A homeowner is up in arms after he says his neighborhood association crossed the line. The HOA even admits that a previous board used Google satellite technology to scope out violations.

Andrew Murphy A neighborhood starting an HOA cannot force you to join it. As long as you don't pay the HOA statement and decline it you would legally be outside of HOA control. If you buy a house in an HOA community you automatically join as a condition of sale. What I learned fighting my neighborhood HOA.

I bought my house and property in a lumpsum paymet at auction when the previous owner was declared bankrupt. Turned out no one from the HOA showed up at the auction, so after the deed and all the titles were officially transferred to me, I get a letter from the HOA with a contract saying I have to sign this to live there. Called up my lawyer to have it checked, turns out, no I don't have to sign that. The HOA should have come to the auction and should have bought the property if they wanted to stake a claim to it. But even now, almost 5 years later, I still get people from the HOA at the door telling me my house is in violation of rule X and my yard in violation of rule Y, and I have to get it sorted or they will do it and bill me for the privilege. I don't even bother arguing with them anymore. I just straight up tell them to get off my property and if they don't I call the cops. I bet they are going to freak out next summer when I start replacing the 30 year old bitumen on the roof with EPDM.

They think that because the house was originally in the grasp of the HOA when it was auctioned off, they still think it "technically" belongs to them even with papers saying otherwise. The HOA is just trying to pressure you into signing so they have "control" over something that they used to own so they can get money off of you...If they decide enough is enough and try to take you to court over this then they won't have a leg to stand on, sure they can say "it was originally in the HOA sphere so technically it's ours" but you have the deed and titles for it...judge might just say "Why weren't you there when you KNEW the house was being auctioned and you wanted to keep it in the HOA?" and dismiss it.

A swimming pool increases the value of a property, which is the goal of the HOA -to maintain and/or increase the value of the collective group of homes and to insure that one particular home does not devalue the surrounding home by poor choices of the homeowner.

Daniel Broderick yep I agree. The way the shed was maintained and the way it looks definitely didn’t decrease the value of the property. It fits the philosophy behind an HOA and therefore should be allowed.

Liam I don't want my property value higher. I bought to live and die in then leave to my kids. It's a home not an investment. Plus higher value means more taxes. What they really want is control over other folks lives.

my dad built a house on an open field out in the country. his yard was about 3 acres. 2yrs the rest of the field was turn into an hoa subdivision. he never signed on to the hoa when they moved in. they started harassing him about the size and location of his garden, parking his trailer on a extension off of his driveway he built specifically for it. then they tried fining him and evicting him. well a judge over turned the hoa's demands. well they still kept harassing him, so my dad went and bought the mineral rights to his property. he then went to the next hoa meeting and addressed the council. he told them that if they didn't stop harassing him that he would demolish his house and turn his property into a gravel pit, and reclaim the road that originally went just to his property that he still owns which the hoa stole and turned it into the main entrance to the subdivision and make it the main entrance to the pit. the hoa sued my dad over this and my dad won. the stopped bugging my dad after that. my dad then run for hoa president and won that also. he then nullified 90% of the rules and hoa are now only used to help the subdivision. the hoa board are not allowed any cut of the funds, no matter what now. 2 of the board members quit after that.

ben hawke in Texas it's against state law for any hoa board members or employees to collect any monies or salaries. Hoa positions are considered voluntary and the state made sure that it stayed that way

A couple years ago me sister went to a open house. While she was there a man was signing papers on a million dollar house. All of the houses are surrounded by a large tract of land. My sister asked how much land is yours when you buy the house. The lady said 1 foot around the house, the rest is owned by the HOA. The man looked up and said what. The lady went on to explain that the land was still under development and not all of the houses were built yet. Most of the houses were going to be about a driveway apart from each other, with the driveway being owned by the HOA. At that point the man turned to my sister and said thank you, while he tore up the paperwork.

Buidalot I have a friend who lives in a community with that rule as well. They must park in the garage, which is what the driveway is for. I would never live in a community with that rule. HOA's are the worst.

People R. Animals Recently I was looking at moving to Utah to live with my girlfriend (she lives in a suburb of SLC) and all the houses listed were in HOA’s I told her nope you’re coming here instead cause I refuse to live in an HOA, not even love could make me live in one.

I said this to her “haha... soo every house is in an HOA... change of plans you’re coming here!” Currently she’s being stubborn, but I ain’t living in an HOA even for love!

When you get fined for your lawn not taking the approved sod, or for having a fixture that was installed prior to the HOA being brought in and you joining it, or any of the other hundreds of asinine things that HOA's create for no good reason, that's the problem.

Tim Brown Seems this is an issue for homes in subdivisions. This is new to me. The city where I live I only know of something like $30 a year per house for the pool area or something like that. One of the main reason I live in a condo is because I hate mowing and such. We have workers that do the mowing,landscape,maintenance,etc..paid for with part of our condo dues. There's an inspection before you sell and things have to be corrected at owner cost such as removing that storage unit. Actually you won't be allowed to put it there to begin with my HOA. Pretty strict condo HOA where I live which is why there are very few kids here and a waiting list. Only work against you here when you don't abide by them.

The elusive Bigfoot that is a *good* HOA story: I helped form an HOA several years ago, to force the land developer to fix the goddamn sewer system. It was a private system we all paid into and its maintenance was part of what we were paying for, but he preferred to keep the money for himself. So when it eventually got broken down enough to stop working properly, instead of fixing it he just pumped our sewage into the creek that ran through the neighborhood. 100 households or so, and he pumped sewage from about half of them into a designated scenic waterway without their knowledge, for months. He'd set up the equipment in the woods downstream of us to hide what he was doing, so we didn't know about it for a bit. Boy Scout troops and weekenders canoe down that creek, goddammit. We swam and boated in it all summer. And he gave zero fucks and told us we'd have to sue him to make him do anything about it. We got the state DEQ on his ass and due to the severity and duration of the violations they hit him with the largest waterway pollution fine imposed on an individual in the state's history and made him fix the shit. Pardon the pun. After that we didn't have much HOA business to attend to so we just met to have BBQs and bonfires and drink all the beers. He was also into real estate fraud, sexual harassment and assault, trespassing, multiple physical assaults (including beating his wife in public), wage theft, abusing his employees, etc... a true buffet of fuckery. A few years after the sewer incident was resolved I moved out of state, and the day he died my phone rang off the hook from old neighbors calling to make sure I heard the news, and to celebrate. Fuck that guy. His name was Lawrence Elliott and he can rot in hell, but by god we got our creek back.

robert karas they may have fees for a company that comes and cares for your front lawn so it's never in violation. Plus they may Paint and clean the outside of your house. I've lived in condos where that is the case and while expensive, it's worth it to me as someone with a disablilty where I would otherwise be expected to do it. (Where I live there are city bylaws about keeping your yard nice.)

HOA's reports on their do's and don'ts so everyone is on the same page. If a certain color combination is allowed for painting your home, you agree to follow that. But in a non-HOA community some clown next door decided to paint his house black and weird stripes, good luck when you decide to sell your home.

Not all HOA’s are the same. Some are super strict & overpowering, others are very mild and only get on you for things like leaving your front yards looking like trash. Something I actually like about HOA’s. I don’t wanna live in a nice home while my neighbor just lets his house go to shit, meanwhile decreasing MY property value

The authorities are useless. Here the HOA will simply have you thrown out after making your life near impossible. They don't play around which is why some here like them. We want peace and tranquility in our homes but some neighbors mean to make your life hell. That's when HOA's are useful.

Well why not? Sometimes it's worth the hassle. I live in a home run by an HOA and we have not had any problems, We have actually noticed over the year we have lived here that the HOA doesn't enforce our street at all really, And even if they did we ask the HOA for permission to park on the road for parties, Park trailers and tow trucks their all the time and they grant us permission to do so no problem.

jeff Webb My family has moved a lot and never into an hoa neighborhood and not once did we ever have neighbors who leave junk cars in their front yard. If you are so worried about that happening that you would willing be told how you can control your own home then that's proof you're a fool.

Thirty years ago I was looking at homes in a new development in my town. All of the lots were one acre. I commented, "That's nice and big, I could put up a nice shed." I was told that sheds weren't permitted. That blew that development for me. Later I found out that many people got around that rule buy building "playhouses" for their kids and then using the playhouses to store lawnmowers and other such stuff.

I rented a duplex in an HOA neighborhood and kept my tent trailer in the carport when I didn’t use it( keep in mind I used this trailer regularly so it wasn’t trashed and got regular maintenance). Got a notice saying that it wasn’t allowed to be there and that I’d be fined if it wasn’t moved. Keep in mind 5 other neighbor’s car ports were filled with junk, boxes and rusted out cars that would never move again if they tried. I told them they’d have to enforce this on the other residents who’s carport was is much worse shape than mine. They attempted to tow it in the middle of the night not realizing I had it locked down tight. Woke up everyone in the house. I reiterated that if want my trailer gone then they’ll have to enforce their rules on the other residents who didn’t care what their carport looked like. They eventually gave up.

My HOA threatened to tow my pop up camper from my driveway. While I was on the phone with them I used my cell phone to call my local police department to inquire if my HOA was allowed to tow anything off of my property. NOPE - in Texas that is still considered theft. I was even told that I can park my RV in front of my house and the HOA can not do anything about it because it is a public street.

@@JenniferPerryMyScraproom exactly, thats what people don't seem to understand... just because a neighborhood gets an HOA, that doesn't mean the roads go from public to private. The roads will always be public, unless they are bought from the state/city; though, I would think most states/cities wouldn't sell the rights of the street in a neighborhood anyways. The HOA can, technically, own the properties in the neighborhood, but they do not own the street. Gated communities are a different story, as those communities when they were built bought all the land and then laid out the neighborhood so those communities are completely private. But just regular, non-gated neighborhoods, those streets are 99% of the time still public and the HOA can do nothing about it. The HOA only is able to enforce street "ordinances" in their contracts because homeowners in an HOAs tend not to look things up, or dive too deeply, until its too late and by then its very difficult to kick an HOA out.

Many people buy into HOA properties without any knowledge of what kind of power they have over them. At closing so many documents are being pushed in front of you for you to sign that most people just do it in a daze to get it 'over with'. The very first thing you should tell the realtor when they are looking for a home is that you do not want to see any HOA governed houses! Avoid this headache by not buying into it in the first place!

+thelaughingman- Yes...some are bad like the one featured here but I must say that most are good. You just really have to read the HOA documents and ask homeowners in the area if you are considering buying in a place with an HOA. I never lived in an area with an HOA and was definitely opposed to any such thing. Then, in 2009, my wife and I ended up buying a house in an area with an HOA and I was very nervous about it. We've been here 7 years now and our HOA is great...nothing like this one in this video. Ours is more of a sanity check with common sense rules...and they do a great job with the community. I think the key is having the right people on the board...ones that represent the homeowners interests well. Lastly, no news station would feature a story about a good HOA that is doing exactly what it is supposed to do...there's no story there...you will never hear about those HOA's. So, you will only see these bad examples in the news or on YT.

It's nice that you have a decent HOA... now. There's no reason that can't change though. A new board could easily change the rules and begin enforcing those new rules as well as old rules in ways that you don't anticipate. I wish you all the best with your HOA but I'll never take that risk.

when i was in an HOA subdivision couple years ago, total nazies.. i have a few drones, including a mavic pro, the HOA tried to get me arrested on invasion of privacy a few times, failed miserably once they managed to get money into police's pockets they also learned the its a federal jurisdiction and they have zero control over a drone situation.. then HOA came back to me paid me to help them locate violators with my drone.. agreed to help out, all i did was document board members violations with my drones... corrupted HYPOCRITES.. not only that they tried the excuse on me and the other people that lived there that came to put in a vote fore things, that it was one like this short period of time, 3 days excusable limit, i then showed them screen shots off my ipad at the time.. that it was sustained issue for months! trash in yard wasn't even blowing away after storms, un cared for back yards, hidden sheds, wood piles, rusted parts, and shit under back decks.. even garbage cans untouched and full that existed for months in backyards.. then also thing universally unapproved of, like beekeeping in one property that leader of the board had, and it was active.. good news was the vote did change leadership and half the board members stepped down, bad news is the nazi regime continued to harass everyone, just little more lenient until the last winter i lived there when they started demanding things and even threatened to evict me from my house i owned for not clearing sidewalks, btw not our job.. and the house..i owned outside of HOA..i never took them to court on things,. i know i could have and won money.. but for me it was sort of entertaining, i knew they cant touch me legally, but they think they can...so gave me something to do as i was pissed off at end of the day after work and a place to vent my frustrations in cunning ways..

I heard that the HOA's will NOT be allowed to monitor your bathroom and bedroom for now, but of course will be allowed full access to the rest of the home's interior to make sure your house isn't turning into a "Hoarders" nightmare or a place where kids don't pick up all their toys.

It's part of the deed for the property that it is covered by a mandated HOA, buy buying you're obligated by law. people get all worked up about them - the whole idea is to keep the place looking decent for curb appeal on resale - that and the maintenance of commons grounds of the neighborhood like pool, walksways etc..

SpencerFcp HOA, may start out for good reasons. But in time, power corrupts. Maybe new people get voted in and they it all goes to hell. Why should you ask permission to do anything on the land and house you own. Let alone a public street? Can’t part out on the curb. Can’t park in your own driveway. Park in the garage only. Can’t put up satellite dish. It’s cable only, and generally some deal they signed with the cable company!!! It’s all a huge scam. I’d rather my neighbor had a couple cars on blocks next to my house, with 8 foot tall weeds than belong to and HOA. Besides the city would take care of a issue like that anyway. No need for a HOA. It’s a power trip for a small group if people to control your life. Sounds like a living Hell to me.

It is time to write a federal code of real estate law regarding CCRs and HOAs. This must be done on human rights grounds so that the new code of real estate law can supersede existing contracts and deeds and impair them when the terms of those contracts and deeds violate basic human rights. There should also be other provisions to protect owners of real property from other abuses such as adverse possession and intrusive private surveillance, photography and video. The new federal code of real estate law should include the following.: 1) A sale of real estate confers total ownership of the real estate to the new owner. There can be no hidden liabilities or limitations placed on the ownership. Mineral rights or other special uses of the land shall be a part of the ownership. All past splits of mineral or other rights shall revert back to the current land owner or new purchaser. Property rights shall extend from the depths of the Earth to the reaches of the sky, with very few exceptions. Only bona fide military, general aviation, and commercial transportation flights shall be allowed over private property. No unauthorized spying, photography, video, drone, RC, or other private flights should be allowed over private property. No exceptions should be made for private satellite companies, no matter the nation. In the case of satellites, some limited resolution to about 2 meters or so could be made. No private entity should be allowed to use or benefit from aerial surveillance of private property, unless contracted by the owner. High resolution imagery to better than 2 meter resolution of private property by private entities must be banned. No private entity should be allowed to post or obtain for public display aerial imagery of better than 2 meters surface resolution of private property without written permission from the owner or a court issued warrant allowing a law enforcement agency to contract the private entity. No intrusive imaging techniques should ever be allowed to any private entity. 2) Adverse possession, easements, and other usurpation of real estate by outside parties shall be severely limited. Any adverse possession or granting of easements of real estate through open, notorious, hostile, adverse use or occupation of the real estate by squatters or other nefarious usurpers should only be conferred after a minimum of 20 years of such activity. There should be no more short time frames for adverse possession or easements allowed. Any claim of adverse possession should required to include an act of due diligence on the part of the adverse party to locate and contact the owner, make reasonable offers of purchase, and afford the owner endless opportunity to say "no" to the adverse possession or easement. Any attempt by the current owner to say "no" to an attempted easement or adverse possession shall suffice to cancel any adverse claim on a property. Any subsequent violation of a request by an owner to vacate or stay off of a property shall be a criminal matter and the violator shall be treated as a felon. Local, state, bureaucratic, and other small regulatory restrictions on the placing of fences or other barriers to illicit traffic through a property shall not in any way interfere with an owner's right to say "no" to trespass. Saying "no" to trespass shall include any spoken or written request, signage at any time frame, notice given of a trespass problem to any authority, or any other communication which makes it clear that the owner has not abandoned the property. 3) In the case of private communities such as co ops, condos, HOA communities, and more, any private management group or individual shall only have the ability to introduce relevant and minor regulations of behavior and property use. Such management shall not be allowed to in any way restrict behavior or property use which an ordinary owner of a private piece of real estate would not face from a local or state government, and may not in any way usurp or supersede local or state law. Under no circumstances should any private management ever have police powers. An exception can be made for limited regulation of attached or large apartment complexes to prevent dangerous or obnoxious use which interferes with the rights or safety of others. In such cases, any state or local regulations shall apply if those local or state regulations are less restrictive. Even in such cases, private enforcement shall require a due process through the courts. No private entity ever has the right to make and enforce its own laws. 4) No eminent domain seizure should ever be allowed for the gain of a private entity at the expense of another. Under no circumstances should a private entity be given ownership of another party's real property through eminent domain seizure. There is only one reason why a private entity would want to use the eminent domain process to acquire another entity's real property, and that is corruption. We live in a capitalist society. Everybody has a price. If a private entity wants the property of another, they can make an offer of sufficient size to entice a sale. Under no circumstances does one have the right to substitute the eminent domain seizure process for being unwilling or too cheap to do business. An owner has every right to refuse a sale if they don't wish to vacate their property. The only entity which has the right to use and benefit from eminent domain seizure is the government, and only for dire military need, or for public utilities when there is no other choice. 5) The absolute flat real property tax must be abolished. It has been ruled that the power to tax is the power to destroy. Since property rights are a constitutionally recognized basic human right, property rights may not be taxed. Only the owner can be taxed. A taxing authority never has the right to use the real property tax to force an owner off of their land or out of their home. Real property taxes should be based not only on land value but on income. Real property taxes should never be allowed to be used to force negative cash flow on an owner who does not earn enough money to pay the taxes. Real property taxes should never be greater than the federal or state income taxes paid by a property owner. Being "land rich" is not a crime and government does not have the right to tax us out of our real property. Real property taxes should be based upon a definite and simple formula which includes income, property value, and ability to pay after reasonable living expenses.

Honestly, I've never had to deal with HOA before, but from what I hear about them I would NEVER buy a house that has one, NOBODY is gonna tell me what I can or can't do with my own home that my hard earned money is paying for. One time, when I was looking for a house and I found out there was an HOA, I immediately walked out of the realtor's office. They were shocked and was begging me to come back.

One of our neighbours had complained about the big half pipe I built in my yard because my neighbour and I don't have a fence in between our house and whenever they had parties they'd use our property since their's has a big tree in the middle of their yard, we didn't mind though we let them have their parties we never really threw parties and when we did it was always our yard. Note my neighbours have a about 8 kids and whenever their family comes it multiplies by 10. Once I had installed it they started saying that they'll call the city and report that that's illegal because we need a permit. I later found out that the city of Chicago didn't care as long as it wasn't bigger than my garage and it wasn't. Our neighbours never spoke to us again. Now imagine if we had HOA I would probably never have had my half pipe

there should be some regulations put ion place that govern how HOA's are run and to limit the scope of power HOA's have over home owners. HOA's serve a purpose by keeping housing areas clean and keeping your property values up but in turn you sell your basic human rights to do whatever you want to your own house. everything from the color you paint it, to how many cars can park in front of your house and some HOA's even require you to seek approval before you host a party at your OWN HOUSE. Someone in HUD has to step up and limit these bloated associations power and cap how much they can charge in fines. $100 a day for having small trees - ludicrous.

Nah, most are very good. Most operate like a true democratic system, even more so than the way the US government operates. Wherein the choice of most becomes the rule. We've had online votes sent out and even before the board meetings to officially void the rules, the HOA would send out an email saying we're not going to enforce this rule. It's usually the HOAs that are managed by outside contractors that really suffer and are hated. Ours is community managed with residents holding voting positions. They even added a position where a renter represented the renters since we live in a military community and about 25% of the community is occupied by renters.

xREZxTITANx Yes it makes my life easier and more freedom to do what I want. Somebody else cut the grass,landscape,maintenance,etc.. We have gates and security here so I can leave and be away for long periods of time without worry. I have the smallest unit(1500sqft) with two car garage,2bed/2bath with two balconies and Italian stucco design. Largest unit 2100sqft and 42 floor plans. I live in Tulsa. But I have been in Switzerland since mid July for Lugano Estival Jazz and will be here until the end of August doing some sailing and hiking. I have a home here.....a large 6 bedroom Italian farmhouse I bought and restored in 2001 that overlooks the lake with views of Mountains and many palm trees. It's a b&b three months a year. Also own an apartment in Rome with a rooftop garden that's a rental.....passive income and place to stay when there. You can see the dome from this place. During the Great Recession and housing crisis I bought another condo which over looks the gulf and marina. Cash was king back then and cheap homes for sale all over the country. This condo was $560k and I bought it as a short sale fully furnished for $240k cash on Marco Island. This is another place I don't need to worry about and I don't rent it out because it's too nice of place. My type of condo is in demand now because the eye of hurricane went right over it last year and no damage. I was there. Steel and concrete low rise structure with push button hurricane shutters that comes down over windows and envelopes the wraparound balconies. The value of it is back over $500k. And again....I have the freedom to do what "I" want. I'm a $160k/yr aerospace metallurgical engineer. I'm completely debt free,work 4 days a week,and can take off 6 weeks to 3 months off work without pay on top of the 5 weeks paid vacation each year. Like I said I've been in Europe since mid July until September. Last year I spent October through December traveling,exploring,and hiking through New Zealand,Cooks,Malaysia,Singapore,and Hong Kong with girl friend.This a December I will be traveling somewhere again. I take many mini vacations and long weekends as well or just take a day or two off work to read a book if I wish. I have free lifetime global flight benefits and take full advantage of them. I left Lockheed SkunkWorks and NASA to live in a cheaper part of the country and get these free flight benefits and still make close to the same pay. So I have great job,great pay,and freedom to do what I want so condos work for me.

Literally if anyone gets into issue with a HOA, take them to court. Any cheapass lawyer will see through their petty bullshit. You get a settlement, they get smacked for being a bunch of tyrants.

W00DCHUCK Ya, everyone should have the same boring light brown house. There’s nothing wrong with a blue house or a red house or a green house, etc. You get a littler personality to the neighborhood. I’ve seen many house in all kinds of colors and they look great. I know of one house that was fighting the city over something, I don’t remember what it was, but they painted the house black and purple. It was like that for a number of years. Hey, at least it didn’t look like anyone else’s house. You should be free to paint your house however you want.

other way around - if the HOA is well run, the homes are very desireable because you have fair confidence someone isn't going to trash the neighborhood up around yours... have owned a couple in HOAs - they sell 1st.

We have come home now, most of us anyway, so have fun fuckers, after they detonate a few VBIEDs or IEDs at your local grocery store or on the way to it, maybe then you will see how it was easier to bomb us there than it would've been to have to come all the way over here to bomb your fat ungrateful asses waddling out of Walmart. I GOT IN TROUBLE WITH MY HOA OVER TOMATO AND RHUBARB PKANTS! In 2008, I planted 5 tomato plants in my backyard. I also planted rhubarb. Soon after, I got a citation for them. It told me my tomato and rhubarb plants violated the bylaws forbidding "agricultural activity". So, the HOAcompared my tomato and rhubarb to a full-scale farm. I tried resisting them, told them these small plants were only for the enjoyment and consumption of my family, but the board would have none of It! The HOA had their lawyers (yes lawyers , as in the pleare!) Call me at work, at home, and even send a DEMAND letter ordering me to remove the "nusence foleage" within 5 days or else face a $500 fine, and potential legal action up to liens, and a lawsuit! So, I finally had to dig up the tomatoes and rhubarb. So now, we have nothing to grow but grass!
