In the suit of cancellation of instrument in civil court , Summon witness was a government hospital doctor who appeared in the court only once and signed in the interim order to ensure his presence...after that he never appeared on any hearing for next 6 months ....civil judge didn't apply order 16 rules ...no proclamation..neither bailable warrant nor non bailable warrant issued ...rather evidence of Doctor was declared unnecessary What law states
