the traffic stop has been concluded. After the traffic stop has concluded, I will then ask you if I am still detained, and if you say I am detained, I will explain that I have nothing to say, and that I would like to speak to a duty counsel lawyer as soon as possible. I then said that I will be timing the traffic stop to determine if I have grounds for arbitrary detention if and when I file a police complaint with the Halifax Police Complaints Commissioner's Office, 1692 Hollis St, Third Floor, last door on the left. He then became "slightly" agitated but still respectful and asked if I had been drinking tonight, I remember reading that it's in my best interest to answer that one question, even if I don't have to, so I quickly said "No". He then said that he is going to perform a Roadside Sobriety Test on me and for me to exit the vehicle and stand in front of his car. Before exiting my car, I raised all windows, turned the dome lights off, locked the car with the valet key, but left the ignition in the "on" position. As soon as I got out, he asked why do I have my phone on a lanyard around my neck. I said I am recording him and that Canadian Law stipulates that I can record a police officer in public in the course of his duties, as long as I don't interfere or obstruct ... I said having my phone on record, on my chest is in no way interference, if you think it is interference, please call a Supervisor. He attempted to administer a nystagmus test, but I interrupted him and said that I prefer if you continued the test in front of my car instead of in front of his car. He asked why...I said there are a number of reasons, you have flashing lights on your police car and your headlights are still on, and I would be facing traffic, facing oncoming headlights at night, all of which can cause a false positive when administrating the nystagmus test...or do you want me to fail? He said " Well, why in front of your car", I said that I can turn facing away from your cars lights then, and I have a very high quality, 1440K 60 fps dash cam that is still running ( I left the key in the "one" position), and I would like to record the actual SRST procedure. He said that I already have my phone on record, what's the sense? I said to him that I am forced under Canadian Law to take this test, but YOU are obligated by law to perform this test flawlessly. I then said that there are 25 steps alone that you are required to perform in order to JUST administer the nystagmus test alone, 25 is a lot of things to remember. Failure to hold the pen at the proper distance, moving the pen too fast or too slow are just 2 of them, and of course, the dash cam and phone will record if you make the mistake of "looping." He hesitated and then said to me with a half a smile " Are you a lawyer?" ...I said " No, I am NOT a lawyer, I am also NOT a chef, but I can cook a roast perfectly." He said that he is concluding the SRST based on the fact that he is satisfied that I have not been drinking. He said that I am " sure-footed", no glassy or watery eyes, no muscle tremors, no signs of agitation and definitely no signs of slurred speech, and he mentioned that my car's paperwork is in order, my driver's license has no prior infractions and my car is in proper mechanical order. 10 YEARS, I have been educating myself on police interactions with the public, and it kinda paid off that night. I have practiced performing roadside sobriety tests over 200 times now, so that I will not be suckered into their " divided attention" tests in the dark of the night. PS: To anybody not Canadian reading this, as of 2018, in Canada, the police can now stop you for no reason, just to check you out, and they can demand you take a roadside sobriety test, and also demand a breath sample from you. You cannot speak to a lawyer before performing these tests. If you refuse, not only are you instantly charged, but all your fines are now doubled. Only under reasonable suspicion can Canadian police demand you take a roadside saliva test to check for consumption of drugs.

Do you also try to get people off who have caused an accident where innocent people have died or been seriously injured and children no longer have a mother or father and lives are changed forever. God forbid the police didn't dot an I or cross a T the proper way. Will you be there for them, do you visit the victims in then hospital or go to services of those who have died or do you spend all your time looking for typos in the state's case and getting your clients off so you can charge the highest fees? Something maybe legal in a sense but it does not make it right. Personal accountability sadly is rarely around these days and we look for ' outs ' instead of owning up to our actions.

@Jeffrie_Baer7 ай бұрын
@@BryanKirch I totally understand. We learn daily. Anybody at any given part of life, is growing. Sometimes it just takes a little patience to get there. I was just thinking of the scenario of the fact that we have all these bars open at any given time and everything available to us. You know people are out there at least having a few above the limit and driving. The statistics just tell us this. That's why it's so easy to get out of control and upset over a simple scenario. I have known to be wrong many times throughout my life. I like the tasteful way that you brought up this point. I was being totally childish. Was probably even drunk at the time. I guess I have been through so many traumas, so I was looking for an easy way out. That's what we need these days is understanding for each other and to see our different point of views. Thank you. Sometimes I just feel that we are over complicating things and simplicity feels so good.

@@BryanKirch I really understand. I just made a comment to a friend that I went to school with that is now a great author. He wrote a book on PTSD for soldiers called the mirror and he did a sequel called the broken mirror. His name is Billy Stevens. When I told him a basic overview of my worldview he said that I could be a novelist and to take notes on things that come to mind. I'll try to see if I can post what I originally said to him as to what is going on with the world in general right now.
@Jeffrie_Baer7 ай бұрын
@@BryanKirchokay, here is what I said that he feels has potential... The current time we live in, there's no such thing as worldview. There's only one reality and play that is happening right before our eyes. Back in 2020, principalities and Powers were summoned by Satan. The whole world stopped. Why, because people that don't understand will not follow the word of God and are easy puppets for The Prince and power of the air to control. Think about this. There was not one group of people that did this. When Jesus was tempted by Satan to gain the whole world, it's his to give. The same distraction is happening right now before our eyes. At the time of the falling away of the church, the Antichrist is revealed. That has already happened in the late 80s. The Antichrist was being interviewed by Oprah and many other people asking whether he would like to be president or not of the most powerful, in appearance, country in the world. At that time, he said no, but he was still commenting from the sidelines. He became president once and will come to power again. I can't believe that people can't see what is really going on. It seems so obvious because we have Hollywood and all these other distractions. It is literally playing out exactly the way it said it would. EXACTLY. Fast forward, the Antichrist will come to power again. When he does, he will make a covenant and break it halfway through. Don't believe me? Watch how it plays out. The US dollar that is the standard for the world will fall. Cryptocurrency will come into play. With cryptocurrency you need no bank. Just a string of letters and numbers that is your "Mark". It can all be tracked through the blockchain. If you don't believe this again, research it. Money can be turned off just like that. Every "wallet" can be tracked with every transaction. The image of the Beast (Beast being a kingdom), will probably be artificial intelligence. It was given a mouth to blaspheme God. What do I think we should do? Exactly what Jesus said to. Love God with all of our heart and our neighbor as our self. There's no time to be distracted. This is going down worldwide. It is extremely serious and determines our Fate for all of eternity. I am not saying this because I want to influence people one by one. I am saying this because it was shown to me, and I care. Not trying to one-up anyone or anything like that. We are all in the same boat. There is one major narrative going on right now and it just has been exposed. It says in the last days the love of many will wax cold because of so much violence going on. We are seeing that as well right now. People have been lovers of self and not God, including myself. Just like it says, people will say Lord Lord I did all this stuff, and he will say I never knew you. The most important thing right now is, Does Jesus know us? I know this is hard to comprehend because of all we've been conditioned to. When I say that Satan is the prince and power of the air, that includes airwaves. He has built a web all over the world because he can't be everywhere at once. He is influencing us through all the media that he has available to use. Please take heed. I have nothing to gain. I love everyone. I'm just saying before anyone loves themselves, the left or the right, play stand back and think of this whole scenario. It's much much more serious than what we could ever imagine. Please tell me what you think.
