I am going to request for change to 'Adjustment of Status' and file i-485 for her. I have a question about my mother's Birth Certificate which you said would be required for i-485. I was going through the travel.state.gov website for India (travel.state.gov/content/travel/en/us-visas/Visa-Reciprocity-and-Civil-Documents-by-Country/India.html) and the instructions about Birth Certificate state the following : **"Alternate Documents: If an individual is born after April 1, 1970 and is unable to obtain a birth certificate, the individual must obtain a certificate of non-availability from the local authorities with jurisdiction over their place of birth. In addition to a non-availability certificate, the following documents can be accepted as secondary evidence:" ** My question: 1) Given that my mom was born in 1941, is a non-availability of BC required ? Per the above , it looks like a certificate of non-availability is required only if the applicant is born after April 1, 1970 and doesn't have a Birth Certificate. Hi Kseniya, thank you very much for videos related to I-485, as they're very detailed. While collecting documents to apply for Adjustment of Status for DV lottery, I have found the following information regarding a document I have to submit: "If derivative applicants are filing Form I-485 based on the principal applicant’s Selection Letter, you must provide evidence that the principal applicant included the derivative applicants in the entry when entering the DV lottery for the current fiscal year." Frankly speaking, I have no idea what it means since DV entry itself did not allow to download the entire Application, and on submission confirmation page my wife is not mentioned. Probably you have an idea what are they mentioning? Appreciate your help.

Hi Kseniya, very informative video. If you are an immediate relative (i.e. parents) of a US Citizen, then I believe you can still apply for Adjustment of Status even if you have overstayed in the US.

If you don't send it after the rfe,your case will be denied! Many send the i693 to avoid the rfe because depending on the IO(immigration officer), they can take 1 day-12 months to accept it...

Hi Kseniya, I don't know if you can help me on this subject but NVC has been rejected my divorce certificate 3 times. They required a FINAL LEGAL DIVORCE DECREE. In France since 2017 when spouses are agree to divorce by mutual consent the divorce is pronounced by a notary and NOT in a court. The only three legal documents that spouses have in their possession are : the divorce contract provided by the lawyers, the divorce certificat provided by the notary and the mariage certificat with mention of the divorce provided by the city hall where the marriage took place. They rejected all 3 documents. I have no idea what to provide so does my lawyer who pronounced the divorce. If you have any idea that would help me I would be very grateful. Thank you Emmanuelle

Would this proof of legal entry have to be the latest entry into the U.S.? I have a situation in which my latest entry was actually crossing into the U.S. by car (coming back from a trip to Mexico), and the border officers didn't give me anything like a stamp but it's on my travel history on the I-94 website. My last I-94 was the entry before that when I few into the U.S. through Chicago. Do you think I should provide the travel history in addition to my I-94 from entering in Chicago? Thank you so much! I am in the US filing an i-485 (following an approved i-130 petition through consular processing in Australia). If I file for an i-485 (adjustment of status), do I still need to travel to Australia for the interview (with my US citizen wife)? Or does that interview occur at a USCIS field office here in the USA?. I also want to know if I need to send original letterhead documentation (with a hidden USCIS seal that can only be seen when holding the paper to the light) of my i-130 approved petition, as it was addressed to Australia when we were both living there doing consular processing (My wife is a US born citizen and a dual Australian citizen. I am an Australian citizen by birth with no other immigration status, other than a B2 tourist visa for medical reasons). I have an email copy of that approval notice (I know that an i-130 approval is not required to file an i-485, just one that is pending). Is that sufficient? This notice also has my old Australian address on the top when I don't live in Australia anymore (neither does my US citizen wife) I've been told by other legitimate sources that I file i-485 (Adjustment of Status), i-765 (employment authorisation), i-693 (certified medical doctor), i-131 (advanced travel parole, to return to Australia, if needed and not have my Green Card application cancelled or rejected). I do this all at the same time and only pay the filing fee for i-485 (excluding the medical, which may have private charges)

Hi Kseniya, awesome videos. I could not get information on this but is the marriage certificate of my mother required for I-485 if filing for just her? My sister is petitioning for my mother only and we were unsure if we also need to submit her marriage certificate since we realized she has her surname spelled wrong (also wromg surname of her father) in it. If yes, what other evidence we can support to prove that the spelling was a clerical error it is indeed my mom in the marriage certificate?

I do have a question, if anyone can help. A lot of these documents are submitted with I-130 and I-130A. Passport-style photos, I-94 verification of legal entry, copy of passport, etc. Do we have to resubmit all of them another time to be mailed with the I-485, or will the receipt number and copy of the I-130 refer them to those documents and photos?

If submitting 130-a online you submit the required items. For the i485,you'll need copies again for the required items of the i485. Same thing with the i765,i131

Hello, my wife's I131 approved and sent out but to the wrong address. We are able to see that in the digital version of the document that it was mailed to our same street address but to the wrong state. We had already updated our new address but it registed as Illinois instead of washington state. The case is closed but it looks like it may have been sent back to uscis as the address was not a physical mailbox rather just an empty field with no house. Would you simply send a letter to uscis and state that the address was wrong and that we never received it? Thank you!

Вы только можете подать на неё I-130. Братья и сестры гражданок сша не могут подать на adjustment of status пока не подойдет их очередь в визовой бюллетени, что сейчас занимает 15+ лет. Dear Kseniya, I submitted all forms for my spouse as a petitioner before april 1st , they were all accepted. They also scheduled his biometrics immediately after 2 weeks. I opened online account and see all the forms there. However it worries me to see that they uploaded only one or two documents per form out of so many that I as a proof in paper. Do you think I should upload all the documents that I already submitted in paper? Or they usually randomly upload just a few as they have it all in paper? Please advise. Thank you so so much for your videos!! we are ready to turn our packet in a few days but I am unsure about a few things. i am a US Citizen sponsoring my husband (we’re both living in the US) for adjustment of status (he has DACA) and has re-entered through advance parole. -Household size: 2 (me & him) im also using his income to supplement mine. Both combined is 99k/yr. But in our tax records, he used his old address and put his brother as a dependent (because he was providing support for him majority of that year then we moved out). This old address is listed on the application as well but now we live in our current address (new one). Should we include his brother for household size because of the tax records (even though he lives in a different address) ?

@Kseniya I am a big fan of you. Could you kindly help me with some information since you know a lot about this adjustment of status things? I am on an F1 visa, and my spouse is a US citizen. I have a legal status here and planning to file i485 now. Before coming to the USA, I got married to him in my home country, and I disclosed all of this information when I applied for my F1 visa. Now, do I need to keep my Sevis active (continue my study) after filing the form i485, or as an immediate relative of a US citizen, am I allowed to stay with him without continuing my study (F1 visa's condition)? Your help will be highly appreciated.
