Hello po, NEED YOUR HELP ATTY. ask lang po atty. Required Po ba talaga mag-back to zero kapag may kulang at may mali na nirecord sa complaint form. Naka-1st ammended na Po kasi Ako . Kaso may kulang lang na date of dismissal sa form ko. Ang Sabi sa NLRC back to zero daw Po Ako ulit.😭 Nasa position papers na Po Sana Ako kaso may kulang sa form ko na date of dismissal. May mga tinanungan Po akong atty. Ang Sabi saken kaylangan kumpleto Yun para di matalo sa kaso. PANO Po iyon mag-back to zero na Naman Ako sa hearing?

I would like to ask if an intern can be considered an employee if it can be proved that the employer exercises control over the work performed by the intern and there is no proof that the intern was doing the job in relation to the requirements of his academic degree or profession?

Hi Atty. Duka, are regular employees being full time or part time? more specifically if they are employed and doing part time in grab car or other transportation business w/o employer-employer relationship.

Hi Dean, Sadden as I missed your lecture. I would humbly asked po sana re unauthorized deduction. Here's the situation, this existing company policy re double deduction of lates was up for months now. Employee(s) who came beyond the allowable grace period was charged double (example: 11 mins late equates to 22 mins of late) on employee's salary. Need your insight on the matter Thank you

Dean halimbawa po ngksundo ang both parties mbbgyan ng separation pay kso ileles dw po doon ung mga balance na naiwan pa s mga vale ng employees then kung negative pa at my mtira pa n balance pde dw bawiin ung lupa na pinahulugan sa employees pero mga bayad na. Ano po advice nyo tuloy p po ba ang pgtnggap ng separation pay or wag nlng po? Tnx po

natural lang na ibawas sa separation pay ang mga utang nya. kung kanya na ang lupa sya ang bahala magdesisyon kung ibabayad nya yun

Ask ko lang po if worked sa regular holiday then restday 230% lang po? hindi po ba 260% ? yun po kasi nakalagay sa handbook 2023 edition clear ko lang po sana kung ano po yung tama pati po if double holiday falls on restday tas nagwork 330% lang po? sa handbook po kasi 390% ang nakalagay

230% lang kasi ang dinodoble lang ay holiday pay at hindi ang ang premium for rest day lugi at magrereklamo ang employer. 330% lang yun. you may refer to NIPPON PAINT PHILIPPINES, INC., v. NIPPON PAINT PHILIPPINES EMPLOYEES ASSOCIATION [NIPPEA], G.R. No. 229396, June 30, 2021

Magandang araw po atty mayron po sana akong idudulog about my labor dispute yr 2018 pa naging final and executory sa nlrc because of the neglegence of my council, I have a pending complaint sa ibp with regard to this lawyer at hinhintay ko pa decision frm sc, my question is there any avenue to refile my labor dispute since kasalanan naman ng abogado kung bakit nawalan nh saysay ang claim ko, salamat po atty

Atty Dean ano po yung retrenchment and company closure na ifinile ng employer s Dole? Labor code 297 yung #3 po ang hindi nila ngwa s mga employees. Hindi po pti ipinaalam s employees na tuluyan ng ippsara yung company. Ang reason nalugi. Pero yung company na yun close n s report ng dole, lgu pero iniapply ulit iopen kso ibang name na po sa anak n nkaname kya nag ooperate p po now. Ang tanong lng po may chance p po b kmi n mghbol khit close n pero wla nmn ntnggap n separation pay slmt po
