9:54 If the client does not testify in these, especially if it is a he said/she said it will most likely be FATAL to their case not to (you have a right to silence yes but not a right to be not falsely convicted). Remember this if you are ever falsely accused, and no lawyer worth his or her salt should ever tell you otherwise.

@@anthonyayala2412 No, the defendant does not necessarily win if they testify. But if they don't testify in case where credibility is important, their lawyer needs to do a very good job in cross-examination, and/or the complainant needs to be a poor witness.

He said 1000% right , a liar can seems very truthful on stand , and people who told the truth could look like a liar . The prosecutor would even lie on the stand and hide without evidence that’s good for you to make you look as bad as possible , they only want to win , they don’t care if you innocent. And if you have a public defender or a bad lawyer , May god help you out , because they won’t do shit for you . I have been through all those , I know exactly what happened .

Do you ever feel like a shitty person for defending sexual offences that you know were true? I mean, getting a rapist off of a conviction? I know everyone is entitled to a fair trial, but if someone has raped and violated another and you KNOW they did it, how do you sleep knowing there is a victim of the worst kind of violation has been ripped to shreds so you can get their perpetrator off?

Because there's levels to want the truth is. That's why the government has to prove beyond a reasonable doubt that it was actually rape and not just a regret. I have a friend that got charged with R and at the end the video surfaced of the girl helping his drunk ass up the steps. The next morning he walked her out and they hugged and kissed and laughed and talked before she got in har car. That morning she went to the cops and told them he raped her and if course they found his DNA inside and all over her. How is he guilty?

They are treated appallingly during the court process and very often end up seeing their attacker walk free. In the UK, where I'm from, only 1% of reported rape cases in end in conviction. You can't honestly think 99% of these people have lied? If you honestly think that your friends experience is the norm you are completely delusional.

For many women, our fear response is to appease the one hurting us. It's a survival technique. Instead of escalating the situation, they will do exactly what is asked of them. We appease the one who hurt us, so they won't see us as a threat .

So, "know is true" is the key words here. If the accused is denying it, then the lawyer doesn't know it's true. Sometimes it's more obvious than others, but there's strange things that happen in this world, and sometimes this is one of those strange cases. Most cases, there's nothing that makes it clear what really happened. Having said that, it does take a certain ability to isolate emotional and empathetic reactions to do that job. For some, it's being able to hang on to "everyone is entitled to a full and fair trial" as an absolute principle. Think of the ACLU defending terrible bigots, because they believe in the principles of free speech, free association, etc. However, there's a high degree of burnout and addiction in criminal lawyers, both defence and prosecution. That's likely a contributing factor.

A loved one that's going through a sexual assault case there's no physical evidence it's going against his word and her word there's no evidence all they have is the police video tape and cassette tape with a person confess that they did it and that's all they're going on they tried to give the person a plea bargain of a 4 years deferred but the person is going to take it to trial next week on the 24th and the person pleaded is not guilty

Hold on....if your client says they did it, they sexually assaulted another person you just say ok, we are going to defend you the best way we can? What about human ethics? What kind of person defends a person that admitted to sexual assault? You are literally defending injustice and you are in the justice business? How does this make sense? can you please explain? I mean, that's their job. If the client is paying them, they are willing to take this case and the client wants to plead innocent they still have to defend them. On the other side what about all those people who are wrongfully imprisoned? I agree that it probably isn't "ethical" but if they choose to defend this person and they may be required to if they're employed by the government then they have to do their best to defend this person no matter what awful crime they commit. There's a reason that attorneys get a bad reputation, they both wrongfully convict the innocent and let murderers go for a living but without them there would be anarchy. It's like if you got paid as a taxi driver to take a person who was racist, homophobic, etc. You wouldn't want to but it's still a required part of the job, unless you wanted to completely refuse to do it entirely then it's what you're getting paid for.

If your client tells his lawyer he did it, the lawyer can't represent him unless he pleads guilty. Lawyers can't knowingly let their clients lie in court.

Excuse me, but win the case means to put the rapist to the jail, not to save them. So, it would be correct to name the video how to save a rapist from the law...
